Notice of the Ministry of Labor and Social Security and the Ministry of Finance on Issues relating to Organizations within the Banking System Participating in Unemployment Insurance

To the labor and social security departments (bureaus), the financial departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government:

In order to implement the Regulations on Unemployment Insurance and the Interim Regulations on Collecting and Paying Social Insurance Premium, to successfully enable participation of banking system in unemployment insurance, this Notice on relevant issues is hereby promulgated as follows:

    各省、自治区、直辖市劳动和社会保障厅(局),财政厅(局):为贯彻施行《失业保险条例》和《社会保险费征缴暂行条例》,做好银行系统参加失业保险工作,现就有关问题通知如下:

1. The People's Bank of China and its branches are not included in the scope of implementing the unemployment insurance. The enterprises and public institutions of various types subordinate to the People's Bank of China and the employees thereof shall participate in the unemployment insurance offered at the places of their locations in accordance with provisions.

       一、中国人民银行及其分支机构,不纳入失业保险实施范围。中国人民银行所属的各类企业事业单位及其职工,应按规定参加单位所在地的失业保险。

2. All commercial banks and their employees shall participate in the unemployment insurance offered at the places of their locations.

       二、各商业银行及其职工,均应参加单位所在地的失业保险。

3. All policy banks of the State and their employees shall participate in the unemployment insurance offered at the places of their locations.

       三、各国家政策性银行及其职工,均应参加单位所在地的失业保险。

4. Organizations within the banking system and their employees that participate in the unemployment insurance shall sincerely perform specified obligations to pay insurance premium. Where any of such employees loses his or her job, he/she shall be entitled to the unemployment insurance treatment in accordance with these provisions.

       四、参加失业保险的银行系统单位及其职工,应当认真履行规定的缴费义务。其职工失业后,按规定享受失业保险待遇。

5. Labor security departments at all levels and their social insurance administrative institutions managing the unemployment insurance matters shall properly carry out the work of publicizing the relevant laws, regulations and policies among the relevant organizations within banking system; they shall strengthen the guidance thereof to make all organizations within banking system participate in the unemployment insurance in accordance with provisions.

       五、各级劳动保障部门及其经办失业保险业务的社会保险经办机构,应对银行系统的有关单位做好相关法律、法规和政策的宣传工作,加强指导,使银行系统各单位按规定参加失业保险。
