To the financial departments (bureaus) in all provinces, autonomous regions, municipalities directly under the Central Government and specially designated cities in the State plan,

In order to further regulate the administration of the subsidy for the environmental construction for foreign investment, decision is, after discussion, made by the Ministry to revise the scope of use of the funds. We hereby notify the relevant matters as follows:

    各省、自治区、直辖市、计划单列市财政厅(局):

    为进一步规范外商投资环境建设补助资金的管理,经研究,我部决定对资金的使用范围进行修订,现将有关事项通知如下:

1. Article 4 of the Administrative Measures on the Subsidy for the Environmental Construction for Foreign Investment (Cai Qi [2002] No. 174) is revised into: the subsidy shall be used specially for the compensation, resettlement, and removal and relocation, resulted from the use of land by foreign-invested enterprises, and for the construction of public facilities in connection with the improvement of foreign investment environment.

       一、《外商投资环境建设补助资金管理办法》(财企[2002]174号)第四条修订为:补助资金专项用于外商投资企业用地的补偿、安置、拆迁以及为改善外商投资环境相关的公共设施建设支出。

2. Each local financial department shall use the funds in strict accordance with the prescribed purposes, and no alteration or extension of the scope of the use of funds is allowed without authorization.

       二、请各地财政部门严格按规定用途安排使用,不得任意改变和扩大资金的使用范围。

3. The subsidy for the environmental construction for foreign investment comes from the income from the site use fees turned over to the central finances by the central-level foreign-invested enterprises in all provinces, autonomous regions, municipalities directly under the Central Government and specially designated cities in the State plan. Each local financial department shall strengthen the administration over the collection of the site use fees payable by foreign-invested enterprises, and ensure that the fiscal revenue goes to the State treasury in a timely manner and in full amount.

       三、外商投资环境建设补助资金的来源为各省、自治区、直辖市和计划单列市上缴中央财政的中央级外商投资企业场地使用费收入,各级财政部门应加强外商投资企业场地使用费征收管理,确保财政收入的及时、足额入库。

4. The site use fees turned over by each local foreign-invested enterprise to the central finances shall serve as the basis for the Ministry to assign the capital budget.

       四、各地上缴中央财政的外商投资企业场地使用费收入将作为我部下达资金预算的基本依据。

This Notice shall come into force on the date of promulgation, and Article 4 of the Administrative Measures of the Subsidy for the Environmental Construction for Foreign Investment (Cai Qi [2002] No. 174) shall be repealed simultaneously.

       五、本通知自发布之日起执行,《外商投资环境建设补助资金管理办法》(财企[2002]174号)第四条同时废止。
