To the finance departments (bureaus) of all provinces, autonomous regions, municipalities directly under the Central Government, cities specifically designated in the State plan, the Financial Bureau of the Xinjiang Production and Construction Corps, relevant banks, procurement companies, enterprise groups in cities specially designated in the State plan, as well as enterprises under the management of the Central Government,

After consultation with the Japan International Cooperation Agency (JICA), relevant issues concerning the procurement and payment of Yen loan projects are hereby notified as follows:

    各省、自治区、直辖市、计划单列市财政厅(局),新疆生产建设兵团财务局,有关银行、采购公司、计划单列企业集团、中央管理企业:

    经与日本国际协力机构(JICA)协商,现将日元贷款项目采购和支付有关问题通知如下:

1. Add the provision that the bidders shall provide a declaration of corruption conducts

(1) In accordance with the anti-corruption consensus reached by both the Chinese and the Japanese side as well as relevant terms and conditions of the loan agreement, during the loan procurement process, add the requirement that the bidders shall provide declaration documents of corruption conducts (see Appendix 1 for format).

(2) The declaration shall be an integral part of the tender documents and contracts. Bidding documents shall, in the Instruction to Bidders or Instruction to Consultant, specify that the tender documents shall be accompanied with this declaration as a term of abandonment of tender. At the same time, this declaration format shall be added in the sample contract. This declaration shall be attached when providing the evaluation report to the Japanese side.   

(3) This provision shall come into effect as of January 1, 2010 and shall be applicable for all the loan procurement whose contracts are subject to the examination and approval of the Japanese side. As for loan procurement whose invitation of tenders has already been completed prior to January 1, 2010 but whose contracts have not been submitted to the Japanese side, the bidders or the successful bidders shall supplement the declaration document and revise the contracts.

       一、增加投标人提供腐败行为声明的规定

    (一)根据中日双方就反腐败工作达成的共识和贷款协议有关规定,在贷款采购过程中,增加有关投标人提供腐败行为声明文件的要求(格式见附件1)。

    (二)该声明应当作为投标文件以及合同的组成部分。招标文件应在投标人须知(Instruction to Bidders或Instruction to Consultant)中规定投标文件需附带此声明并将其作为废标条款,同时在合同样本中添加此声明格式。在向日方提供评标报告时,需将该声明作为附件。

    (三)此规定自2010年1月1日起实施,适用于所有需要日方审批合同的贷款采购。对于2010年1月1日前已完成招标工作,但未向日方报送合同的贷款采购,投标人或中标人应补充提供声明文件并修改合同内容。

2. Revise the format of the Application for Payment of loans  

(1) In order to facilitate the mastery of information on loan payment, the Claims for Payment in the 2007 loan agreement on the transfer of payment of has been revised. (see Appendix 2 for format).

(2) The revision shall apply to the loan agreements of the following six (6) projects: Lanzhou Atmospheric Environmental Protection (C07-P226), Comprehensive Ecological Management of Qinghai Province (C07-P227), Comprehensive Management of Urban Environment of Xinjiang (Phase 2) (C07-P228), Comprehensive Management of Urban Environment of Nanyang of Henan Province (C07-P229), Urban Garbage Disposal of Hunan Province (C07-P230) and Urban Garbage Disposal of Anhui Province (C07-P231).

(3) This format shall come into effect as of January 1, 2010.

       二、修改贷款“支付申请”格式

    （一）为便于掌握贷款支付有关信息，对2007年度贷款协议中转移支付方式的“支付申请”（Claims for Payment）进行修改（格式见附件2）。

    （二）该修改适用于兰州市大气环境保护（C07-P226）、青海省生态综合治理（C07-P227）、新疆城市环境综合治理（二期）（C07-P228）、河南南阳市城市环境综合治理（C07-P229）、湖南省城市垃圾处理（C07-P230）和安徽省城市垃圾处理（C07-P231）6个项目的贷款协议。

    （三）此格式自2010年1月1日起实施。
