To the relevant departments of the Central Committee of the Party, all ministries and commissions under and agencies directly subordinate to the State Council, the General Office of the Standing Committee of the National People's Congress, the General Office of the Chinese People's Political Consultative Conference, the Supreme People's Court, the Supreme People's Procuratorate, relevant private organizations, enterprises under the administration of the central government, and the Xinjiang Production and Construction Corps,

To support the building of the Zhongguancun National Independent Innovation Model Area, further drive the initiative and creativity of the central-government institutions and their research and development staff, the Ministry of Finance has decided to launch the pilot reform of scientific achievement disposal rights among the central-government institutions within the Zhongguancun National Independent Innovation Model Area. We hereby announce the relevant matters as follows:

    党中央有关部门,国务院各部委、各直属机构,全国人大常委会办公厅,全国政协办公厅,高法院,高检院,有关人民团体,有关中央管理企业,新疆生产建设兵团:

    为了积极支持中关村国家自主创新示范区建设,进一步激发区内中央级事业单位及其研发人员的积极性和创造性,财政部决定在中关村国家自主创新示范区进行中央级事业单位科技成果处置权改革试点,现将有关事项通知如下:

1. The disposal of scientific achievements of central-government institutions shall mean the transfer or cancellation of property rights in connection with the scientific achievements they own, including transfer free of charge, donation, sale, and transfer.

       一、中央级事业单位科技成果处置是指,中央级事业单位对其拥有的科技成果进行产权转让或注销产权的行为,包括无偿划转、对外捐赠、出售、转让等。

2. Power of central-government institutions in connection with the disposal of their scientific achievements: for achievements with base value or aggregate value below RMB8 million, the owner may dispose the same by itself and report the results to the Ministry of Finance within one month of the disposal for record-filing; for achievements with base value or aggregate value above RMB8 million (inclusive), the prevailing provisions shall apply, i.e., the owner shall apply with the Ministry of Finance for approval after the disposal is approved by the competent authority.

       二、中央级事业单位科技成果处置权限:一次性处置单位价值或批量价值在800万元以下的,由所在单位按照有关规定自主进行处置,并于一个月内将处置结果报财政部备案;一次性处置单位价值或批量价值在800万元以上(含)的,仍按现行规定执行,即由所在单位经主管部门审核同意后报财政部审批。

3. This Notice shall be implemented on trial basis by the central-government institutions within the Zhongguancun National Independent Innovation Model Area. Where there is conflict between relevant documents issued and this Notice, this Notice shall prevail. The pilot period is between the issuance date of this Notice and December 31, 2013.

       三、本通知在中关村国家自主创新示范区内中央级事业单位中试行。已经发布的相关文件与本通知不一致的，依照本通知执行。试行时间为本通知发布之日起至2013年12月31日。
