All ministries (commissions) of, and departments directly the State Council, finance departments (bureaus), development and reform commissions and price bureaus of all provinces, autonomous regions and municipalities directly under the Central Government, and the Bureau of Finance of the Xinjiang Production and Construction Corps,

In accordance with the Regulations of the People's Republic of China on the Disclosure of Government Information (Order No. 492 of the State Council), issues concerning the fee-charging by administrative organs for providing public government information are hereby notified as follows with a view to promoting lawful administration and improving the transparency of governmental affairs:

   国务院各部（委）、各直属机构，各省、自治区、直辖市财政厅（局）、发展改革委、物价局，新疆生产建设兵团财务局： 

为促进依法行政，提高政府工作透明度，根据《中华人民共和国政府信息公开条例》（国务院令第492号）的有关规定，现将行政机关提供政府公开信息时收取费用等有关事项通知如下：

1. In the disclosure of government information, an administrative organ may charge the following fees when providing public government information outside the scope of information voluntarily disclosed by the organ upon a written application by a citizen, a legal person or any other organization:

(1) Information retrieval fee 

Information retrieval fee may be charged for searching, inquiring about, editing and storing public government information in a public information reference room, a data acquisition venue or other places set up by the administrative organ.

(2) Duplication fee

Duplicate fee may be charged where the administrative organ provides public government information via such media as hardcopy, disc or compact disc upon application by citizens, legal persons or any other organizations.

(3) Postage. 

The administrative organ may charge postage for transmitting public government information by mail upon application by citizens, legal persons or any other organizations.

The administrative organ shall not charge any fees when it voluntarily provides public government information by government gazette, on government websites, via press conference, or in the form of newspapers, periodicals, radio or TV broadcasting.

      一、行政机关政府信息公开工作中，依公民、法人或者其他组织的书面申请，向其提供本机关主动公开信息范围以外的政府公开信息时，可以收取下列费用：

   （一）检索费。在本行政机关设置的公共查阅室、资料索取点等场所搜索、查询、编辑、存储政府公开信息，可以收取检索费。

   （二）复制费。本行政机关根据公民、法人和其他组织申请并通过纸张、磁盘、光盘等介质提供政府公开信息的，可以收取复制费。

   （三）邮寄费。本行政机关根据公民、法人和其他组织申请，采取邮政手段传递政府公开信息的，可以收取邮寄费。

   行政机关通过政府公报、政府网站、新闻发布会以及报刊、广播、电视等形式主动提供政府公开信息，一律不得收取任何费用。

2. Rural residents under the five-guarantees system (under which, disadvantaged rural residents are provided with food, clothing, medical care, housing and burial expenses), urban and rural residents under the minimum living guarantee, and recipients of State pension and subsidies may be exempted from relevant fees by submitting an application together with valid certificates issued by the people's governments of their respective townships or sub-district offices and after review and verification by government information disclosure departments under administrative organs.

      二、农村五保供养对象、城乡居民最低生活保障对象，以及领取国家抚恤补助的优抚对象，凭所在地乡镇人民政府或街道办事处出具的有效证明，经本人申请、行政机关政府信息公开工作机构审核，可以免收相关费用。

3. The charging standards for information retrieval fee, duplication fee and postage shall be separately formulated by the National Development and Reform Commission and the Ministry of Finance (MOF).

      三、检索费、复制费、邮寄费收费标准由国家发展改革委、财政部另行制定。

4. Administrative organs charging information retrieval fee, duplication fee and postage shall obtain the fee-charging permit from designated competent price departments, and shall use fiscal bills uniformly printed by the MOF and finance departments of provinces, autonomous regions, and municipalities directly under the Central Government, respectively, according to the financial affiliation.

      四、收取检索费、复制费、邮寄费的行政机关应到指定的价格主管部门办理收费许可证，并按财务隶属关系分别使用财政部和省、自治区、直辖市财政部门统一印制的财政票据。

5. In accordance with the Notice of the General Office of the State Council on the Opinions on Deepening the Reform in the Separation of Income and Expenditure and Further Strengthening Fiscal Administration (Guo Ban Fa [2001] No. 93), information retrieval fee, duplication fee and postage shall be included in the fiscal budget at the same level as the administrative organ that collects the fees and postage, and be administered according to the principle of "separation of income and expenditure". Administrative organs at all levels (excluding Central budgetary departments in Beijing) shall, within three (3) days after collecting the information retrieval fee, duplication fee and postage, pay the proceeds in full to respective local State Treasury at the corresponding level. The aforesaid fees and postage collected by Central budgetary departments in Beijing shall be paid into the Central Treasury in full. When handing in the fees and postage to the treasury, an administrative organ shall use the general payment form, state the budgetary level, and fill out the subject of "other administrative and institutional fees to be submitted to the State Treasury" under Clause 50 of various items of revenues from administrative and institutional fees under Paragraph 04 "revenues from administrative and institutional fees" of Section 103 "non-tax revenues" of the Government Revenue and Expenditure Items. Where institutional reform of administration over non-tax revenue payment is implemented, relevant provisions thereunder shall apply. Expenditure shall be arranged via budget by finance departments at the corresponding level, and fund appropriation shall be subject to relevant provisions of fiscal treasury administration systems.

      五、按照《国务院办公厅关于深化收支两条线改革进一步加强财政管理意见的通知》（国办发[2001]93号）的有关规定，检索费、复制费、邮寄费应当纳入同级财政预算，实行“收支两条线”管理。各级行政机关（除在京中央预算部门外）应于收取检索费、复制费、邮寄费的3日内，将收入就地全额缴入同级国库，在京中央预算部门收取的上述三项费用金额缴入中央总金库。缴库时使用一般缴款书，注明预算级次，并相应填列《政府收支分类科目》103类“非税收入”04款“行政事业性收费收入”下各项行政事业性收费收入的50目“其他缴入国库的行政事业性收费”科目。实施非税收入收缴管理制度改革的，按改革的有关规定执行。支出由同级财政部门通过部门预算予以安排，资金支付按财政国库管理制度有关规定执行。

6. Administrative organs at all levels, in particular people's governments of townships, counties and cities and the departments (systems) thereof that directly serve the public, shall make full use of the existing administrative service halls and administrative service centers, or set up special reception counters or venues to facilitate fee payment by the public and ensure applications for disclosure of government information are handled in a timely manner.

      六、各级行政机关，特别是直接面向基层群众的市、县、乡级人民政府及其部门（系统），要充分利用现有行政服务大厅、行政服务中心等场所，或设立专门的接待窗口和场所方便群众缴费，确保政府信息公开申请得到及时处理。

7. Administrative organs at all levels shall collect fees in strict accordance with the aforesaid provisions, and shall not add chargeable items, expand charging scope or raise charging rate without authorization, or provide government information on a payable basis through other organizations or individuals. In addition, they shall conscientiously subject themselves to the supervision and inspection by finance departments, price departments and audit offices.

      七、各级行政机关应当严格按照上述规定收费，不得擅自增加收费项目、扩大收费范围或提高收费标准，更不得通过其他组织、个人以有偿服务等方式提供政府信息，并自觉接受财政、价格、审计部门的监督检查。

8. Administration over fee-charging by organizations with the function of public affairs administration as authorized by laws and regulations for disclosure of government information shall be carried out with reference to this Notice.

      八、法律、法规授权的具有管理公共事务职能的组织公开政府信息活动的收费管理，参照本通知的规定执行。

9. The foregoing provisions shall come into effect on the date of printing and distribution.

      九、上述规定自印发之日起执行。
