The Development and Reform Commissions (Economic Commissions, Economic and Trade Commissions, and Commissions of Economy and Information Technology), Finance Departments (Bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government, cities under separate state planning including Xinjiang Production and Construction Corps, and the Government Offices Administration of the State Council:

Pursuant to relevant provisions of the Notice of the State Council General Office on Forwarding Opinions of the National Development and Reform Commission and other Departments on Accelerating the Implementation of the Energy Performance Contracting to Promote the Development of Energy Conservation Service Industry (Guo Ban Fa. [2010] No. 25), and theNotice of the Ministry of Finance and the National Development and Reform Commission on Issuing Interim Measures for the Administration of the Financial Rewards Funds to Energy Performance Contracting (Cai Jian [2010] No.249), we hereby notify you about the following supplements to the issues relating to financial awards to energy performance contracting projects:

    根据《国务院办公厅转发发展改革委等部门关于加快推行合同能源管理促进节能服务产业发展意见的通知》(国办发[2010]25号)和《财政部国家发展改革委关于印发〈合同能源管理财政奖励资金管理暂行办法〉的通知》(财建[2010]249号)有关规定,现就财政奖励合同能源管理项目有关事项补充通知如下:

I. The energy performance contracting projects [with their contracts] signed and executed on or after June 1, 2010 by energy services companies listed in the examination and filing list of the National Development and Reform Commission and the Ministry of Finance are eligible for the application of financial awards. The energy performance contracts signed after October 20, 2010 shall be made with the reference of the standard format set out by General Technical Rules for Energy Performance Contracting (attached hereto as GB/T24915-2010).

       一、国家发展改革委、财政部审核备案名单内的节能服务公司在2010年6月1日(含)以后签订并实施的符合规定条件的合同能源管理项目,可以申请财政奖励资金。2010年10月20日以后签订的能源管理合同,须参照《合同能源管理技术通则》(GB/T24915-2010,见附件)中的标准合同格式签订。

II. Project supported by the financial awards mainly include: boiler (furnace) renovation, waste heat and pressure utilization, electric motor system energy conservation, energy system optimization, green lighting renovation, existing construction energy conservation projects and any other such energy conservation renovation projects which have adopted the advanced and applicable technologies, techniques or products.

       二、财政奖励资金支持的项目内容主要为锅炉(窑炉)改造、余热余压利用、电机系统节能、能量系统优化、绿色照明改造、建筑节能改造等节能改造项目,且采用的技术、工艺、产品先进适用。

III. The following projects shall not be supported by the financial awards:

1. New construction or relocated construction projects.

2. Renovation projects that focus on increasing production capacity, "replacing small units with large ones," or projects for the purpose of replacing old facilities with new ones.

3. The main equipment to which the renovation is made does not conform to the policies of the State, and has been listed under the catalogue of products which the State has expressly ordered to eliminate or shall be eliminated soon according to the plans. 

4. The main subject that is under renovation is a project which has been examined and concluded to be in violation of regulations or a project which has been constructed in violation of relevant regulations.

5. Solar power and wind power utilization projects.

6. Projects that substitute energy generated from the total combustion or co-combustion of straw, rice hull and any other such discarded biomass fuels, or any low-quality energy for high-quality energy.

7. Power generation projects that utilize coal slack, coal bed gas, and waste.

8. Thermoelectricity cogeneration projects.

9. Projects that utilize combustion adjutants-added coals.

10. Electricity generation projects established and put into operation after January 1, 2007 that utilize the waste heat of cement production lines, or blast-furnace gas, coke oven gas, and waste heat and pressure from sintering in steel enterprises.

11. Projects which have already obtained related financial subsidies from the State.

       三、属于下列情形之一的项目不予支持。

    （一）新建、异地迁建项目。

    （二）以扩大产能为主的改造项目，或“上大压小”、等量淘汰类项目。

    （三）改造所依附的主体装置不符合国家政策，已列入国家明令淘汰或按计划近期淘汰的目录。

    （四）改造主体属违规审批或违规建设的项目。

    （五）太阳能、风能利用类项目。

    （六）以全烧或掺烧秸杆、稻壳和其它废弃生物质燃料，或以劣质能源替代优质能源类项目。

    （七）煤矸石发电、煤层气发电、垃圾焚烧发电类项目。

    （八）热电联产类项目。

    （九）添加燃煤助燃剂类项目。

    （十）2007年1月1日以后建成投产的水泥生产线余热发电项目，以及2007年1月1日以后建成投产的钢铁企业高炉煤气、焦炉煤气、烧结余热余压发电项目。

    （十一）已获得国家其他相关补助的项目。

Competent administrative departments of energy conservation and public finance departments at all places shall comply with this Supplemental Notice in the projects examination and appropriation of funds, shall promptly make detailed local level implementation measures on granting financial rewards to energy performance contracting projects at all places and file with the National Development and Reform Commission and the Ministry of Finance before November 15, 2010.
