Supplementary Notice of the Ministry of Finance on the Interim Measures for the Supervision and Assessment of Centralized Procurement Institutions under the Central Government

With a view to furthering the supervision and assessment of centralized procurement institutions under the Central Government, and promoting the scientific, standardized and high-efficiency operations of the centralized procurement of the Central Government, in accordance with the Government Procurement Law of the People’s Republic of China and the Interim Measures for the Supervision and Assessment of Centralized Procurement Institutions under the Central Government (hereinafter referred to as “the Interim Measures”), we hereby issue a notice as follows on relevant adjustments,

    为进一步做好中央集中采购机构的监督考核工作,促进中央集中采购工作科学、规范、高效运行,根据《中华人民共和国政府采购法》和《中央集中采购机构监督考核暂行办法》(以下简称《暂行办法》)的相关规定,现就有关调整内容补充通知如下:

1. The Ministry of Finance shall conduct a regular assessment on centralized procurement institutions under the Central Government every other year, and arrange in principle the assessment in the period from March 1 to late April in the year of assessment. If finding relevant persons including purchasers, staff of centralized procurement institutions, staff of suppliers and government procurement review experts involved in violations of laws and regulations, assessment groups may conduct an extended inspection and handle relevant violations in accordance with law.

       一、财政部对中央集中采购机构实行定期考核,隔年进行一次,原则上安排在考核当年的3月1日开始至4月底结束。在考核过程中,如发现采购人、集中采购机构、供应商和政府采购评审专家等相关人员存在违法违规的问题,考核小组可以进行延伸检查,并依法作出处理。

2. The assessment covers the content provided for in Article 66 of the Government Procurement Law of the People’s Republic of China and the Interim Measures, as well as content including the implementation of government procurement policies, replies to queries, the internal management and operating regulations of centralized procurement institutions.

       二、考核事项包括《中华人民共和国政府采购法》第66条和《暂行办法》规定的内容,同时政府采购政策的执行情况、质疑答复情况、集中采购机构内部管理和操作规程等内容也列为考核事项。

3. The Ministry of Finance shall, after the end of assessment, issue correction notices to centralized procurement institutions, and centralized procurement institutions shall duly make corrections. The Ministry shall organize reexamination from August 1 of the year of assessment and may, in accordance with law, punish the centralized procurement institutions that have failed to make corrections based on relevant requirements.

       三、财政部将在考核结束后,针对发现的问题向集中采购机构下发整改通知书,集中采购机构应当及时作出整改。财政部从考核当年的8月1日起组织复查,未按要求进行整改的,将依法进行处理。

4. The Ministry of Finance shall, after the end of assessment, disclose assessment results within the scope of central entities, and announce assessment scores and grades on its designated government procurement information media; where assessment results contain important information, the Ministry shall report such information to the State Council.

       四、考核结束以后,财政部将在中央单位范围内通报考核结果,并将考核得分和等次情况在财政部指定的政府采购信息媒体上公布,考核结果有重要情况的,财政部将向国务院报告。

5. This Notice shall come into effect from the date of promulgation.
