The Provisions of the Supreme People's Court on Several Issues Concerning the Trials of Cases on Objection to Hierarchy-based jurisdiction over Civil Actions were adopted at the 1471th meeting of the Trial Committee of the Supreme People's Court on July 20, 2009, are hereby announced and shall come into force from January 1, 2010.

Provisions of the Supreme People's Court on Several Issues Concerning the Trials of Cases on Objection to Hierarchy-based Jurisdiction over Civil Actions

(Adopted at the at the 1471th meeting of the Trial Committee of the Supreme People's Court on July 20, 2009)

In order to properly try the cases on objection to hierarchy-based jurisdiction over civil actions, maintain litigation order and protect the legitimate interest of the parties concerned in accordance with the law, these Provisions are formulated in accordance with the provisions of the Civil Procedure Law of the People's Republic of China and based on adjudication practice.

    最高人民法院关于审理民事级别管辖异议案件若干问题的规定

    为正确审理民事级别管辖异议案件，依法维护诉讼秩序和当事人的合法权益，根据《中华人民共和国民事诉讼法》的规定，结合审判实践，制定本规定。

   Article 1   In the event that a defendant objects to the jurisdiction during the period for the submission of the statement of defence, and believes that the people's court that accepts the lawsuit violates the provisions relating to hierarchy-based jurisdiction and that the case shall be subject to the jurisdiction of the people's court at a higher or lower level, the people's court that accepts the lawsuit shall conduct a review and make a ruling within 15 days from the date the objection is accepted:

(1) If the objection is not established, the court shall render a decision to dismiss the objection;

(2) If the objection is established, the court shall render a decision to transfer the case to a people's court with jurisdiction.

     第一条 被告在提交答辩状期间提出管辖权异议,认为受诉人民法院违反级别管辖规定,案件应当由上级人民法院或者下级人民法院管辖的,受诉人民法院应当审查,并在受理异议之日起十五日内作出裁定:

    (一)异议不成立的,裁定驳回;

    (二)异议成立的,裁定移送有管辖权的人民法院。

   Article 2   If, before the ruling on the objection to jurisdiction is made, the plaintiff applies for the withdrawal of the charge and the people's court accepting the lawsuit rules that the charge may be withdrawn, the objection to jurisdiction will no longer be reviewed and the situation will be stated on the ruling.

     第二条 在管辖权异议裁定作出前,原告申请撤回起诉,受诉人民法院作出准予撤回起诉裁定的,对管辖权异议不再审查,并在裁定书中一并写明。

   Article 3   If, upon the expiry of the period for the submission of the statement of defence, the plaintiff increases the claim amount in the lawsuit and as a result of which the subject amount of the case exceeds the standard of hierarchy-based jurisdiction of the people's court accepting the lawsuit, and the defendant raises objection to the jurisdiction and requests to be submitted to the jurisdiction of a people's court at a higher level, the people's court shall conduct a review and make a ruling in accordance with Article 1 of these Provisions.    

     第三条 提交答辩状期间届满后,原告增加诉讼请求金额致使案件标的额超过受诉人民法院级别管辖标准,被告提出管辖权异议,请求由上级人民法院管辖的,人民法院应当按照本规定第一条审查并作出裁定。

   Article 4   A people's court at a higher level that transfers a civil case over which it has jurisdiction as court of first instance to a people's court at a lower level for trial in accordance with the provisions of paragraph 1 of Article 39 of the Civil Litigation Law shall make a ruling. If the party concerned is not satisfied with the ruling and lodges an appeal, the people's court of second instance shall conduct a trial and make a ruling in accordance with the law.

     第四条 上级人民法院根据民事诉讼法第三十九条第一款的规定,将其管辖的第一审民事案件交由下级人民法院审理的,应当作出裁定。当事人对裁定不服提起上诉的,第二审人民法院应当依法审理并作出裁定。

   Article 5   A people's court at a lower level may not request a people's court at a higher level to transfer to it civil cases over which the people court at the higher level has jurisdiction as court of first instance for trial.

     第五条 对于应由上级人民法院管辖的第一审民事案件,下级人民法院不得报请上级人民法院交其审理。

   Article 6   If a defendant raises an objection to the jurisdiction on the ground that the people's court accepting the lawsuit violates the provisions relating to hierarchy-based jurisdiction and geographical jurisdiction at the same time, the people's court accepting the lawsuit shall make rulings on both issues.

     第六条 被告以受诉人民法院同时违反级别管辖和地域管辖规定为由提出管辖权异议的,受诉人民法院应当一并作出裁定。

   Article 7   In the event that the party concerned does not raise objection to the jurisdiction, but the people's court accepting the lawsuit finds that it does not have hierarchy-based jurisdiction, it shall transfer the case to a people's court with jurisdiction for trial.

     第七条 当事人未依法提出管辖权异议,但受诉人民法院发现其没有级别管辖权的,应当将案件移送有管辖权的人民法院审理。

   Article 8   If the party concerned is not satisfied with the ruling of the people's court on the objection to hierarchy-based jurisdiction and lodges an appeal, the people's court of second instance shall conduct a trial and make a ruling in accordance with the law.

     第八条 对人民法院就级别管辖异议作出的裁定,当事人不服提起上诉的,第二审人民法院应当依法审理并作出裁定。

   Article 9   If the party concerned does not lodge an appeal against the ruling to place the case under the jurisdiction of a people's court at a higher level, but the people's court to which the case is transferred believes that it is wrong to do so, it may exercise its authority and rule that the above ruling is revoked.

     第九条 对于将案件移送上级人民法院管辖的裁定,当事人未提出上诉,但受移送的上级人民法院认为确有错误的,可以依职权裁定撤销。

   Article 10   The provisions governing the standard of hierarchy-based jurisdiction on civil cases tried by court of first instance as approved by the Supreme People's Court shall be the basis for trying cases on objection to hierarchy-based jurisdiction over civil actions.

     第十条 经最高人民法院批准的第一审民事案件级别管辖标准的规定,应当作为审理民事级别管辖异议案件的依据。

   Article 11   If the relevant judicial interpretations issued before the implementation of these Provisions are not consistent with these Provisions, these Provisions shall prevail.

     第十一条 本规定施行前颁布的有关司法解释与本规定不一致的，以本规定为准。
