Notice on Issues Concerning Work-Related Injuries of Personnel of Public Institutions and Private Non-Profit Organizations

Labor and social security, personnel, civil affairs and finance departments (bureaus) in all provinces, autonomous regions and municipalities directly under the Central Government,

For the purpose of protecting the rights of personnel in public institutions and private non-profit organizations under the work-related injury insurance program who suffer from work-related injuries or occupational diseases, relevant issues are hereby notified as follows with the approval by the State Council in accordance with the Work-Related Injury Insurance Regulations:

    各省、自治区、直辖市劳动保障、人事、民政、财政厅(局):

    为保障事业单位、民间非营利组织因工作遭受事故伤害或者患职业病的工作人员依法享受工伤保险待遇,根据《工伤保险条例》规定,经国务院批准,现就有关问题通知如下:

1. For personnel of public institutions and private non-profit organizations who suffer from work-related injuries or occupational diseases, the scope of work-related injuries, determination of work-related injuries, evaluation of working capacity and compensation criteria shall be in accordance with the Work-Related Injury Insurance Regulations.

       一、事业单位、民间非营利组织工作人员因工作遭受事故伤害或者患职业病的,其工伤范围、工伤认定、劳动能力鉴定、待遇标准等按照《工伤保险条例》的有关规定执行。

2. Public institutions and private non-profit organizations not supported by governmental budget or not regularly financed from governmental budget shall be included into the work-related injury insurance program of the local region. The work-related injury insurance premium paid shall be recognized as social security contribution.

       二、不属于财政拨款支持范围或没有经常性财政拨款的事业单位、民间非营利组织,参加统筹地区的工伤保险。缴纳工伤保险费所需费用在社会保障缴费中列支。

3. Personnel of public institutions and social organizations administered in accordance with or with reference to the national civil servant system shall be subject to the work-related injury policy governing personnel of governmental authorities.

       三、依照或者参照国家公务员制度管理的事业单位、社会团体的工作人员,执行国家机关工作人员的工伤政策。

4. Public institutions and private non-profit organizations other than set forth in Articles 2 and 3 may either be included into the work-related insurance program of the local region or be subject to the work-related injury policy governing personnel of governmental authorities. Specific measures shall be developed by the people's government at provincial level in line with local economic and social conditions and particular situations of local public institutions and private non-profit institutions.

       四、第二条、第三条规定范围以外的事业单位、民间非营利组织,可参加统筹地区的工伤保险,也可按照国家机关工作人员的有关工伤政策执行。具体办法由省级人民政府根据当地经济社会发展和事业单位、民间非营利组织的具体情况确定。

5. This Notice shall come into effect as of the date of issuance. For public institutions and private non-profit organizations covered by the work-related injury insurance program, the work-related injury insurance benefits enjoyed by any employee thereof who suffers any work-related injury prior to issuance of this Notice shall remain unchanged.

       五、本通知自下发之日起施行。参加工伤保险的事业单位、民间非营利组织,其工作人员在本通知下发前已发生工伤的,其原享受的工伤待遇不变。

6. For the purpose of this Notice, the "private non-profit organizations" shall mean social organizations, foundations and private non-enterprise entities.

Work-related injury insurance for public institutions and private non-profit organizations involves substantial interests of their employees and has an effect on many aspects. Labor and social security, personnel, civil affairs, finance and other related authorities shall fulfill their respective duties concerned. Cross-regional and inter-departmental efforts are required to strengthen supervision and administration of work-related injury insurance in public institutions and private non-profit organizations, thereby ensuring smooth work relating to the work-related injury insurance in public institutions and private non-profit organizations, protecting legitimate rights and interests of employees and promoting social stability and development. Any major issue shall be reported on a timely basis.

       六、本通知所称民间非营利组织是指社会团体、基金会和民办非企业单位。

    事业单位、民间非营利组织的工伤保险,关系广大职工的切身利益,涉及面广。劳动保障、人事、民政、财政等有关部门要认真履行各自的职责。各地区、各部门要密切配合,加强对事业单位、民间非营利组织工伤保险运行情况的监督和管理,确保事业单位、民间非营利组织工伤保险工作的正常开展,维护职工的合法权益,促进社会稳定和发展。重大问题请及时报告。
