To the Ministry of Industry and Information Technology:

 acknowledge our receipt of your Letter Regarding an Application for Verifying and Approving the Charging Standards for Frequency Occupancy of 3G Public Mobile Communication Networks (Gong Xin Bu Cai [2010] No. 579). After discussion, the verification and approval of charging standards for frequency occupancy of 3G public mobile communication networks and relevant matters are hereby notified as follows:

    你部《关于申请核定第三代公众移动通信网络频率占用费收费标准的函》(工信部财[2010]579号)收悉。经研究,现就核定第三代公众移动通信网络频率占用费收费标准及有关问题通知如下:

1. The standards for fees charged by the national radio administration for the frequency occupancy by operators of 3G public mobile communication networks shall be implemented in accordance with the Charging Standards for frequency occupancy of 3G Public Mobile Communication Networks attached to this Notice. In view of the fact that China's 3G public mobile communication business is in an initial stage and the operators still need to increase in their investments, the above-mentioned standards are approved to be put into practice gradually within four years -- 25% in 2011, 50% in 2012, 75% in 2013 and 100% in 2014 and afterwards.

       一、国家无线电管理机构向第三代公众移动通信网络运营商收取的频率占用费收费标准,按附件《第三代公众移动通信网络频率占用费收费标准》规定执行。考虑到我国第三代公众移动通信业务处在起步阶段,运营企业仍需加大投入,同意上述收费标准从2011年起分四年逐步到位,即2011年按25%,2012年按50%,2013年按75%,2014年及以后按100%收取。

2. The standards for fees charged by the national radio administration for the frequency occupancy by the entities using special bands of 3G public mobile communication networks are as follows:

(1) For any profit-making entity applying for temporary use or use of bands for researches and experiments, 20% of the rates specified in the Charging Standards for Frequency Occupancy of 3G Public Mobile Communication Networks attached to this Notice shall be charged; and for any other nonprofit entity, 10% of the rates specified in the Charging Standards for Frequency Occupancy of 3G Public Mobile Communication Networks attached to this Notice shall be charged. Time of charging fees for frequency occupancy shall comply with the Regulations on Fees of Radio Administration (Ji Jia Fei [1998] No. 218)—"Fees for frequency occupancy shall be calculated and charged annually as of the date of frequency allocation or assignment. Fees for frequency occupancy for less than three months shall be calculated and charged as one fourth of a year, fees for frequency occupancy for more than three months but less than six months shall be charged as six months, and fees for frequency occupancy for more than six months but less than a year shall be charged as a year".

(2) For any entity using restricted bands (e.g. bands for indoor mobile communication signal coverage only), 30% of the rates specified in the Charging Standards for Frequency Occupancy of 3G Public Mobile Communication Networks attached to this Notice shall be charged.

       二、国家无线电管理机构向使用第三代公众移动通信特殊频段的单位收取的频率占用费收费标准为:

    (一)对申请临时使用或使用研究试验用频段的营利性单位,按附件《第三代公众移动通信网络频率占用费收费标准》规定标准的20%收取,其他非营利性单位按附件《第三代公众移动通信网络频率占用费收费标准》规定标准的10%收取。频率占用费计收时间按照《无线电管理收费规定》(计价费[1998]218号)规定执行,即“频率占用费自频率分配或指配之日起按年度计收。不足三个月的按四分之一年计收,超过三个月不足半年的按半年计收,超过半年不足一年的按一年计收”。

    (二)对使用范围受限频段(如只能用于室内移动通信信号覆盖等)的单位,按附件《第三代公众移动通信网络频率占用费收费标准》规定标准的30%收取。

3. Fees for Frequency Occupancy of 3G public mobile communication networks shall be incorporated into the central budget administration, and the specific administrative measures for use of fees shall be in accordance with relevant provisions of the Ministry of Finance.

       三、第三代公众移动通信网络频率占用费应纳入中央财政预算管理,具体使用管理办法按照财政部有关规定执行。

4. You shall, in accordance with the relevant provisions, apply with the National Development and Reform Commission for a charge permit and use the uniform bills printed and made by the Ministry of Finance.

       四、你部应按规定到国家发展改革委办理收费许可证,并使用财政部统一印制的票据。

5. You shall charge fees strictly in accordance with the above-mentioned provisions, shall not arbitrarily add chargeable items, expand the scope of charges, heighten charging standards or charge any other expenses additionally, and shall consciously accept the supervision and inspection from the price, financial and audit departments.

       五、你部要严格按照上述规定收费,不得擅自增加收费项目、扩大收费范围、提高收费标准或加收其他任何费用,并自觉接受价格、财政、审计部门的监督检查。

6. The abovementioned provisions shall come into effect as of May 1, 2011.
