To Sichuan High People's Court:

This is to acknowledge our receipt of your Instruction Request on Certain Issues Concerning the Application of Law during the Enforcement (Chuan Gao Fa [2007] No. 390). After discussion, we hereby reply as follows:

    四川省高级人民法院:

    你院《关于执行工作几个适用法律问题的请示》（川高法〔2007〕390号）收悉。经研究，批复如下:

1. When a people's court calculates "interest of debt for the period of delay of performance" pursuant to Article 229 of the Civil Procedure Law of the People's Republic of China, the benchmark loan interest rate specified by the Bank of China for that corresponding period shall apply.

     一、人民法院根据《中华人民共和国民事诉讼法》第二百二十九条计算“迟延履行期间的债务利息”时,应当按照中国人民银行规定的同期贷款基准利率计算。

2. Where the money subject to enforcement is not sufficient to repay all the debts, the debts (in monetary form) determined in the legal document and the interest on such debts for the period of delay of performance shall be repaid in a certain proportion, unless it is otherwise agreed upon by the parties concerned in the enforcement reconciliation regarding the order of repayment.

     二、执行款不足以偿付全部债务的，应当根据并还原则按比例清偿法律文书确定的金钱债务与迟延履行期间的债务利息，但当事人在执行和解中对清偿顺序另有约定的除外。

Annex:

Specific Calculation Method

(1) Money subject to enforcement= debts (in monetary form) determined in the legal document + interest of the debts for the period of delay of performance

(2) Interest of the debts for the period of delay of performance to be repaid = debts determined in the legal document to be repaid * benchmark loan interest rate of the corresponding period * 2 * period of delay of performance

具体计算方法

    （1）执行款=清偿的法律文书确定的金钱债务+清偿的迟延履行期间的债务利息。

    （2）清偿的迟延履行期间的债务利息=清偿的法律文书确定的金钱债务×同期贷款基准利率×2×迟延履行期间。
