All ministries, commissions and institutions directly under the State Council, departments (bureaus) of finance, development and reform commissions, price bureaus, departments (bureaus or commissions) of transport, departments (bureaus or commissions) of supervision and departments (bureaus) of audit of all provinces, autonomous regions and municipalities directly under the Central Government and the cities specifically designated in the State plan, Shanghai Urban and Rural Construction and Transport Committee, Tianjin Municipal Highway Administration, the Bureau of Finance, Price Bureau, Bureau of Transport, Bureau of Supervision and Bureau of Audit of the Xinjiang Production and Construction Corps: 

In accordance with the Circular of the State Council on Implementing Product Oil Price and Tax Reform (Guo Fa [2008] No. 37), relevant issues concerning the cancellation of transport-and-vehicle-related charges such as the road maintenance fee are notified as follows:

    国务院各部委、各直属机构,各省、自治区、直辖市、计划单列市财政厅(局)、发展改革委、物价局、交通厅(局、委)、监察厅(局、委)、审计厅(局),上海市城乡建设与交通委员会,天津市市政公路管理局,新疆生产建设兵团财务局、发展改革委、物价局、交通局、监察局、审计局:

    根据《国务院关于实施成品油价格和税费改革的通知》(国发[2008]37号)规定,现将取消公路养路费等涉及交通和车辆收费项目有关事项通知如下:

1. With effect from January 1, 2009, road maintenance fee, water conservation fee, road transport administration fee, road passenger and freight surcharge, waterway transport administration fee and waterway passenger and freight surcharge shall be cancelled nationwide. 

Bunker surcharge collected by Hainan Province shall be converted into surcharge for high-grade road vehicles; the specific collection measures will be formulated by Hainan Province and reported to the Ministry of Finance, the National Development and Reform Commission and the Ministry of Transport for record.

       一、自2009年1月1日起,在全国范围内统一取消公路养路费、航道养护费、公路运输管理费、公路客货运附加费、水路运输管理费、水运客货运附加费。

    海南省征收的燃油附加费改为高等级公路车辆通行附加费,具体征收办法由海南省制定,并报财政部、国家发展改革委、交通运输部备案。

2. The abovementioned charges relating to transport and vehicles that have been collected in advance for 2009 by transportation fee collection agencies or need to be refunded as required by applicable government policies shall be refunded in full amount, among which, charges falling under the Central revenue shall be refunded by the collection agency under the Ministry of Transport; charges falling under local revenue shall be refunded in accordance with the specific measures formulated by provinces, autonomous regions and municipalities directly under the Central Government.

       二、交通规费征稽机构已预征的2009年度或因政策等原因需要退还的上述交通和车辆收费,要予以全额清退。其中,属于中央收入的收费,由交通运输部所属征稽机构负责清退;属于地方收入的收费,具体清退办法按照各省、自治区、直辖市规定执行。

3. Where the contract fees ("share money") or management fees collected by taxi companies from taxi drivers include the above transport and vehicle-related charges, such charges shall be deducted accordingly.

       三、出租汽车企业向出租汽车司机收取的承包费(“份钱”)或管理费中包含上述交通和车辆收费的,要相应核减。

4. Transportation fee collection agencies shall, in accordance with current policies, carry out the collection of transport and vehicle-related charges for December 2008 and the clearance of those charges the payments of which are in default or have been evaded. Revenue from the collection and clearance shall be fully transferred to the State treasury or special financial account through the channel stipulated by competent finance authorities. Transportation fee collection agencies may continue using relevant financial invoices of 2008 when collecting transport and vehicle-related charges and clearing those charges the payments of which are in default or have been evaded in and after 2009.

       四、交通规费征稽机构要按照现行政策规定,继续做好2008年12月份交通和车辆收费征收以及欠缴、漏缴交通和车辆收费的清理工作,确保应征不漏。有关征收和清缴收入要按照财政部门规定渠道全额上缴国库或财政专户。交通规费征稽机构在2009年及以后年度清理欠缴、漏缴交通和车辆收费时,可继续使用2008年度有关财政票据。

5. Upon completion of clearance and refund, transportation fee collection agencies shall go through the formalities for cancelling the Fee Charging Permit with the original price authority that issued the permit and the formalities for cancelling invoices with the original finance authority that issued such invoices.

       五、清缴和清退收费工作结束后,交通规费征稽机构应按规定到原核发《收费许可证》的价格主管部门办理《收费许可证》注销手续,并到原核发财政票据的财政部门办理票据缴销手续。

6. All regions of the country shall gradually and in an orderly manner, cancel tolls for secondary roads, including bridges and tunnels, constructed with loans repaid by the government. The specific locations and names of the toll stations for such roads that are to be cancelled shall be publicly announced in a timely manner and under social supervision.

       六、各地要逐步有序取消政府还贷二级公路(含二级公路上的桥梁、隧道,下同)车辆通行费。对确定取消的政府还贷二级公路车辆通行费收费站点,要及时向社会公布具体位置和名称,接受社会监督。

7. Unless provided for in State laws and administrative regulations or by the State Council, no regions, departments or entities may propose to implement new administrative charges and government funds related to the construction and maintainence of roads, waterways, urban roads and the administration of motor vehicles and vessels. Any administrative charges and government funds related to the construction and maintainence of highways, waterways, urban roads and the administraton of motor vehicles and vessels implemented by any regions or departments in violation of the provisions on examination and approval of administrative charges and government funds shall be cancelled.

       七、今后除国家法律、行政法规和国务院规定外,任何地方、部门和单位均不得设立新的与公路、水路、城市道路维护建设以及机动车辆、船舶管理有关的行政事业性收费和政府性基金项目。各地区、各有关部门违反国家行政事业性收费、政府性基金审批管理规定,越权出台与公路、水路、城市道路维护建设以及机动车辆、船舶管理有关的收费基金项目均一律取消。

8. All regions, departments or entities shall strictly implement the provisions of this Notice, cancel the transport and vehicle-related charges announced herein, and shall not, directly or indirectly, delay or reject the implementation thereof on any ground. Where any region, department or entity fails to enforce the cancellation as required or continues to illegally implement new charges on items, all illegal income derived therefrom shall be confisticated and transferred to the Central State Treasury, and the liabilities of the relevant persons shall be investigated and prosecuted.

       八、各地区、各有关部门和单位要严格执行本通知规定，认真落实公布取消的交通和车辆收费项目，不得以任何理由直接或变相拖延甚至拒绝执行。对不按规定取消或继续非法设立收费项目的，一律将其非法所得没收上缴中央国库，并追究有关人员的责任。
