In order to fully implement the guiding principles of the Party Central Committee on solving the problem of the difficulty in enforcing judgments, to create a new situation of enforcement work characterized by leadership by the Party committees, supervision by the people's congresses, support by the governments, and cooperation and coordination among all sectors of society, to establish and improve a permanent mechanism to solve the problem of difficulty with enforcement, to ensure the effective enforcement of effective legal documents, to effectively maintain the legitimate rights and interests of citizens, legal persons and other organizations, to protect the authority and dignity of the law, and to promote the building of the social good-faith system, the following opinions are hereby formulated in respect of the establishment and improvement of the enforcement linkage mechanism in accordance with the provisions of relevant laws and policies.

    为深入贯彻落实中央关于解决执行难问题的指示精神,形成党委领导、人大监督、政府支持、社会各界协作配合的执行工作新格局,建立健全解决执行难问题长效机制,确保生效法律文书得到有效执行,切实维护公民、法人和其他组织的合法权益,维护法律权威和尊严,推进社会诚信体系建设,依据有关法律、政策规定,现就建立和完善执行联动机制提出以下意见。

   Article 1   With respect to any clues to violations of the laws and disciplines that Party members and administrative supervision objects hinder the enforcement of people's courts and interfere in the enforcement by people's courts in violation of the provisions, which are found in the enforcement and transferred by people's courts, the discipline inspection and supervision organs shall organize the checks and verification of such clues in a timely manner; if necessary, they shall put them on file for investigation. Where a Party member or administrative supervision object hinders the enforcement by a people's court or interferes in the enforcement by a people's court in violation of the provisions, or refuses to perform the obligations determined in the relevant effective legal document, the Party member or administrative supervision object shall be subject to a Party or administrative disciplinary sanction in accordance with the law or the discipline.

     第一条 纪检监察机关对人民法院移送的在执行工作中发现的党员、行政监察对象妨碍人民法院执行工作和违反规定干预人民法院执行工作的违法违纪线索,应当及时组织核查;必要时,应当立案调查。对于党员、行政监察对象妨碍人民法院执行工作或者违反规定干预人民法院执行工作,以及拒不履行生效法律文书确定义务的,应当依法依纪追究党纪政纪责任。

   Article 2   A personnel department shall, through complaints in the form of letters and visits from the public, public tip-offs, cadre examination and assessment and other means, timely learn and master the information such as a Party member or civil servant's refusal to implement an effective legal document, illegal interference, and obstruction of enforcement, urge the Party member or civil servant who has the abovementioned problems, by giving out warnings, conversations, and other means, to make corrections in a timely manner. With respect to a Party member or public servant who refuses to implement an effective legal document, illegally interferes in or obstructs enforcement, he or she shall be punished in accordance with the Regulations of the Communist Party of China on Disciplinary Penalties, the Regulations on Sanctions Against Public Servants of Administrative Organs and other relevant provisions.

     第二条 组织人事部门应当通过群众信访举报、干部考察考核等多种途径,及时了解和掌握党员、公务员拒不履行生效法律文书以及非法干预、妨害执行等情况,对有上述问题的党员、公务员,通过诫勉谈话、函询等形式,督促其及时改正。对拒不履行生效法律文书、非法干预或妨碍执行的党员、公务员,按照《中国共产党纪律处分条例》和《行政机关公务员处分条例》等有关规定处理。

   Article 3   A press and publicity department shall strengthen the publicity of the enforcement work of a people's court, educate and guide all sectors of society to arouse the awareness of good-faith, which forms a good tendency characterized by initiative performance of the obligations determined in an effective legal document, and assisting a people's court in the enforcement in accordance with the law, hold correct direction of public opinion, and enhance the risk awareness of market subjects. Such department shall cooperate with a people's court in establishing the public announcement system for the parties subject to enforcement, and timely expose the name list of the parties subject to enforcement which is published upon authorization by a people's court and other acts of interfering in and obstructing enforcement.

     第三条 新闻宣传部门应当加强对人民法院执行工作的宣传,教育引导社会各界树立诚信意识,形成自觉履行生效法律文书确定的义务、依法协助人民法院执行的良好风尚;把握正确的舆论导向,增强市场主体的风险意识。配合人民法院建立被执行人公示制度,及时将人民法院委托公布的被执行人名单以及其他干扰、阻碍执行的行为予以曝光。

   Article 4   A comprehensive administration department shall include in the scope of objective and responsibility assessment of the comprehensive administration over public security the information about recognition and support of the enforcement of people's courts by the local Party committee, people's congress, government, and political consultative conference at its same level, the performance of debts by the parties subject to enforcement, in particular, the special subjects, relevant departments' assistance in the enforcement in accordance with the law, and the implementation of enforcement aid funds etc. A comprehensive administration department shall establish and improve a basic network for assistance with enforcement, and fully play the role of basic organizations, thereby cooperating with people's courts to properly handle the enforcement.

     第四条 综合治理部门应当将当地党委、人大、政府、政协重视和支持人民法院执行工作情况、被执行人特别是特殊主体履行债务情况、有关部门依法协助执行的情况、执行救助基金的落实情况等,纳入社会治安综合治理目标责任考核范围。建立健全基层协助执行网络,充分发挥基层组织的作用,配合人民法院做好执行工作。

   Article 5   The procuratorial organ shall, in accordance with the law, strictly and promptly prosecute the persons who refuse to implement the rulings and decisions of a court, or otherwise obstructs the enforcement, which constitutes a crime, investigate and handle the cases involving dereliction of duty, embezzlement and bribery and other duty crimes occurring during the enforcement.

     第五条 检察机关应当对拒不执行法院判决、裁定以及其他妨害执行构成犯罪的人员,及时依法从严进行追诉;依法查处执行工作中出现的渎职侵权、贪污受贿等职务犯罪案件。

   Article 6   A public security organ shall, in accordance with the law, severely crack down on violations of laws such as the refusal to implement the decision or ruling of a court and other obstruction of enforcement; with respect to any hindrance or resistance of enforcement through violence or threat, it shall promptly dispatch the police to handle in accordance with the law upon receipt of notification from a people's court. When a public security organ is assisting the people's court with inquiry about the household registration and whereabouts of a party subject to enforcement and found, during the performance of its duties, it necessary for the people's court to detain or summon by force the party subject to enforcement, it shall timely notify the people's court of the same; with respect to the person whom the people's court decides to detain, the public security organ shall take such person into custody in a timely manner. A public security organ shall assist in restricting a party subject to enforcement from exit, assist a people's court in handling the formalities for the registration of seal-up, seizure or transfer etc of vehicles, and, when finding the properties of a party subject to enforcement such as vehicles, shall timely notify the people's court responsible for enforcement of relevant information.

     第六条 公安机关应当依法严厉打击拒不执行法院判决、裁定和其他妨害执行的违法犯罪行为;对以暴力、威胁方法妨害或者抗拒执行的行为,在接到人民法院通报后立即出警,依法处置。协助人民法院查询被执行人户籍信息、下落,在履行职责过程中发现人民法院需要拘留、拘传的被执行人的,及时向人民法院通报情况;对人民法院在执行中决定拘留的人员,及时予以收押。协助限制被执行人出境;协助人民法院办理车辆查封、扣押和转移登记等手续;发现被执行人车辆等财产时,及时将有关信息通知负责执行的人民法院。

   Article 7   A legislative affairs department of a government shall, in accordance with the law, perform its duties of record-filing examination and supervision, and strengthen the record-filing examination. Where any rules and regulations submitted for record-filing and the administrative decisions and decrees with universal binding force promulgated by relevant governmental organs are found to involve exceeding of authority, violation of the provisions of a superior law or a statutory procedure, or inappropriate provisions, or any other circumstance, which is detrimental to the enforcement by a people's court, the legislative affairs department shall handle the same in accordance with the Regulations on Submission of Regulations and Rules for the Record and other provisions.

     第七条 政府法制部门应当依法履行备案审查监督职责,加强备案审查工作,对报送备案的规章和有关政府机关发布的具有普遍约束力的行政决定、命令,发现有超越权限、违反上位法规定、违反法定程序、规定不适当等情形,不利于人民法院开展执行工作的,应当依照《法规规章备案条例》等规定予以处理。

   Article 8   A civil administration department shall properly provide relief to an enforcement applicant with financial hardship in a timely manner in accordance with relevant provisions.

     第八条 民政部门应当对生活特别困难的申请执行人,按照有关规定及时做好救助工作。

   Article 9   A development and reform department shall assist a people's court with inquiry about the information on project establishment and relevant materials for the construction project relating to a party subject to enforcement; if the party subject to enforcement is applying for the handling of the formalities for examination, verification, approval and record-filing of a project, the development and reform department shall conduct coordination among relevant departments and localities relationship for assisting a people's court in accordance with the law in having relevant formalities stopped.

     第九条 发展和改革部门应当协助人民法院依法查询被执行人有关工程项目的立项情况及相关资料;对被执行人正在申请办理的投资项目审批、核准和备案手续,协调有关部门和地方,依法协助人民法院停止办理相关手续。

   Article 10   A judicial administrative department shall strengthen the publicity and education concerning the law, enhance the legal sense of the people, and improve the obligators' consciousness for initiatively implementing effective legal documents. The judicial administrative department shall promote a healthy attitude of cadres at all levels toward law-based support in the enforcement by a people's court, and overcome local and departmental protectionism. With respect to a case in which the party subject to enforcement is a prison or a reeducation-through-labor center, the judicial administrative department shall urge the party to perform in a timely manner. It shall guide lawyers, notarial personnel and basic legal service workers to provide proper services for the parties concerned, and actively perform the obligations determined in effective legal documents. With respect to a case in which the party subject to enforcement is a person who serves a sentence, or subjects himself or herself to reeducation through labor or compulsory detoxification, the prison, reeducation-through-labor center, or compulsory detoxification center shall actively assist a people's court in the enforcement in accordance with the law.

     第十条 司法行政部门应当加强法制宣传教育,提高人民群众的法律意识,提高债务人主动履行生效法律文书的自觉性。对各级领导干部加强依法支持人民法院执行工作的观念教育,克服地方和部门保护主义思想。对监狱、劳教单位作为被执行人的案件,督促被执行人及时履行。指导律师、公证人员和基层法律服务工作者做好当事人工作,积极履行生效法律文书确定的义务。监狱、劳教所、强制隔离戒毒所对服刑、劳教人员和强制隔离戒毒人员作为被执行人的案件,积极协助人民法院依法执行。

   Article 11   A land and resources administrative department shall assist a people's court in making timely inquiry about the registration of land use rights, prospecting rights, mining rights and relevant ownership etc., timely assist the people's court in handling the registration of seal-up, pre-seal-up, and queued-up seal-up of land use rights, prospecting rights, mining rights etc., and timely notify relevant information to the people's court. If the party subject to enforcement goes through the formalities for change of the registration of land use rights, prospecting rights, mining rights or other ownership, the land and resources administrative department shall stop handling relevant formalities according to the requirements of a written enforcement assistance notice issued by the people's court. If an obligee applies for going through the formalities for change of the registration of land use rights by presenting an effective legal document, the land and resources administrative department shall handle such formalities in accordance with the law.

     第十一条 国土资源管理部门应当协助人民法院及时查询有关土地使用权、探矿权、采矿权及相关权属等登记情况,协助人民法院及时办理土地使用权、探矿权、采矿权等的查封、预查封和轮候查封登记,并将有关情况及时告知人民法院。被执行人正在办理土地使用权、采矿权、探矿权等权属变更登记手续的,根据人民法院协助执行通知书的要求,停止办理相关手续。债权人持生效法律文书申请办理土地使用权变更登记的,依法予以办理。

   Article 12   A housing and urban-rural development administrative department shall assist a people's court in making timely inquiry about the information relating to the registration, change, mortgage etc. of housing ownership, timely assist the people's court in handling the formalities for the registration of seal-up, pre-seal-up, and queued-up seal-up as well as transfer of houses, and timely notify the people's court of the relevant information. If the party subject to enforcement goes through the formalities for the registration of transfer of ownership of a house, the housing and urban-rural development administrative department shall stop handling the formalities according to the requirements of a written enforcement assistance notice issued by the people's court. Where the people's court that conducts the queued-up seal-up requires assistance with the handling of the formalities for registration of a house in violation of the law, the housing and urban-rural development administrative department shall refuse to handle such formalities in accordance with the law. Where an obligee applies for going through the formalities for registration of the transfer of a house by presenting an effective legal document, the housing and urban-rural development administrative department shall handle such formalities in accordance with the law. A housing and urban-rural development administrative department shall assist a people's court in making inquiry about the information relating to the examination and approval of the planning of a project, and provide the people's court with necessary approved materials such as planning documents and drawings. Where the party subject to enforcement applies for going through the formalities for the examination and approval for the planning of a project involved, the housing and urban-rural development administrative department shall stop handling relevant formalities according to the requirements of a written enforcement assistance notice issued by the people's court. A housing and urban-rural development administrative department shall include the information on a real estate enterprise or construction enterprise's failure to perform the obligations under an effective legal document in the credit archives for the real estate and construction market, and disclose relevant information to the public. Where the party subject to enforcement default on compensation and resettlement funds for housing removal, the housing and urban-rural development administrative department shall take sanctions in accordance with the law.

     第十二条 住房和城乡建设管理部门应当协助人民法院及时查询有关房屋权属登记、变更、抵押等情况,协助人民法院及时办理房屋查封、预查封和轮候查封及转移登记手续,并将有关情况及时告知人民法院。被执行人正在办理房屋所有权转移登记等手续的,根据人民法院协助执行通知书的要求,停止办理相关手续。轮候查封的人民法院违法要求协助办理房屋登记手续的,依法不予办理。债权人持生效法律文书申请办理房屋转移登记手续的,依法予以办理。协助人民法院查询有关工程项目的规划审批情况,向人民法院提供必要的经批准的规划文件和规划图纸等资料。被执行人正在申请办理涉案项目规划审批手续的,根据人民法院协助执行通知书的要求,停止办理相关手续。将房地产、建筑企业不依法履行生效法律文书义务的情况,记入房地产和建筑市场信用档案,向社会披露有关信息。对拖欠房屋拆迁补偿安置资金的被执行人,依法采取制裁措施。

   Article 13   A people's bank shall assist a people's court in making inquiry about the information on the account of a party subject to enforcement in the Renminbi banking accounting management system, and include the information on such party's failure to perform the obligations determined in an effective legal document provided by a people's court in the credit information basic database for enterprises and individuals.

     第十三条 人民银行应当协助人民法院查询人民币银行结算账户管理系统中被执行人的账户信息;将人民法院提供的被执行人不履行法律文书确定义务的情况纳入企业和个人信用信息基础数据库。

   Article 14   A banking regulatory department shall supervise the banking financial institutions to actively assist people's courts in making inquiry about the information on account opening and savings of the parties subject to enforcement, and timely handle the matters such as freeze, queued-up freeze and withholding and transfer of savings in accordance with the law. If a financial institution refuses to perform an effective legal document, or to assist a people's court in enforcement, the banking regulatory department shall subject relevant personnel to the liability in accordance with the law. A banking regulatory department shall formulate the provisions requiring a financial institution to make the necessary restriction on a party subject to enforcement from applying for a loan, and require a financial institution to consult the credit information basic database for enterprises and individuals when granting loans, and take the information on such party's performance of the obligations determined in an effective legal document as a factor for consideration in loan examination and approval. If a party subject to enforcement who refuses to perform the obligations under an effective legal document involves a financial debt, the banking regulatory department may refuse to open a new account for, to grant a new loan to, or to handle external payment for, such party or take other sanctions.

     第十四条 银行业监管部门应当监督银行业金融机构积极协助人民法院查询被执行人的开户、存款情况,依法及时办理存款的冻结、轮候冻结和扣划等事宜。对金融机构拒不履行生效法律文书、拒不协助人民法院执行的行为,依法追究有关人员的责任。制定金融机构对被执行人申请贷款进行必要限制的规定,要求金融机构发放贷款时应当查询企业和个人信用信息基础数据库,并将被执行人履行生效法律文书确定义务的情况作为审批贷款时的考量因素。对拒不履行生效法律文书义务的被执行人,涉及金融债权的,可以采取不开新户、不发放新贷款、不办理对外支付等制裁措施。

   Article 15   A securities regulatory department shall supervise a securities registration and settlement institution or a securities or futures operation institution to assist a people's court in accordance with the law in making inquiry about, freezing, withholding and transferring securities and securities transaction settlement funds. A securities regulatory department shall urge securities companies acting as the parties subject to enforcement to initiatively perform the obligations determined in an effective legal document. If a securities registration and settlement institution or securities company refuses to perform the obligations determined in an effective legal document or to assist a people's court in enforcement, the securities regulatory department shall urge relevant departments to impose liability on relevant persons in charge and the persons directly responsible in accordance with the law.

     第十五条 证券监管部门应当监督证券登记结算机构、证券、期货经营机构依法协助人民法院查询、冻结、扣划证券和证券交易结算资金。督促作为被执行人的证券公司自觉履行生效裁判文书确定的义务;对证券登记结算机构、证券公司拒不履行生效法律文书确定义务、拒不协助人民法院执行的行为,督促有关部门依法追究有关负责人和直接责任人员的责任。

   Article 16   A taxation authority shall, in accordance with the law, assist a people's court in investigating the information on the properties of a party subject to enforcement, and provide relevant information such as tax payment of such party. A taxation authority shall, according to the requirements of a written enforcement assistance notice issued by the people's court, provide the information such as the tax refund account, amount of tax refund, and the date of tax refund of a party subject to enforcement. If such party fails to pay taxes, or underpay taxes, the taxation authority shall request the court to demand the payment of such taxes according to the statutory order of priority for debt repayment, and turn over revenues to the State Treasury according to the level of budgeted tax.

     第十六条 税务机关应当依法协助人民法院调查被执行人的财产情况,提供被执行人的纳税情况等相关信息;根据人民法院协助执行通知书的要求,提供被执行人的退税账户、退税金额及退税时间等情况。被执行人不缴、少缴税款的,请求法院依照法定清偿顺序追缴税款,并按照税款预算级次上缴国库。

   Article 17   An industrial and commercial administrative department shall assist a people's court in making inquiry about the information relating to the registration of establishment, change and deregistration etc. of an enterprise, and shall, in accordance with relevant provisions, assist a people's court in handling the formalities for the registration of the freeze or transfer of equity interests of a limited liability company held by a party subject to enforcement. With respect to an enterprise that applies for deregistration, the industrial and commercial administrative department shall strictly implement the liquidation system to prevent the party subject to enforcement from transferring properties and avoiding enforcement. An industrial and commercial administrative department shall step by step enter a party subject to enforcement who fails to legally perform the obligations determined in an effective legal document into the classified regulatory system for enterprise credit.

     第十七条 工商行政管理部门应当协助人民法院查询有关企业的设立、变更、注销登记等情况;依照有关规定,协助人民法院办理被执行人持有的有限责任公司股权的冻结、转让登记手续。对申请注销登记的企业,严格执行清算制度,防止被执行人转移财产,逃避执行。逐步将不依法履行生效法律文书确定义务的被执行人录入企业信用分类监管系统。

   Article 18   A people's court shall enter relevant information of enforcement cases in a timely, comprehensive and accurately manner into an information management system for enforcement cases, and realize the linkage between information systems of relevant departments, thereby providing basic data and information for the smooth operation of the enforcement linkage mechanism.

     第十八条 人民法院应当将执行案件的有关信息及时、全面、准确地录入执行案件信息管理系统,并与有关部门的信息系统实现链接,为执行联动机制的顺利运行提供基础数据信息。

   Article 19   Where a people's court deems it necessary to take enforcement linkage measures for a party subject to enforcement, the people's court shall prepare a legal document such as a written enforcement assistance notice or a judicial proposal letter, and serve the same on relevant departments.

     第十九条 人民法院认为有必要对被执行人采取执行联动措施的,应当制作协助执行通知书或司法建议函等法律文书,并送达有关部门。

   Article 20   A relevant department shall assist in taking enforcement linkage measures within its statutory functions after receiving a written enforcement assistance notice or a judicial proposal letter. A relevant department that provides enforcement assistance shall not conduct substantial examination over an effective legal document, a written enforcement assistance notice, a judicial proposal letter etc. If a relevant department has an opposition enforcement linkage measures requested by a people's court, such department may make a review proposal, but shall not refuse to take the relevant measures.

     第二十条 有关部门收到协助执行通知书或司法建议函后,应当在法定职责范围内协助采取执行联动措施。有关协助执行部门不应对生效法律文书和协助执行通知书、司法建议函等进行实体审查。对人民法院请求采取的执行联动措施有异议的,可以向人民法院提出审查建议,但不应当拒绝采取相应措施。

   Article 21   Where a party subject to enforcement performs the obligations determined in an effective legal document in accordance with the law, or the enforcement applicant agrees to termination of enforcement linkage measures, the people's court shall terminate appropriate measures when, upon examination, believing that such termination complies with relevant provisions. If the party subject to enforcement provides guarantee to request termination of enforcement linkage measures, the people's court shall render a decision upon examination.

     第二十一条 被执行人依法履行了生效法律文书确定的义务或者申请执行人同意解除执行联动措施的,人民法院经审查,认为符合有关规定的,应当解除相应措施。被执行人提供担保请求解除执行联动措施的,由人民法院审查决定。

   Article 22   The work leading group for the enforcement linkage mechanism shall be formed in order to guarantee the establishment and effective operation of the enforcement linkage mechanism, with members including the Central Commission for Discipline Inspection of the CPC, the Organization Department of the CPC Central Committee, the Propaganda Department of the CPC Central Committee, the Commission of Politics and Law of the CPC Central Committee, the Central Committee for Comprehensive Management of Public Security, the Supreme People's Court, the Supreme People's Procuratorate, the National Development and Reform Commission, the Ministry of Public Security, the Ministry of Supervision, the Ministry of Civil Affairs, the Ministry of Justice, the Ministry of Land and Resources, the Ministry of Housing and Urban-Rural Development, the People's Bank of China, the State Administration of Taxation, the State Administration for Industry and Commerce, the Legislative Affairs Office of the State Council, the China Banking Regulatory Commission, the China Securities Regulatory Commission, and relevant departments. The work leading group shall have an office with specific responsibilities for the organization, coordination, supervision, guidance and other work during the establishment and operation of the enforcement linkage mechanism.

Each member department shall designate one liaison officer in charge of the liaison affairs in the operation of the enforcement linkage mechanism.

All regions shall each establish appropriate work leading group and office for the enforcement linkage mechanism.

     第二十二条 为保障执行联动机制的建立和有效运行,成立执行联动机制工作领导小组,成员单位有中央纪律检查委员会、中央组织部、中央宣传部、中央政法委员会、中央社会治安综合治理委员会办公室、最高人民法院、最高人民检察院、国家发展和改革委员会、公安部、监察部、民政部、司法部、国土资源部、住房和城乡建设部、中国人民银行、国家税务总局、国家工商行政管理总局、国务院法制办公室、中国银监会、中国证监会等有关部门。领导小组下设办公室,具体负责执行联动机制建立和运行中的组织、协调、督促、指导等工作。

    各成员单位确定一名联络员,负责执行联动机制运行中的联络工作。

    各地应成立相应的执行联动机制工作领导小组及办公室。

   Article 23   The politics and law committees at all levels shall lead the work leading group for the enforcement linkage mechanism to meet on a regular or irregular basis, notify relevant information, study and solve the problems occurred in the operation of the enforcement linkage mechanism to ensure the smooth operation of the enforcement linkage mechanism.

     第二十三条 执行联动机制工作领导小组由各级政法委员会牵头,定期、不定期召开会议,通报情况,研究解决执行联动机制运行中出现的问题,确保执行联动机制顺利运行。

   Article 24   If relevant organizations fails to perform its functions according to these Opinions, the people's court may make appropriate judicial proposal to the supervision organ or other relevant authorities, or report the same to the work leading group for the enforcement linkage mechanism for coordination and settlement, or handle the same in accordance with the provisions of Article 103 of the Civil Procedure Law of the People's Republic of China.

     第二十四条 有关单位不依照本意见履行职责的,人民法院可以向监察机关或其他有关机关提出相应的司法建议,或者报请执行联动机制领导小组协调解决,或者依照《中华人民共和国民事诉讼法》第一百零三条的规定处理。

   Article 25   In order to ensure the implementation of these Opinions, a people's court may, if necessary, formulate specific detailed implementing rules in conjunction with relevant departments.

     第二十五条 为确保本意见贯彻执行,必要时,人民法院可以会同有关部门制定具体的实施细则。
