Chapter 1 General Provisions

    第一章  总则

  Article 1   According to the Decision of the State Council on Strengthening Energy-saving Work (Guo Fa [2006] No. 28) and the Notice of the State Council on Further Strengthening the Oil-saving and Electricity-saving Work (Guo Fa [2008] No.23), the Central Treasury has arranged for special funds to support the promotion of high-efficiency and energy-saving products, expand the market share of high-efficiency and energy-saving products and improve the energy efficiency of energy-consuming products. In order to strengthen the administration over financial subsidies for the promotion of high-efficiency and energy-saving products (hereinafter referred to as the Financial Subsidy) and improve capital efficiency, these Measures are hereby formulated.

       第一条  根据《国务院关于加强节能工作的决定》(国发[2006]28号)和《国务院关于进一步加强节油节电工作的通知》(国发[2008]23号),中央财政安排专项资金,支持高效节能产品的推广使用,扩大高效节能产品市场份额,提高用能产品的能源效率水平。为加强高效节能产品推广财政补助资金(以下简称“补助资金”)管理,提高资金使用效益,特制定本办法。

  Article 2   For the purpose of these Measures, high-efficiency and energy-saving products shall mean the products, under the premise of meeting requirements on functions of use and quality, with high energy efficiency according to the national standards for energy efficiency.

       第二条  本办法所称高效节能产品是指满足使用功能和质量要求的前提下,依据能源效率国家标准,能源效率较高的用能产品。

  Article 3   Manufacturers are the main contributors for promoting high-efficiency and energy-saving products. The Central Treasury shall subsidize enterprises manufacturing high-efficiency and energy-saving products which shall then sell the products at the price subject to subsidy deduction, and therefore consumers will be the ultimate beneficiaries.

       第三条  生产企业是高效节能产品推广的主体。中央财政对高效节能产品生产企业给予补助,再由生产企业按补助后的价格进行销售,消费者是最终受益人。

  Article 4    The Financial Subsidies shall be arranged and used scientifically, reasonably, justly and transparently and shall be subject to public supervision.

       第四条  补助资金按照科学合理、公正透明的原则安排使用，并接受社会监督。

Chapter 2 Products and Enterprises under Promotion

    第二章  推广产品与推广企业

  Article 5   The State shall include high-efficiency and energy-saving products with large quantity and wide use, those with large energy consumption and those with obvious potential in saving energy into the promotion scope that shall enjoy the Financial Subsidies. The specific product categories shall be determined separately. After the market share of high-efficiency and energy-saving products has reached certain level, the State shall no longer provide subsidies for promotion.

       第五条  国家将量大面广、用能量大、节能潜力明显的高效节能产品纳入财政补贴推广范围。具体产品种类另行确定。当高效节能产品市场份额达到一定水平时,国家不再补贴推广。

  Article 6   The Ministry of Finance and the National Development and Reform Commission shall establish an entry system for enterprises and products under promotion and shall formulate the detailed implementation rules for the promotion of all categories of products.

       第六条  财政部、国家发展改革委建立推广企业和产品准入制度,制定各类产品推广实施细则。

  Article 7   An eligible manufacturer shall submit the application report for promoting high-efficiency and energy-saving products and the following materials to the authority in charge of energy saving and the financial department at the place of domicile of the said manufacturer. Upon examination and verification by the authority in charge of energy saving and the financial department at the provincial level, the same shall be submitted to the National Development and Reform Commission and the Ministry of Finance. 

(1) the parameters in respect of energy efficiency, quality and performance of the products; 

(2) promotional price of the products; 

(3) promotion programs; and

(4) other relevant materials.

       第七条  符合条件的生产企业根据实施细则要求,将高效节能产品推广申请报告及下述材料报所在地节能主管部门和财政部门,经省级节能主管部门、财政部门审核后,报国家发展改革委、财政部。

    (一)产品的能源效率及质量性能参数;

    (二)产品推广价格;

    (三)推广方案;

    (四)其他相关材料。

  Article 8   The National Development and Reform Commission and the Ministry of Finance shall organize the examination and verification of the application report for promoting high-efficiency and energy-saving products and relevant materials submitted by the local authorities and announce the specification and models of the products under promotion and the list of enterprises under promotion.

       第八条  国家发展改革委、财政部组织对地方上报的高效节能产品推广申请报告及相关材料进行审核，并公告推广产品规格型号及推广企业目录。

Chapter 3 Conditions on Subsidies

    第三章  补助条件

  Article 9   High-efficiency and energy-saving products enjoying Financial Subsidies shall satisfy the following conditions:

(1) the products shall comply with the national standards for energy efficiency; the energy efficiency level shall be level one (1) or two (2); and other quality and performance shall comply with relevant national standards;

(2) the promotional quantity shall have achieved a certain scale;

(3) the actual selling price shall not be higher than the amount after the deduction of the Financial Subsidies from the promotional price promised by the enterprise;

(4) the products shall have unique identifiable barcode serial numbers and the logo and the words "Energy-saving Product, People-benefiting Project" shall be indicated on both the packaging and the products themselves as required;

(5) enterprises under promotion shall have sound after-sales service systems and ensure the quality and provide services as agreed;

(6) enterprises under promotion shall have perfect product sales systems and customer information management systems and shall provide relevant information as required; and

(7) other requirements as stipulated by the detailed implementation rules for the promotion of products.

       第九条  财政补助的高效节能产品必须符合以下条件:

    （一）符合能源效率国家标准要求，能源效率等级为1级或2级，其它质量性能符合相关国家标准规定;

    （二）推广数量达到一定规模;

    （三）实际销售价格不高于企业承诺的推广价格减去财政补助后的金额;

    （四）具有唯一可识别的产品条码序列号，外包装和本体上按要求加施“节能产品惠民工程”标识和字样;

    （五）推广企业具有完善的售后服务体系，履行约定的质量及服务;

    （六）推广企业具有完备的产品销售及用户信息管理系统，按要求提供相关信息;

    （七）产品推广实施细则规定的其他要求。

Chapter 4 Use Scope of and Standards for Subsidies

    第四章  资金使用范围和补助标准

  Article 10   The Financial Subsidies shall mainly be used to subsidize the promotion of high-efficiency and energy-saving products, supervision and inspection, the standardization of logos, information management, publicity and training as well as other promotional work.

       第十条  补助资金主要用于高效节能产品推广补助和监督检查、标准标识、信息管理、宣传培训等推广工作经费。

  Article 11   The subsidy standards for promoting high-efficiency and energy-saving products shall mainly be determined in accordance with a certain proportion of the cost difference between high-efficiency and energy-saving products and general products under the same category. The specific standards shall be stipulated in the corresponding detailed implementation rules.

       第十一条  高效节能产品推广补助标准主要根据高效节能产品与同类普通产品成本差异的一定比例确定。具体标准在相应实施细则中明确。

  Article 12   Regions where conditions permit are encouraged to arrange certain funds to support the promotion of high-efficiency and energy-saving products.

       第十二条  鼓励有条件的地方安排一定资金支持高效节能产品推广。

Chapter 5 Declaration and Distribution of Financial Subsidies

    第五章  补助资金申报和下达

  Article 13   At the end of each month, enterprises under promotion shall collect and enter the information about the actual promotion situation of high-efficiency and energy-saving products of the pervious month into the information management system and report the same level by level to the Ministry of Finance and the National Development and Reform Commission within ten (10) days.

       第十三条  推广企业在月度终了后,将上月高效节能产品实际推广情况汇总录入信息管理系统,并于10日内将推广情况及相关信息逐级上报财政部、国家发展改革委。

  Article 14   The local financial department and the local authority in charge of energy saving shall examine and verify the promotion situation within its administrative region via the information management system for the promotion of high-efficiency and energy-saving products.

       第十四条  地方财政部门、节能主管部门通过高效节能产品推广信息管理系统对本地区产品推广情况进行审核。

  Article 15    The Ministry of Finance may advance the Financial Subsidies for product promotion in accordance with the monthly promotion situation of the enterprise under promotion. Financial departments at all levels shall timely allocate the Financial Subsidies to enterprises under promotion in accordance with the management rules of the State Treasury and other relevant provisions.

       第十五条  财政部根据推广企业月度推广情况,预拨产品推广补助资金。各级财政部门按照财政国库管理制度等有关规定,将补助资金及时拨付给推广企业。

  Article 16   Within thirty (30) days after the end of the year, enterprises under promotion shall prepare audit reports of the Financial Subsidies in the previous year and report the same to the Ministry of Finance level by level. The Ministry of Finance shall conduct audit of the Financial Subsidies in accordance with the examination and verification result and the situation of the special verification and inspection of local financial departments and local authorities in charge of energy saving.

       第十六条  年度终了后30日内,推广企业编制上年度补助资金清算报告,逐级上报财政部。财政部根据地方财政部门、节能主管部门审核结果和专项核查情况进行补助资金清算。

  Article 17    The Ministry of Finance shall arrange for a certain amount of operating expenses in accordance with the work progress, needs of the funds and other situations in the promotion of high-efficiency and energy-saving products.

       第十七条  财政部根据高效节能产品推广工作进展、资金需求等情况安排一定工作经费。

Chapter 6 Supervision and Administration

    第六章  监督管理

  Article 18   The Ministry of Finance and the National Development and Reform Commission shall organize special inspection of the promotion situation of high-efficiency and energy-saving products. Local financial departments and local authorities in charge of energy saving shall conduct routine verification and inspection of the promotion of high-efficiency and energy-saving products.

       第十八条  财政部、国家发展改革委组织对高效节能产品推广情况开展专项检查。地方财政部门、节能主管部门对高效节能产品推广情况进行日常核查。

  Article 19   Where any of the following circumstances occurs to an enterprise under promotion, the Ministry of Finance and the National Development and Reform Commission shall circulate a notice of criticism, deduct the Financial Subsidies or impose other penalties depending on the circumstances. In the case of grave circumstances, the National Development and Reform Commission and the Ministry of Finance shall cancel the qualification for the promotion of high-efficiency and energy-saving products of the enterprise:

(1) defrauding the Financial Subsidies by providing false information;

(2) the products under promotion fail to meet the requirements on energy efficiency, quality and performance; 

(3) the annual quantities of high-efficiency and energy-saving products fail to reach the prescribed scale;

(4) the actual selling price of the products under promotion is higher than the amount after the deduction of the Financial Subsidies from the promotional price promised by the enterprise; and

(5) the enterprise under promotion fails to use the logo as required, or forges the logo, or knowingly uses a logo other than its own, or makes use of the logo to conduct false propaganda to mislead consumers.

       第十九条  推广企业有下列情形之一的,财政部、国家发展改革委将视情节给予通报批评、扣减补助资金等处罚。情节严重的,由国家发展改革委、财政部取消企业高效节能产品推广资格:

    (一)提供虚假信息、骗取补助资金的;

    (二)推广产品的能源效率、质量性能指标不符合要求的;

    (三)年推广高效节能产品数量未达到规定规模的;

    (四)推广产品实际销售价格高于企业承诺推广价格减去财政补助的;

    (五)未按要求使用标识,或伪造、冒用标识,利用标识做虚假宣传,误导消费者的。

  Article 20   Where it is verified that relevant agencies issue false reports or certification materials, the said agencies shall be publicly exposed and corresponding legal liabilities shall be pursued in light of the circumstances.

       第二十条  对出具虚假报告和证明材料的相关机构,一经查实,予以公开曝光,并视情节追究其相应法律责任。

  Article 21   The Financial Subsidies shall be used for prescribed purposes. No entity may withhold or embezzle the subsidies for any reason or by any means. In the case of any violation, entities and/or personnel concerned shall be held liable in accordance with relevant provisions of the Regulation on Penalties and Sanctions against Finacnce-related Voilations (Order of the State Council, No. 427) and other relevant provisions.

       第二十一条  补助资金必须专款专用。任何单位不得以任何理由、任何形式截留、挪用。对违反规定的，按照《财政违法行为处罚处分条例》（国务院令第427号）等有关规定，依法追究有关单位和人员的责任。

Chapter 7 Supplementary Provisions

    第七章  附则

  Article 22   These Measures shall be interpreted by the Ministry of Finance and the National Development and Reform Commission.

       第二十二条  本办法由财政部、国家发展改革委负责解释。

  Article 23   These Measures shall come into force as of the date of printing and circulating.

       第二十三条  本办法自印发之日起实施。
