The development and reform commissions, competent departments of industry and information technology, communication administrations, supervision departments, finance departments, housing and urban-rural development departments (construction committee, construction and transport committee), transport departments, water resources departments, competent commerce department, legislative affairs offices and railway bureaus of all the provinces, autonomous regions and municipalities directly under the Central Government and the administrative bureaus of civil aviation at all regions, 

The strict implementation of the system for the announcement of the records of illegal tendering and bidding acts is an important task in the specialized management of the prominent problems in the area of works construction. Since the promulgation and implementation of the Interim Measures for the Announcement of the Records of Illegal Tendering and Bidding Acts (Fa Gai Fa Gui [2008] No. 1531, hereinafter referred to as the Interim Measures) on January 1, 2009, all the regions has conscientiously and thoroughly implemented the Measures and achieve positive effect in promoting integrity in the tendering and bidding markets. However, the overall progress is not balanced. Some places have not set up the announcement platform yet while others have not published announcements in accordance with the provisions in a timely manner even though the announcement platforms have been set up, and these have affected the effect of the implementation of the system for the announcement of the records of law-breaking behavior. In order to further and thoroughly implement the arrangement and requirements in relation to the Opinions on the Commencement of Specialized Management of the Prominent Problems in the Area of Works Construction (Zhong Ban Fa [2009] No.27) issued by the General Office of the of the Central Committee of the Communist Party of China and the General Office of the State Council, the Implementation Plan for the Specialized Management of the Prominent Problems in the Area of Works Construction (Zhong Zhi Gong Fa [2009] No. 2) formulated by and the Guiding Opinions on Regulating the Decision-making Behavior and Tendering and Bidding Activities Regarding Construction Projects and (Zhong Zhi Gong Fa [2009] No. 3) given by the leadership group of the central government responsible for the management of the prominent problems in the area of works construction, practically bring into play the function of the system for the announcement of the records of illegal tendering and bidding acts in punishing a party for not being credible and promote the establishment of the credibility system for the tendering and bidding markets, the relevant issues are hereby notified as follows: 

    各省、自治区、直辖市发展改革委、工业和信息化主管部门、通信管理局、监察厅、财政厅、住房城乡建设厅(建委、建设交通委)、交通厅、水利厅、商务主管部门、法制办、各铁路局、民航各地区管理局:

    严格落实招标投标违法行为记录公告制度是工程建设领域突出问题专项治理工作的一项重要任务。《招标投标违法行为记录公告暂行办法》(发改法规[2008]1531号,以下简称《暂行办法》)自2009年1月1日颁布实施以来,各地认真贯彻落实,推进招标投标市场诚信建设取得积极成效。但是,总体进展尚不平衡,一些地方至今尚未建立公告平台,一些地方虽建立了公告平台却没有按照规定及时进行公告,影响了违法行为记录公告制度实施效果。为进一步贯彻落实中共中央办公厅、国务院办公厅《关于开展工程建设领域突出问题专项治理工作的意见》(中办发[2009]27号)、中央治理工程建设领域突出问题工作领导小组《工程建设领域突出问题专项治理工作实施方案》(中治工发[2009]2号)和《规范工程建设项目决策行为和招标投标活动指导意见》(中治工发[2009]3号)部署和要求,切实发挥招标投标违法行为记录公告制度的失信惩戒作用,促进招标投标市场信用体系建设,现将有关事项通知如下:

1. Pay close attention to the establishment of the platform for the announcement of the records of law-breaking behavior. Before the end of May 2010, all the competent administrative departments at the provincial level shall, in accordance with the requirements of the Interim Measures, establish the platform for the announcement of the records of illegal tendering and bidding acts in the websites of their own departments and properly maintain and manage the announcement platform. In case the announcement platform has already been established, the department shall further regulate and improve the platform and gradually ensure interoperability, mutual recognition and shared usage. A uniform platform for the announcement of the records of law-breaking behavior shall be established if conditions are mature. Strengthen the guidance and supervision of the establishment of the platforms for the announcement of the records of illegal tendering and bidding acts at the municipal and county levels and strive to establish announcement platforms at four levels, namely the level of the relevant departments of the State Council and the provincial, municipal and county levels by the end of this year. In conjunction with the work on the specialized management of the prominent problems in the area of works construction, the implementation of the system regarding the platform for the announcement of the records of illegal tendering and bidding acts and the establishment of the information disclosure and integrity system for projects in the area of works construction shall be combined and the sharing of information shall be promoted.

       一、抓紧建立违法行为记录公告平台。2010年5月底前,各省级有关行政主管部门要按照《暂行办法》要求,在本部门网站上建立招标投标违法行为记录公告平台,并做好公告平台维护和管理工作;已经建立的,进一步规范和完善公告平台,逐步实现互联互通、互认共用;条件成熟的建立统一的违法行为记录公告平台。要加强对市、县级招标投标违法行为记录公告平台建设的指导和督促,争取今年年底前,建立起国务院有关部门,以及省、市、县四级公告平台。结合开展工程建设领域突出问题专项治理工作,将招标投标违法行为记录公告平台制度落实与工程建设领域项目信息公开和诚信体系建设相结合,促进信息共享。

2. Announce records of law-breaking behavior in accordance with the law. All the competent administrative departments at the provincial level shall seize the opportunity to implement the central government's work arrangement regarding the specialized management of the prominent problems in the area of works construction, step up efforts in supervision and inspection and seriously investigate and punish illegal tendering and bidding acts according to the stipulated segregation of duties. Law-breaking behavior that shall be announced in accordance with the law shall be announced in the announcement platform in a timely manner. Announcement shall be published in strict accordance with the procedures and requirements stipulated in the Interim Measures and announcements shall be accurate and objective. The announcement of illegal tendering and bidding acts by all the competent administrative departments at the provincial level is an administrative decision for the handling of the cases and shall be reported to the corresponding competent administrative departments of the State Council in accordance with the requirements in a timely manner. The competent administrative departments of the State Council shall select a group of typical cases for announcement, strengthen the guidance on the announcement of the records of law-breaking behavior by this system and establish the information disclosure system regarding the announcement records of the system.

       二、依法公告违法行为记录。各省级有关行政主管部门要以落实中央工程建设领域突出问题专项治理工作部署为契机,加大监督检查工作力度,按照规定的职责分工,严肃查处招标投标违法违规行为。对于依法应当公告的违法行为,应及时在公告平台上公告。严格按照《暂行办法》规定的程序和要求发布公告,确保公告准确和客观。各省级有关行政主管部门公告的招标投标违法行为行政处理决定,须按要求及时抄报相应国务院行政主管部门。国务院有关行政主管部门将选取一批典型案件进行公告,并加强对本系统违法行为记录公告工作的指导,建立系统公告记录信息通报制度。

3. Impose more severe punishment on parties that are not credible in tendering and bidding activities. All the regions may, based on the actual local situations, further improve the penalty system for parties that are not credible, regard the announced records of illegal tendering and bidding acts as the important basis for activities such as the recognition of the qualifications of tender agencies, the examination of qualifications of bidders in projects which requires tender by law, the selection of tender agencies, the recommendation and determination of tender winning parties, the determination of the members of the bid assessment committee and the appraisal by bid assessment experts. 

All the regions shall, based on the central government's uniform work arrangement regarding the specialized management of the prominent problems in the area of works construction, adopt effective measures and fully implement the system for the announcement of the records of illegal tendering and bidding acts. In the first half of 2010, the National Development and Reform Commission and the Ministry of Supervision will, in conjunction with the relevant departments of the State Council, supervise and inspect the status of thorough implementation at all regions and focus on the inspection of the establishment and operation of the announcement platform and circulate notices about regions that do not establish announcement platforms or fail to announce the records of law-breaking behavior in accordance with the provisions in a timely manner.

       三、加大招标投标失信惩戒力度。各地可以结合本地实际，进一步健全失信惩戒制度，将公告的招标投标违法行为记录作为招标代理机构资格认定、依法必须招标项目投标人资格审查、招标代理机构选择、中标人推荐和确定、评标委员会成员确定和评标专家考核等活动的重要依据。

    各地要按照中央工程建设领域突出问题专项治理工作统一部署，采取有效措施，全面落实招标投标违法行为记录公告制度。2010年上半年，国家发展改革委、监察部将会同国务院有关部门对各地贯彻落实情况进行监督检查，重点检查公告平台建立和运行情况。对没有建立公告平台，或者不按照规定及时公告违法行为记录的地方，要进行通报。
