To the people's government of each province, autonomous region, municipality directly under the Central Government, and the municipality separately listed in the State plan:

In order to alleviate the burden of the sole proprietor businesses and privately-owned enterprises, to promote the sustainable and wholesome development of non-State owned economy such as sole proprietor businesses and privately-owned businesses, and to strengthen and improve the administration of industry and commerce, upon the approval of the State Council, the relevant issues are hereby notified as follows:

    各省、自治区、直辖市、计划单列市人民政府:

    为减轻个体工商户和私营企业负担,促进个体、私营等非公有制经济持续健康发展,加强和改进工商行政管理,经国务院批准,现将有关问题通知如下:

1. Sole proprietor business management fees and terminal market management fees shall cease to be collected nation-wide from September 1, 2008.

       一、自2008年9月1日起在全国统一停止征收个体工商户管理费和集贸市场管理费。

2. The revenue loss resulting from the discontinuance of collecting sole proprietor business management fees and terminal market management fees shall be resolved by the people's government of each province, autonomous region, municipality directly under the Central Government, and municipality separately listed in the State plan through overall planning, and the central government finance shall offer appropriate financial transfer payment subsidy. The detailed measures for the subsidy shall be formulated separately by the Ministry of Finance.

       二、停止征收个体工商户管理费和集贸市场管理费所造成的减收,由各省、自治区、直辖市、计划单列市人民政府统筹解决,中央财政给予适当的财力性转移支付补助,具体补助办法由财政部另行制定。

3. The people's government of each province, autonomous region, municipality directly under the Central Government, and the municipality separately listed in the State plan shall, in compliance with the provisions of the Notice of the State Council on Further Improving the Work of Funding Assurance for Administrative Departments for Industry and Commerce and for Quality and Technical Supervision Departments (Document No.: Guo Ban Fa [2002] No. 55), make appropriate budget arrangement for the administrative department for industry and commerce and provide financial support to the administrative department for industry and commerce to enable them to exercise their functions of market supervision and administration. The level of assurance of funding for the administrative department for industry and commerce shall not be affected by the discontinuance of collecting sole proprietor business management fees and terminal market management fees.

       三、各省、自治区、直辖市、计划单列市人民政府要按照《国务院办公厅关于进一步做好工商行政管理和质量技术监督部门经费保障工作的通知》(国办发[2002]55号)的规定,妥善安排工商行政管理部门预算,为工商行政管理部门正常履行市场监管职能提供财力保障,不能因停止征收个体工商户管理费和集贸市场管理费而影响工商行政管理部门经费保障水平。

4. The departments of finance, the departments in-charge of price, and the administrative departments for industry and commerce at all levels shall, in a conscientious manner, implement the provisions of this Notice thoroughly keeping in mind their respective duties; strengthen supervision and inspection as to the implementation of the discontinuance of collecting sole proprietor business management fees and terminal market management fees. Where the collection of sole proprietor business management fees and terminal market management fees continues in violation of the provisions or in disguised forms, punishment shall be imposed in accordance with the provisions, and the person responsible and the person of the relevant department bearing direct liability shall be subject to administrative liability.

       四、各级财政部门、价格主管部门和工商行政管理部门要按照各自职责，认真贯彻落实本通知的各项规定，加强对停止征收个体工商户管理费和集贸市场管理费执行情况的监督检查，对不按规定停止征收个体工商户管理费和集贸市场管理费或变相继续收费的，要按规定给予处罚，并追究有关单位负责人和直接责任人的行政责任。
