To all insurance regulatory bureaus and insurance companies:

In order to alleviate the financial burden of companies, employers, and individuals in the areas that are heavily affected by the Wenchuan Earthquake, and to support post-disaster reconstruction, the Ministry of Finance and the National Development and Reform Commission have decided to reduce or exempt partial administrative charges of the said earthquake-stricken areas. We hereby forward theNotice of the Ministry of Finance and the National Development and Reform Commission on Relevant Issues Concerning Reduction or Exemption of Partial Administrative Charges for Areas Heavily Affected by Wenchuan Earthquake (Cai Zong [2008] No. 50, hereinafter referred to as the "Notice") to you, please earnestly study and accordingly implement it. The specific requirements are as follows:

    各保监局,各保险公司:

    为减轻地震受灾严重地区的企业、单位和个人经济负担,支持灾后重建,财政部、国家发展改革委决定对受灾严重地区减免部分行政事业性收费。现将《财政部国家发展改革委关于对汶川地震受灾严重地区减免部分行政事业性收费等问题的通知》(财综〔2008〕50号,以下简称《通知》)转发给你们,请认真学习,遵照执行。具体要求通知如下:

1. Insurance regulatory bureaus and insurance companies shall forward the Notice. 

       一、各保监局和保险公司要逐级转发《通知》,传达文件精神,切实抓好落实工作。

2. Each insurance regulatory bureau shall be responsible for establishing a count, within the area of its jurisdiction, of the number of branch offices of the insurance intermediaries with legal person status in the disaster-stricken areas and the expected amount of reduction or exemption of insurance business regulatory fees, and specify the process of measurement and calculation. 

       二、保监局负责统计辖区内的保险中介法人机构在受灾地区的分支机构数量和保险业务监管费预计减免金额,说明测算过程。

3. Each insurance company shall be responsible for establishing a count of the number of its branches in the disaster-stricken areas and the expected amount of reduction or exemption of insurance business regulatory fees, and specify the process of measurement and calculation based on the charging items and standards. 

       三、保险公司负责统计本公司在受灾地区分支机构数量和保险业务监管费的预计减免金额，按收费项目和标准说明测算过程。

Notice of the Ministry of Finance and the National Development and Reform Commission on Relevant Issues Concerning Reduction or Exemption of Partial Administrative Charges for Areas Heavily Affected by Wenchuan Earthquake

In accordance with the Opinions of the State Council on Policies and Measures for Wenchuan Recovery and Post-disaster Construction (Guo Fa [2008] No. 21) and to alleviate the financial burden of companies, employers, and individuals in the areas severely affected by Wenchuan Earthquake, and to support recovery and post-disaster reconstruction, we hereby issue this Notice as follows regarding the relevant issues on reduction or exemption of partial administrative charges of the areas heavily affected by the earthquake:

   根据《国务院关于支持汶川地震灾后恢复重建政策措施的意见》（国发[2008]21号）的规定，为减轻受灾严重地区的企业、单位和个人经济负担，支持灾后恢复重建，现将对受灾严重地区减免部分行政事业性收费等有关问题通知如下:

1. Relevant enterprises within the severely stricken areas of the earthquake shall be exempted from the following administrative charges from the date of printing and distribution of this Notice until June 30, 2011. 

(1) All construction companies are exempt from the fees falling under the revenue of the Central Government, including the rated engineering measurement fee, construction project quality supervision fees, compensation for occupation of agricultural irrigation water source and facilities, water conservancy engineering quality supervision fees, and railway engineering quality supervision fees. 

(2) All mineral resources exploitation enterprises are exempt from the fees falling under the revenue of the Central Government, including mineral resources' compensation fees, mineral exploration and mining royalties, oil (natural gas) exploration and mining registration fees, mineral mining registration fees, and mineral resources' exploration registration fees. 

(3) All banks, credit cooperatives, and postal savings institutions (including legal person institutions registered in the affected areas and branch offices situated in the affected areas) are exempted from the banking regulatory fees and business regulatory fees. 

(4) All insurance companies, insurance intermediaries (including legal person institutions registered in the affected areas and branch offices situated in the affected areas) are exempted from insurance regulatory fees. 

(5) All securities, funds, and futures companies (including legal person institutions registered in the affected areas and branch offices situated in the affected areas) are free of securities market regulatory fees.

(6) All power enterprises are exempted from power regulatory fees.

   一、自本通知印发之日起至2011年6月30日止，对受灾严重地区内的有关企业，免收下列行政事业性收费。

   （一）对建筑企业，全部免收属于中央收入的工程定额测定费、建设工程质量监督费、占用农业灌溉水源及设施补偿费、水利建设工程质量监督费、铁路工程质量监督费。

   （二）对矿产资源开采企业，全部免收属于中央收入的矿产资源补偿费、探矿权采矿权使用费、石油（天然气）勘查开采登记费、采矿登记费、矿产资源勘查登记费。

   （三）对银行、信用社、邮政储蓄机构（包括注册地在受灾地区的法人机构及在受灾地区的分支机构），全部免收银行业机构监管费和业务监管费。

   （四）对保险公司、保险中介机构（包括注册地在受灾地区的法人机构及在受灾地区的分支机构），全部免收保险业务监管费。

   （五）对证券、基金、期货公司（包括注册地在受灾地区的法人机构及在受灾地区的分支机构），全部免收证券市场监管费。

   （六）对电力企业全部免收电力监管费。

2. In implementation of the policy for discharging the branch office of a financial business from banking regulatory fees, insurance regulatory fees, and securities market regulatory fees, the relevant regulatory authorities shall reduce the amount of payment by the enterprise legal person that establish the branch office in accordance with the assets and operating income of the branch office and assets and the ratio of operating income of the enterprise legal person. 

   二、在落实对金融企业的分支机构免收银行业监管费、保险业务监管费和证券市场监管费政策时，由相关监管机构根据金融企业分支机构的资产、营业收入及占其所属企业法人资产、营业收入比例等情况，相应核减其所属企业法人的缴费数额。

3. In the severely affected areas of Sichuan, Gansu, and Shaanxi provinces, the administrative charges falling under the local revenue as approved by the Central Government and the administrative charges imposed under provincial regulations shall be appropriately reduced or exempted based on local situations. At the same time, various arbitrary charges in violation of regulations shall be cancelled. 

   三、四川、甘肃、陕西省要根据本地实际情况，对受灾严重地区酌情减免由中央级批准属于地方收入的行政事业性收费，以及本省出台的行政事业性收费。同时，各地要坚决取消违规出台的各种乱收费项目。

4. Companies, employers, and individuals of other regions who come to the severely stricken areas to establish new companies and help restore production may be granted the aforesaid charge reduction or exemption policy.

       四、其他地区的企业、单位和个人到受灾严重地区新建企业、帮助灾区恢复生产,享受上述收费减免政策。

5. To support mining enterprises in the disaster areas to restore production and development, during the period from the printing and distribution of this Notice till June 30, 2011, the mineral resources' compensation fees, royalties for mineral exploration and mining rights, and mineral exploration right purchase price, collected in Sichuan, Gansu, and Shaanxi and payable to the Central Government shall be retained in full by the local government.. Collection organizations shall directly pay the said revenue to local treasury, with the specific policies formulated, respectively, by the municipal governments of Sichuan, Gansu, and Shaanxi provinces. 

       五、为支持灾区的矿山企业恢复生产和发展,自本通知印发之日起至2011年6月30日止,将四川、甘肃、陕西省的矿产资源补偿费、探矿权采矿权使用费、矿业权价款收入中央分成部分全额留给地方。执收单位收取上述收入后直接缴入地方国库,具体政策由四川、甘肃、陕西省人民政府规定。

6. The policy of implementing the reduction or exemption of partial administrative charges for severely stricken areas is an important measure of the State to promote restoration and reconstruction in disaster affected areas. The relevant areas and department shall earnestly implement the policy and promptly make a written report about the implementation of the policy in the area, or by the department, to the Ministry of Finance and the National Development and Reform Commission. Departments in charge of finance and price in Sichuan, Gansu, and Shaanxi provinces, and financial supervision commissioner's offices of the Ministry of Finance in Sichuan, Gansu, and Shaanxi provinces shall strengthen the supervision and inspection of implementation of this Notice in accordance with their responsibilities and impose serious punishment on any department and organization that fails to implement the policy in accordance with the relevant regulations. 

       六、对受灾严重地区实行减免部分行政事业性收费等政策，是国家为促进灾区恢复重建而采取的重要措施，各有关地区和部门要切实抓好落实工作，并及时将本地区、本部门贯彻落实本通知情况，以书面形式报送财政部、国家发展改革委。四川、甘肃、陕西省财政、价格主管部门和财政部驻四川、甘肃、陕西省财政监察专员办事处要按照各自职责加强对落实本通知情况的监督检查，对不按规定落实政策的部门和单位，要予以严肃处理。
