To the Development and Reform Commissions, Price Bureaus, Departments (Bureaus) of Finance and Departments (Bureaus) of Water Resources of all provinces, autonomous regions and municipalities directly under the Central Government and to all watershed agencies:

In order to push forward the water price reform and promote the conservation and protection of water resources, this Notice is hereby issued, based on relevant provisions set out by the Administrative Regulations on the Collection of Water Permit and Water Resources Fees (Decree No. 460 of the State Council), concerning the water resource charging standards for water conservancy projects of the Central Government and those covering multiple provinces, autonomous regions and municipalities directly under the Central Government and other relevant issues.

    各省、自治区、直辖市发展改革委、物价局、财政厅(局)、水利(水务)厅(局),各流域机构:

    为推进水价改革,促进水资源节约和保护,根据《取水许可和水资源费征收管理条例》(国务院令第460号)有关规定,现就中央直属和跨省、自治区、直辖市水利工程的水资源费征收标准及有关问题通知如下:

1. Basic principles for determining water resource charging standards: (1) Promote rational development, utilization, conservation and protection of water resources; (2) Adapt to the water resource conditions and the level of economic and social development, and take into full account the differences between different industries and sectors; (3) Ensure consistency between the charging standards concerning water resources of the same nature so as to maintain a fair market environment.

       一、制定水资源费征收标准的基本原则:(一)促进水资源的合理开发、利用、节约和保护;(二)与水资源条件和经济社会发展水平相适应,并充分考虑不同产业和行业的差别;(三)保持同类性质用水水资源费征收标准的统一性,维护公平的市场环境。

2. Water resource charging standards for water conservancy projects of the Central Government and those covering multiple provinces, autonomous regions and municipalities directly under the Central Government shall be reviewed by the watershed administration authorities, and be formulated and revised by the National Development and Reform Commission, jointly with the Ministry of Finance and the Ministry of Water Resources.

Water resource charging standards for other water conservancy projects shall be formulated and revised by the price competent departments of the provinces, autonomous regions and municipalities directly under the Central Government along with the competent departments for finance and water resources at the same level, and shall be reported to the people's governments at the same level for approval, and to the National Development and Reform Commission, the Ministry of Finance and the Ministry of Water Resources for record-filing.

       二、由流域管理机构审批取水的中央直属和跨省、自治区、直辖市水利工程的水资源费征收标准,由国家发展改革委会同财政部、水利部制定和调整。

    其他水利工程的水资源费征收标准,由省、自治区、直辖市价格主管部门会同同级财政、水行政主管部门制定和调整,报本级人民政府批准,并报国家发展改革委、财政部、水利部备案。

3. Water resource charging standards for water conservancy projects of the Central Government and those covering multiple provinces, autonomous regions and municipalities directly under the Central Government, the use of which is approved by relevant watershed administration authorities, shall be: 

(1) Water for agricultural production shall be provided free of charge.

(2) Non-agricultural water (excluding water for hydraulic power generation) shall be temporarily subject to the existing charging standards effective at the place where the intake is located.

(3) RMB0.003-0.008 per KWh for hydraulic power generation: the rate of RMB0.008 per KWh shall be adopted in provinces, autonomous regions and municipalities directly under the Central Government (where the intakes are located) whose local water resource charging standards for hydraulic power generation of the same kind are lower than RMB0.003 per KWh; if the local standards are higher than RMB0.008 per KWh, RMB0.008 shall apply; water resource charging standards ranging between RMB0.003 and RMB0.008 shall remain unchanged. Water for pumped storage power generation shall be provided free of charge for the time being.

       三、由流域管理机构审批取水的中央直属和跨省、自治区、直辖市水利工程的水资源费征收标准为:

    (一)供农业生产用水暂免征收水资源费。

    (二)供非农业用水(不含供水力发电用水)暂按取水口所在地现行标准执行。

    (三)水力发电用水为每千瓦时0.3-0.8分钱,其中:取水口所在地省、自治区、直辖市制定的同类水力发电用水水资源费征收标准低于每千瓦时0.3分钱的,按0.3分钱执行;高于0.8分钱的,按0.8分钱执行;在0.3—0.8分钱之间的,维持不变。抽水蓄能发电用水暂免征收水资源费。

4. The water resource fees paid by water conservancy project enterprises directly under the Central Government and those covering multiple provinces, autonomous regions and municipalities directly under the Central Government shall be included in the production cost.

       四、中央直属和跨省、自治区、直辖市水利工程单位(企业)缴纳的水资源费计入生产成本。

5. All local governments shall not overstep their authority to issue new administrative and institutional fee items involving hydroelectric enterprises of the Central Government and those covering multiple provinces, autonomous regions and municipalities directly under the Central Government.

       五、各地不得越权出台涉及中央直属和跨省、自治区、直辖市水电企业的新的行政事业性收费项目。

6. The directory of water conservancy projects of the Central Government and covering multiple provinces, autonomous regions and municipalities directly under the Central Government shall be determined and announced by the Ministry of Water Resources, the National Development and Reform Commission and the Ministry of Finance.

       六、中央直属和跨省、自治区、直辖市水利工程名录,由水利部商国家发展改革委、财政部确定并公布。

7. These provisions shall come into effect as of September 1, 2009.
