Notice of the Ministry of Finance and the National Development and Reform Commission on Exempting Safe Construction Projects of Primary and Secondary School Buildings Nationwide from Certain Fees

Finance departments (bureaus), development and reform commissions, and price bureaus of all provinces, autonomous regions, and municipalities directly under the Central Government,   

With a view to implementing relevant provisions of the Notice of the General Office of the State Council on Printing and Distributing the Implementation Plan of Safe Construction Projects of Primary and Secondary School Buildings Nationwide (Guo Ban Fa [2009] No. 34), and ensuring the smooth implementation of the safe construction projects of primary and secondary school buildings nationwide (hereinafter referred to as the Safe School Buildings Project), relevant issues are hereby notified as follows concerning the exemption of the Safe School Buildings Project from relevant fees during construction:

    各省、自治区、直辖市财政厅(局)、发展改革委、物价局:

    为落实《国务院办公厅关于印发全国中小学校舍安全工程实施方案的通知》(国办发[2009]34号)有关规定,保证全国中小学校舍安全工程(以下简称“校舍安全工程”)顺利实施,现就免收“校舍安全工程”建设过程中的有关收费问题通知如下:

1. All administrative and institutional fees involved in the construction of the Safe School Buildings Project for all primary and secondary schools shall be fully exempted, including the administrative and institutional fees at the national level or of Central departments and entities as instituted upon approval of the State Council and the Ministry of Finance (MOF) and/or the National Development and Reform Commission (NDRC), as well as the administrative and institutional fees instituted upon approval by people's governments at the provincial level and the finance departments and/or competent price departments thereof. Specifically, the exempted administrative and institutional fees at the national level or of Central departments and entities shall include: land reclamation fee, arable land reclamation fee, land registration fee, (expropriated) land management fee, housing ownership registration fee, urban housing safety assessment fee, fee for use of urban drainage facilities, termite prevention and control fee, fee for constructing air defence basements in other places, greenery fee, pollution discharge fee, environment monitoring service fee, water resource fee, special equipment inspection and testing fee, etc.

       一、所有中小学校“校舍安全工程”建设所涉及的行政事业性收费,包括经国务院和财政部、国家发展改革委批准设立的全国性及中央部门和单位行政事业性收费,以及经省级人民政府及其财政、价格主管部门批准设立的行政事业性收费,一律予以全额免收。免收的全国性及中央部门和单位行政事业性收费具体包括:土地复垦费、耕地开垦费、土地登记费、征(土)地管理费、房屋所有权登记费、城市房屋安全鉴定费、城市排水设施有偿使用费、白蚁防治费、防空地下室易地建设费、绿化费、排污收费、环境监测服务费、水资源费、特种设备检验检测收费等。

2. Relevant entities shall be encouraged to appropriately reduce or waive the commercial and service fees involved in the construction of the Safe School Buildings Project of all primary and secondary schools from the perspective of supporting educational development, subject to mutual consultation by the parties to the services.

       二、中小学“校舍安全工程”建设所涉及的经营服务性收费,在服务双方协商的基础上,提倡有关单位从支持教育事业发展的角度适当予以减收或免收。

3. Finance departments and competent price departments of all provinces, autonomous regions and municipalities directly under the Central Government shall, in strict accordance with the provisions of this Notice, earnestly implement the policies of exempting the Safe School Buildings Project from relevant fees, announce to the public the list of specific chargeable items exempted prior to August 31, 2010, and report the same to the MOF and the NDRC for record-filing. 

       三、各省、自治区、直辖市财政、价格主管部门要严格按照本通知规定,认真落实免收“校舍安全工程”建设相关收费政策,并于2010年8月31日前向社会公布免收的具体收费项目目录,同时报财政部、国家发展改革委备案。

4. All finance departments and competent price departments at all levels shall strengthen the supervision and inspection of the implementation of relevant fee-charging policies on the Safe School Buildings Project of primary and secondary schools. Failure to implement the policies on fee reduction or exemption in accordance herewith shall be dealt with in accordance with relevant provisions.

       四、各级财政、价格主管部门要加强对涉及中小学“校舍安全工程”建设有关收费政策落实情况的监督检查，对不按照本通知落实减免政策的，要按照有关规定进行处理。
