To the finance departments (bureaus), development and reform commissions, price bureaus, and energy bureaus of all provinces, autonomous regions, and municipalities directly under the Central Government,

In recent years, some provinces and cities have issued local policies for exploitation and utilization of hydroenergy (hydroelectricity) on compensation basis at their own discretion, and have been charging, in the name of compensated transfer of the right to exploit and use hydroenergy (hydroelectricity), transfer fees, compensation fees and other fees from hydroelectricity companies, which is not only in violation of the administrative provisions on administrative institutional fees and the examination and approval of government funds, but also increases the burden on hydroelectricity enterprises, affecting their normal production and operation activities. With a view to establishing a standardized system of compensated use of water resources, and promoting the sustainable and healthy development of the hydroelectricity industry, relevant issues are hereby notified as follows:

    各省、自治区、直辖市财政厅(局)、发展改革委、物价局、能源局:

    近几年,一些省市自行出台地方性水能(水电)资源有偿开发使用政策,以水能(水电)资源开发使用权有偿出让名义向水电企业收取出让金、补偿费等名目的费用,不仅违反了行政事业性收费和政府性基金审批管理规定,而且加重了水电企业负担,影响了水电企业正常的生产经营活动。为建立规范的水资源有偿使用制度,促进水电行业持续健康发展,现就有关问题通知如下:

1. All regions shall cease the implementation of the policies for exploitation and utilization of hydroenergy (hydroelectricity) on compensation basis introduced on their own. Pursuant to the Decision of the CPC Central Committee and the State Council on Rectifying Such Issues as Arbitrarily Charging Fees from, Imposing Fines on and Burdening Enterprises with Various Charges (Zhong Fa [1997] No. 14), the right to exploit hydroenergy (hydroelectricity) resources shall not be transferred, on compensation basis, to hydroelectricity projects already built, in progress or to be built. In addition, it is prohibited to charge transfer fee for the right to use hydroenergy resources, fee for compensated transfer of the right to exploit and utilize hydroenergy resources, compensation fees for exploitation of hydorenergy resources or other fees from hydroelectricity enterprises, project developers and individuals in the name of compensated exploitation and utilization of hydroenergy (hydroelectricity) resources.

      一、各地停止执行自行出台的水能(水电)资源有偿开发使用政策。根据《中共中央国务院关于治理向企业乱收费、乱罚款和各种摊派等问题的决定》(中发[1997]14号)的规定,各地不得对已建、在建和新建水电项目有偿出让水能(水电)资源开发权,不得以水能(水电)资源有偿开发使用名义向水电企业或项目开发单位和个人收取水能资源使用权出让金、水能资源开发利用权有偿出让金、水电资源开发补偿费等名目的费用。

2. To effectively strengthen administration over the collection and use of the water resources fee, and standardize the system of compensated use of water resources. Pursuant to the Regulations on the Administration of Water Abstraction Licensing and Collection of Water Resources Charges (Order No. 460 of the State Council), the Notice of the Ministry of Finance, the National Development and Reform Commission and the Ministry of Water Resources on Printing and Distributing the "Administrative Measures for the Collection and Use of the Water Resources Fee" (Cai Zong [2008] No. 79) and the Notice of the National Development and Reform Commission, the Ministry of Finance and the Ministry of Water Resources on the Charging Standards of the Water Resources Fee for Water Conservancy Projects Directly under the Central Government and Inter-provincial Water Conservancy Projects as well as Other Related Issues (Fa Gai Jia Ge [2009] No. 1779), all regions shall strengthen administration over the collection of the water resources fee to make sure that the same is collected in full and on time, and is earmarked for the conservation, protection and management of water resources, as well as the rational exploitation of water resources as required. No entity or individual may transfer gratis, withhold or divert the fee for any other purposes.

      二、切实加强水资源费征收使用管理,规范水资源有偿使用制度。按照《取水许可和水资源费征收管理条例》(国务院令第460号)、《财政部国家发展改革委水利部关于印发〈水资源费征收使用管理办法〉的通知》(财综[2008]79号)和《国家发展改革委财政部水利部关于中央直属和跨省水利工程水资源费征收标准及有关问题的通知》(发改价格[2009]1779号)的规定,各地应加强水资源费征收管理,确保水资源费及时足额征收,按规定专项用于水资源节约、保护和管理,并用于水资源的合理开发,任何单位和个人不得平调、截留或挪作他用。

3. Unless approved by the Ministry of Finance or the National Development and Reform Commission, no region may step beyond its authority to institute administrative institutional chargeable items relating to hydroelectricity enterprises; and unless approved by the State Council or the Ministry of Finance, no government fund projects relating to hydroelectricity enterprises may be set up. Those who are in violation of relevant provisions shall be severely investigated and punished.

      三、凡未经财政部、国家发展改革委同意，各地一律不得越权设立涉及水电企业的行政事业性收费项目;未经国务院或财政部批准，不得设立涉及水电企业的政府性基金项目。凡违反规定的，要予以严肃查处。
