Measures for Affirming the Eligibility of Beijing-based Venture Capital Institutions for Support by the Special Fiscal Fund

北京市风险投资机构享受财政专项资金支持确认办法

With a view to implementing the Several Provisions of Beijing Municipality on Further Promoting the Development of the High-tech Industries, these Measures are formulated upon approval by the Beijing Municipal People’s Government.

    为贯彻落实《北京市关于进一步促进高新技术产业发展的若干规定》,经市政府同意,制定本实施办法。

  Article 1    These Measures shall apply to venture capital institutions that invest in the projects of Beijing Municipality for commercialization of high-tech achievements.

       第一条  本办法适用于为本市高新技术成果转化项目投资的风险投资机构。

  Article 2    A venture capital institution shall satisfy the following conditions before it may enjoy the support by the special fiscal fund:

1. It is registered in Beijing Municipality and is qualified as an independent legal person; and

2. Its investment in the projects for commercialization of high-tech achievements accredited by Beijing Municipality exceeds 70% of its total investment in the current year.

       第二条  风险投资机构享受财政专项资金支持,应具备以下条件:

    1.在本市注册、具有独立法人资格;

    2.对本市认定的高新技术成果转化项目投资超过当年投资总额的70%.

  Article 3    With respect to a venture capital institution that meets the requirements of Article 2, 50% of the local fiscal revenue from its income tax paid in the current year shall be subsidized by the special fund allocated by the public finance.

       第三条  对符合第二条规定的风险投资机构当年缴纳所得税地方收入部分的50%,由财政安排专项资金支持。

  Article 4    A venture capital institution shall file an application for support by the special fiscal fund with the Beijing Hi-tech Transfer Service Center (hereinafter referred to as the “Service Center”) by the end of May each year.

The venture capital institution applying for support by the special fiscal fund shall submit the following materials:

(1) A confirmation application form;

(2) Its annual financial statement;

(3) Information on the calculation and payment of last year’s enterprise income tax;

(4) Accreditation certificate for projects for commercialization of high-tech achievements;

(5) Relevant documents issued by its board of directors on investment in the accredited projects and capital contribution certificates; and

(6) Photocopy of its business license or legal person certificate.

       第四条  风险投资机构应于每年5月底以前向北京市高新技术成果转化服务中心(以下简称服务中心)提出享受财政专项资金支持的申请。

    申请享受财政专项资金支持的风险投资机构应当提交以下材料:

    1.确认申请表;

    2.机构年度财务报表;

    3.上年度企业所得税汇算清缴结果;

    4.高新技术成果转化项目认定证书;

    5.向认定项目投资的有关董事会文件和出资证明;

    6.营业执照或法人证书复印件。

  Article 5    The Service Center shall be responsible for the examination and confirmation of application materials, and shall submit the consolidated calculation results to the Beijing Municipal Bureau of Finance by the end of July each year. The Beijing Municipal Bureau of Finance shall arrange funds and allocate them to the Service Center according to the tax amounts confirmed by the Service Center and the latter shall transfer the funds to the venture capital institutions within ten working days.

       第五条  服务中心负责对申请材料进行核准、确认,于每年7月底前将汇总清算结果报市财政局。市财政局按照北京市高新技术成果转化服务中心确认的税款数额安排资金并拨付到服务中心。服务中心在10个工作日内将资金转拨到风险投资机构。

  Article 6    Venture capital institutions that enjoy the support by the special fiscal fund shall be confirmed once a year.

       第六条  享受财政专项资金支持的风险投资机构每年确认一次。

  Article 7    Venture capital institutions that enjoy the support by the special fiscal fund shall be subject to inspection at random. Those that practice fraud shall be disqualified from enjoying the preferential policies, and shall be ordered to return the grants already received.

       第七条  对享受财政专项资金支持的风险投资机构实行不定期抽查,如发现有弄虚作假者,撤销其享受优惠政策的资格,并责令其退回所得支持资金。

  Article 8    These Measures shall be interpreted by the Beijing Municipal Bureau of Finance.

       第八条  本办法由市财政局负责解释。
