Notice of the National Development and Reform Commission and the Ministry of Finance on the Charging Standards for Administrative Authorities’ Disclosure of Government Information Upon Request and Relevant Issues

All the ministries (commissions) of the State Council and institutions directly under the State Council, development and reform commissions, price bureaus and financial departments (bureaus) of all the provinces, autonomous regions and municipalities directly under the Central Government, Development and Reform Commission and Bureau of Finance of the Xinjiang Production and Construction Corps:

For the purposes of promoting administration in accordance with the law and enhancing transparency of government work, and in accordance with the Regulation of the People's Republic of China on the Disclosure of Government Information (Order No. 492 of the State Council) and Notice of the Ministry of Finance and the National Development and Reform Commission on Issues Concerning Collection of Fees for Disclosure of Government Information (Cai Zong [2008] No. 44), the charging standards for administrative authorities' disclosure of government information upon request and relevant issues are hereby notified as follows:

    国务院各部委、各直属机构,各省、自治区、直辖市发展改革委、物价局、财政厅(局),新疆生产建设兵团发展改革委、财务局:

    为促进依法行政,提高政府工作的透明度,根据《中华人民共和国信息公开条例》(国务院令第492号)和《财政部、国家发展改革委关于提供政府公开信息收取费用等有关问题的通知》(财综[2008]44号)有关规定,现就行政机关依申请提供政府公开信息的收费标准及有关问题通知如下:

1. Where administrative authorities take the initiative to disclose government information through government bulletins, government websites, news conferences as well as newspapers, periodicals, radio, TV, etc, no fees shall be charged. 

Where, upon the written request of citizens, legal persons or other organizations, administrative authorities disclose government information beyond the scope of the information disclosed on their initiative, a search fee, reproduction fee and mailing cost may be charged from the applicant; and the specific charging standards shall be jointly determined and published by local pricing authorities and financial authorities of the provinces, autonomous regions and municipalities directly under the Central Government in line with the principle of cost compensation.Where the ministries (commissions) of the State Council and institutions directly under the State Council disclose government information upon request, they shall implement the local charging standards jointly formulated by competent pricing departments and financial departments of the provinces, autonomous regions and municipalities directly under the Central Government.

       一、行政机关通过政府公报、政府网站、新闻发布会以及报刊、广播、电视等形式主动提供政府公开信息,一律不得收取任何费用。

    行政机关依公民、法人或者其他组织的书面申请提供本机关主动公开信息范围以外的政府公开信息,可以向申请人收取检索费、复制费、邮寄费,具体收费标准由所在地省、自治区、直辖市价格主管部门会同财政部门按照补偿成本原则制定并向社会公示。国务院各部(委)、各直属机构依申请提供政府公开信息的收费,执行所在地省、自治区、直辖市价格主管部门会同财政部门制定的收费标准。

2. Childless and infirm old persons in rural areas who are entitled to food, clothing, medical care, housing and burial expenses provided by the State, urban and rural residents entiitled to low-income allowances and people entitled to the State's pension for the disabled or the bereaved family shall be exempted from such fees if they can provide valid certification issued by the township people's government or street offices, and their applications are reviewed and approved by the divisions responsible for the disclosure of government information in the administrative authorities.

       二、农村五保供养对象、城乡居民最低生活保障对象,以及领取国家抚恤补助的优抚对象,凭所在地乡镇人民政府或街道办事处出具的有效证明,经本人申请、行政机关政府信息公开工作机构审核,可以免收相关费用。

3. The collection agencies shall obtain a fee collection permit from the designated pricing departments in accordance with the relevant regulations, and use the financial bills prepared respectively by the Ministry of Finance and financial departments of the provinces, autonomous regions and municipalities directly under the Central Government in accordance with relationship of financial affiliation.

       三、收费单位应按规定到指定的价格主管部门办理收费许可证,并按财务隶属关系分别使用财政部和省、自治区、直辖市财政部门统一印制的财政票据。

4. The collection agencies shall collect fees in strict accordance with the above provisions, and shall not increase charging items, expand charging scope, or raise charging standards unless authorized, or disclose government information through other organizations or individuals in the form of paid services. They shall also consciously accept supervision and examination of pricing, financial and audit authorities.

       四、收费单位应严格按照上述规定收费,不得擅自增加收费项目、扩大收费范围或提高收费标准,更不得通过其他组织、个人以有偿服务方式提供政府信息,并自觉接受价格、财政、审计部门的监督检查。

5. Provisions of this Notice shall be referred to in the administration of fee collection for government information disclosure by the organizations with the power of administration of public affairs authorized by relevant laws and regulations. 

These provisions shall become effective from the date of promulgation.

       五、法律、法规授权的具有管理公共事务职能的组织公开政府信息活动的收费管理，参照本通知的规定执行。

    上述规定自本通知自发布之日起执行。
