To the Ministry of Housing and Urban-Rural Development:

Your Letter of Application for the Approval on Charging Fees on Property Manager License Examination and Registration (Jian Zong Han No. 160 [2007]) has been received. Upon research and discussion, matters concerning charging fees on property manager license examination and registration are hereby notified:

    你部《关于申请批准物业管理师资格考试与注册收费的函》(建综函[2007]160号)收悉。经研究,现将物业管理师资格考试收费等问题通知如下:

1. We approve your application for the collection of processing fee while holding the property manager license examination. The processing fee shall be collected by the Practice Qualification Registration Center of the Ministry of Housing and Urban-Rural Development from the department in charge of construction of each province, autonomous region, and municipality directly under the Central Government. The processing fee shall be used to cover the expenses on composing examination questions, printing and delivering examination papers, grading examination papers, and other expenses. The department in charge of construction of each province, autonomous region, and municipality directly under the Central Government shall collect property manager license examination fee from candidates or examinees. The said examination fee shall be used to cover the expenses on handling registration for taking the examination, renting the place of examination, employing invigilators, the processing fee handed over to the Practice Qualification Registration Center, and other expenses.

       一、同意你部在组织物业管理师资格考试时,由你部所属执业资格注册中心向各省、自治区、直辖市建设主管部门收取考务费,用于命题、试卷印制和运送、评卷等支出;由各省、自治区、直辖市建设主管部门向考生收取物业管理师资格考试费,用于组织报名、租用考场、聘请监考人员以及上缴执业资格注册中心的考务费等支出。

2. The charging standards for the above-said examination fee and processing fee shall be formulated by the National Development and Reform Commission and the Ministry of Finance separately.

       二、上述考试、考务费的收费标准由国家发展改革委、财政部另行制定。

3. Considering that the examination and approval of the registration of property manager license conducted by the Ministry of Housing and Urban-Rural Development falls within the scope of administrative licensing items, there is no law or administrative regulation as the legal basis for collecting registration fee from applicants. Therefore, the collection of property manager license registration fee is inappropriate.

       三、你部对物业管理师资格进行注册审批,属于行政许可事项,向申请注册的人员收取注册费缺乏法律、行政法规依据,因此,不宜收取物业管理师资格注册费。

4. Fee-collecting agencies shall obtain the fee collection permit from the designated price administration departments and shall separately use instruments uniformly printed and produced by the Ministry of Finance or relevant provincial finance departments according to their financial and administrative subordination relationships.

       四、收费单位应到指定的价格主管部门办理收费许可证,并按财务隶属关系分别使用财政部和省级财政部门统一印制的票据。

5. The full amount of the processing fee collected by the Practice Qualification Registration Center of the Ministry of Housing and Urban-Rural Development shall be handed over to the State treasury to be listed under the Central Government's fiscal budget management. Specific measures for handing over the said processing fee to the State treasury shall be implemented pursuant to relevant provisions of the Notice of the Ministry of Finance on Confirming Relevant Matters Concerning Pilot Reform of Administration System of Turning Over Revenues of the Ministry of Construction (Cai Ku No. 50 [2002]) and the Notice of the Ministry of Finance on Confirming Relevant Matters Concerning Including the Registered Soil and Rock Engineer License Examination Fee, the Real Estate Broker License Examination Fee, and Other Newly-Added Income Items into the Scope of Pilot Reform of Turning Over Revenues of the Ministry of Construction (Cai Ku No. 14 [2003]). The full amount of the property manager license examination fee collected by the departments in charge of construction of all provinces, autonomous regions, and municipalities directly under the Central Government shall be handed over to Treasuries at the provincial level and shall be under relevant provincial fiscal budget management. The specific measures for handing over the collected fees to relevant Treasuries shall be implemented according provisions set forth by relevant finance departments at province level. The above-said processing fee and examination fee shall be listed under the Subcategory 10 "Examination and Processing Fees" of Category 33 "Revenue of Administrative Fees charged on Construction" under Paragraph 04 "Revenue of Administrative Fees" of Item Entry 103 "Non-tax Revenue" in the Classification of Government Revenue and Expenditures. Relevant expenditures shall be verified and determined by the relevant finance departments according to the requirements for the performance of relevant responsibilities and functions.

       五、你部执业资格注册中心收取的考务费,应全额上缴中央国库,纳入中央财政预算管理。具体缴库办法按照《财政部关于确认建设部收入收缴管理制度改革试点有关事宜的通知》(财库[2002]50号)和《财政部关于确认建设部注册土木工程师(岩土)和房地产经纪人执业资格考试费等新增收入项目纳入收入收缴改革试点范围有关事宜的通知》(财库[2003]14号)有关规定执行。各省、自治区、直辖市建设主管部门收取的物业管理师资格考试费,应全额上缴省级国库,纳入省级财政预算管理,具体缴库办法按照省级财政部门的规定执行。上述考务、考试费收入在“政府收支分类科目”列第103类“非税收入”04款“行政事业性收费收入”33项“建设行政事业性收费收入”10目“考试考务费”。支出由同级财政部门按照其履行职能的需要核定。

6. Fee-charging agencies shall collect fees strictly pursuant to approved charging items and standards and shall not add new charging items and increase charging standards at their own discretion. Fee-charging agencies shall conscientiously accept the supervision and inspection of relevant departments including finance, price administration, and audit.

       六、收费单位应严格按照批准的收费项目和标准执行，不得自行增设收费项目和提高收费标准，并自觉接受财政、价格、审计部门的监督检查。
