Chapter 1: General Provisions
第一章 总则
Article 1 These Measures are formulated in accordance with the Regulations on Realty Management as provided by the State Council, the Provisions of the Harbin Municipality on Realty Management and other relevant laws and regulations, by taking into consideration the required circumstances of this Municipality, for the purpose of strengthening the management of the special housing maintenance fund by ensuring the maintenance and normal use of residential housing and safeguarding the legal rights and interests of the owners of the special housing maintenance fund.
第一条 为加强住房专项维修资金的管理,保障住房的维修和正常使用,维护住房专项维修资金所有者的合法权益,根据国务院《物业管理条例》和《哈尔滨市物业管理规定》等有关法律、法规的规定,结合本市实际,制定本办法。
Article 2 These Measures shall be applicable to the deposit, management, use and supervision of the special housing maintenance fund on the State-owned lands within the areas of urban planning of this Municipality.
第二条 本市城市规划区国有土地上的住房专项维修资金的缴存、管理、使用和监督,适用本办法。
Article 3 The term "special housing maintenance fund" mentioned in these Measures (hereinafter referred to as the "maintenance fund") means fund specially used for the maintenance, renewal and transformation of the shared parts, facilities and equipment of housing after the expiration of their guarantee period.
第三条 本办法所称住房专项维修资金(以下简称维修资金),是指专项用于住房共用部位、共用设施设备保修期满后的维修、更新、改造资金。
Article 4 The term "shared parts" mentioned in these Measures means the area within a building, the main bearing structure, external walls, foyer, stairwells and other parts contained within the whole building in terms of use and functions shared by all owners and users of the whole building in accordance with the laws, regulations and the sales contract of housing.
The term "shared facilities and equipment" mentioned in these Measures means water pipelines, elevators, electricity supply and distribution facilities and equipment, firefighting and safety monitoring facilities and equipment, non-profit cultural and leisure facilities, green open space, roads, roadside lamps and non-operating parking lots shared by all owners and users within an area of property management or inside a single building as well as the houses occupied by relevant shared facilities and equipment.
The term "shared parts, facilities and equipment" mentioned in these Measures shall not include the relevant pipelines, facilities and equipment, which are managed and whose maintenance costs are covered by organizations of water supply, drainage, heating, gas supply, telecommunications and cable television within an area of property management.
第四条 本办法所称共用部位,是指根据法律、法规和住房买卖合同,在一幢房屋内部,由整幢房屋的业主、使用人共用的房屋主体承重结构、外墙面、门厅、楼梯间和其他在使用上、功能上为整幢建筑服务的部位等。
本办法所称共用设施设备,是指根据法律、法规和住房买卖合同,在物业管理区域或者单幢房屋内,由业主、使用人共用的上下水管道、电梯、供配电设施设备、消防及安全监控设施设备、公益性文体康乐设施、绿地、道路、路灯、非经营性停车场所和有关共用设施设备使用的房屋等。
物业管理区域内依法属于供水、排水、供热、供电、供气、通讯、有线电视等单位负责管理和承担维修费用的相关管线和设施设备,不属于本办法所称的住房共用部位、共用设施设备。
Article 5 With respect to the proprietors of a residential realty with two owners or more, the non-residential realty within a residential or organization or the non-residential realty structurally linked to a single residential building shall establish the maintenance fund in accordance with these Measures.
The maintenance fund shall be owned by all proprietors, and it shall not be occupied or misappropriated by any organization or individual.
第五条 拥有两个以上房屋所有权人的住宅物业、住宅小区内的非住宅物业或者与单幢住宅楼结构相连的非住宅物业的业主,应当按照本办法的规定建立维修资金。
维修资金属于业主所有,任何单位和个人不得占用、挪用。
Article 6 The management of the maintenance fund shall follow the principles of unified deposit, by creating a special account for a special deposit, a special fund for a special purpose; these decisions are to be made by the owners and pursuant to governmental supervision.
第六条 维修资金管理实行统一缴存、专户存储、专款专用、所有人决策、政府监督的原则。
Article 7 The competent municipal administrative department for real estate shall be responsible for managing, supervising and guiding the collection and use of the maintenance fund within this Municipality.
The competent municipal administrative department for real estate may entrust the responsibility of the maintenance fund on the municipal management agency for the routine work of managing, supervising and guiding the collection and use of the maintenance fund.
第七条 市房产行政主管部门负责本市维修资金归集与使用的管理、监督、指导工作。
市房产行政主管部门可以委托市维修资金管理机构具体负责维修资金归集与使用的管理、监督、指导的日常工作。
Chapter 2: Deposit of the Maintenance Fund
第二章 维修资金的缴存
Article 8 The initial maintenance fund of commercial housing (including affordable housing, the same as mentioned below) shall be deposited by the proprietors. The proprietors shall deposit their initial maintenance fund in accordance with the following provisions:
(1) Before the sale of commercial housing, the project owners, as proprietors, shall deposit 2% of the cost price per square meter of floor space into the special bank account before they go through the formalities of filing the sales of commercial housing for the record; and
(2) After the sales of commercial housing, the purchasers as proprietors shall deposit 2% of the cost price per square meter of floor space into the special bank account before they undertake the registration of housing ownership.
The cost price per square meter of floor space for commercial housing shall consist of construction costs and construction fees for the additional facilities of residential quarters and shall be determined by two standards;, housing equipped with elevators and housing not equipped with elevators, and the specific standards shall be regularly released by the competent administrative department for real estate of this Municipality together with the administrative departments for construction and pricing.
第八条 商品住房(含经济适用住房,下同)的首次维修资金,由业主缴存。
业主缴存首次维修资金,分别按照下列规定执行:
(一)商品住房销售前,建设单位作为业主,应当按每平方米建筑面积成本价的2%,在办理商品住房销售备案手续前缴存至专户银行;
(二)商品住房销售后,购房人作为业主,应当按每平方米建筑面积成本价的2%,在办理房屋权属登记前缴存至专户银行。
商品住房每平方米建筑面积成本价,由建安成本和小区配套设施建设费两部分构成,并按配备电梯和未配备电梯两种标准确定,具体标准由市房产行政主管部门会同建设、物价部门定期发布。
Article 9 Housing-selling units and proprietors shall jointly deposit the maintenance fund for purchased public housings.
The housing-selling units and proprietors shall deposit the initial maintenance fund in accordance with the following provisions:
(1) The housing-selling units shall, within fifteen days from the date of depositing reformed housing selling price into the special housing fund of their organization, deposit 25% of the price of the housings not equipped with elevators or 30% of the price of the housings equipped with elevators into the special bank account; and
(2) The proprietors shall deposit 2% of the average cost price of reformed housing per square meter of floor space into the special bank account before they undertake the registration of the housing ownership.
第九条 已购公有住房的维修资金,由售房单位和业主共同缴存。
售房单位和业主缴存首次维修资金,分别按照下列规定执行:
(一)售房单位对未配备电梯的住房按售房款的25%、配备电梯的住房按售房款的30%,在房改售房款存入单位住房资金专户之日起15日内缴存至专户银行;
(二)业主按每平方米建筑面积房改平均成本价的2%,在办理房屋权属登记前缴存至专户银行。
Article 10 The proprietors of commercial housing whose maintenance fund has not been established prior to the implementation of these Measures shall, from the date of implementation of these Measures, deposit the initial maintenance fund into the special bank account annually at a standard of 5 Yuan per square meter of floor space for four consecutive years.
The proprietors of the purchased public housing whose maintenance fund has not been established before the implementation of these Measures shall, from the date of implementation of these Measures, deposit the initial maintenance fund into the special bank account annually at 0.5% of the average cost price of reformed housing per square meter of floor space for four consecutive years.
Anyone who fails to deposit the maintenance fund in accordance with the provisions of the first or second paragraph of this Article upon expiry of the time limit shall pay overdue fines at 1% of the maintenance fund per day from the date of expiration.
If the proprietors' conference has otherwise made decisions in paragraphs one and two of this Article, such decisions shall be implemented.
第十条 本办法实施前未建立维修资金的商品住房,业主应当自本办法实施之日起,每年按建筑面积每平方米5元的标准,连续四年将首次维修资金缴存至专户银行。
本办法实施前业主未缴存维修资金的已购公有住房,业主应当自本办法实施之日起,每年按每平方米建筑面积房改平均成本价的0.5%,连续四年将首次维修资金缴存至专户银行。
逾期未按照本条一、二款规定缴存维修资金的,应当自逾期之日起,按日增缴应缴维修资金1‰的滞纳金。
业主大会对本条一、二款规定另有决定的,按照业主大会决定执行。
Article 11 When the balance of the maintenance fund in household account is less than 30% of the initial maintenance fund, the proprietor of this housing shall raise the maintenance fund.
The scheme for raising the maintenance fund shall be drafted by the proprietors' committee and implemented by the proprietors' committee after being submitted to the proprietors' conference for decision.
第十一条 分户账中的维修资金余额不足首次维修资金的30%时,该户房屋的业主应当续筹维修资金。
维修资金的续筹方案由业主委员会拟订,提交业主大会决定后,由业主委员会具体实施。
Article 12 The income gained by proprietors from making use of the shared parts, facilities or equipments of housing to engage in operation shall, after deduction of the necessary costs, be mainly used to supplement the maintenance fund, which shall be specially used for the maintenance, renewal and transformation of the shared parts, facilities or equipment of the housings.
The incomes gained by proprietors from making use of the shared parts, facilities or equipments to engage in operation within a realty management area shall be mainly used to supplement the maintenance fund, which shall be specially used for the maintenance, renewal and transformation of the shared parts, facilities or equipments within a realty management area.
第十二条 利用房屋本体的共用部位、共用设施设备进行经营的,业主所得收益扣除必要管理成本后,应当主要用于补充维修资金,专项用于该幢房屋共用部位、共用设施设备的维修、更新、改造。
利用物业管理区域共用部位、共用设施设备进行经营的,业主所得收益应当主要用于补充维修资金,专项用于物业管理区域共用部位、共用设施设备的维修、更新、改造。
Article 13 When the housing ownership is transferred or changed, the remaining fund in the household account of housing maintenance fund shall be simultaneously transferred or changed along with the housing ownership, and the balance of maintenance fund deposited by the original proprietor shall be paid by the transferee instead of being withdrawn from the original proprietor's account unless both Parties have otherwise agreed upon.
第十三条 房屋权属转移、变更时,该房屋维修资金分户账中结余的资金随房屋权属同时转移、变更,原业主缴存维修资金的余额不予提取,由受让人向原业主支付,但双方另有约定的除外。
Chapter 3: Management of Maintenance Fund
第三章 维修资金的管理
Article 14 The competent municipal administrative department for real estate shall conclude a commission contract with commercial bank, open a special account for maintenance fund and may entrust the bank to go through the formalities of establishment, deposit and settlement of the maintenance fund account.
The itemized account shall be established in the special account for maintenance fund, which shall be opened for one realty management area. In the account of each realty management area, an itemized account shall be established for each building and household account shall be established along with the flat number for each flat, and recording information such as the deposit, use and settlement of household account. The initial maintenance fund deposited and withdrawn by project owners and selling organizations of public housing as well as incomes gained by the proprietors shall be separately listed into account based on realty management area.
From the date when the maintenance fund is deposited in the special account for maintenance fund, the interests shall be settled to the special account each year in accordance with relevant provisions of the People's Bank of China.
第十四条 市房产行政主管部门应当与商业银行签订委托合同,开立维修资金专户,并可委托专户银行办理维修资金账户的设立、缴存、结算等手续。
在维修资金专户中,应当建立维修资金明细账,以一个物业管理区域为单位立账。每一个物业管理区域的账户中,应当按每幢房屋立账,并以房屋户门号设分户帐,记载分户账的缴存、使用、结存等情况。建设单位、公有住房售房单位缴存和提取的首次维修资金及业主所得收益应当按物业管理区域或者房屋单独列账。
维修资金自存入维修资金专户之日起,每年按中国人民银行的有关规定结息到户。
Article 15 If the proprietors' conference has not been established, the competent municipal administrative department for real estate on behalf of the conference shall uniformly manage the initial maintenance fund. After the establishment of the proprietors' conference, its proprietors' committee shall, with present of such relevant materials as the documents for record of the establishment of the proprietors' committee and the proprietors' register and realty service contract, approach the special account bank to open a maintenance fund account of the realty management area where it is located.
After the maintenance fund account is opened, its management shall be undertaken by the proprietors' committee or may also be entrusted with a realty management organization or an intermediary institution.
The maintenance fund account shall be subject to uniform supervision by the competent municipal administrative department for real estate.
第十五条 业主大会未成立的,首次维修资金由市房产行政主管部门统一代管。业主大会成立后,其业主委员会应当持业主委员会成立备案文件、业主名册和物业服务合同等有关资料到专户银行设立所在物业管理区域的维修资金账户。
维修资金账户设立后的账目管理,由业主委员会负责,也可委托物业管理单位或者中介机构管理。
维修资金账户,应当接受市房产行政主管部门的统一监管。
Article 16 After the proprietors' committee has opened the maintenance fund account, it shall make a written notification to the competent municipal administrative department for real estate, which shall transfer the principal and interests of the initial maintenance fund of the realty management area where the proprietors' committee is located to the maintenance fund account opened by the proprietors' committee.
第十六条 业主委员会设立维修资金账户后,应当书面告知市房产行政主管部门,由市房产行政主管部门将代管的该业主委员会所在物业管理区域的首次维修资金的本金和利息,划转至该业主委员会设立的维修资金账户。
Article 17 Where any of the following circumstances occurs, the proprietors' committee shall, accompanied with the relevant materials, go through relevant formalities with the special account bank for altering the maintenance fund account:
(1) The realty management area or name is changed;
(2) The property management organization is replaced; or
(3) The director or vice director of the proprietors' committee is changed.
第十七条 有下列情形之一的,业主委员会应当持相关手续到专户银行办理维修资金账户的有关变更手续:
(一)物业管理区域、名称发生变动的;
(二)物业管理单位发生更换的;
(三)业主委员会主任、副主任发生更换的。
Article 18 If the housing ownership is transferred, the transferee shall, accompanied with materials such as housing ownership certificate and identity card, go through the formality with the special account bank for altering the name of household account.
第十八条 房屋权属发生转移的,受让人应当持房屋权属证书、身份证等材料到专户银行办理分户账更名手续。
Article 19 If a housing is lost due to demolition, natural disasters or other reasons, the proprietor shall, go to the special account bank to withdraw the capital balance of household account and itemized account and go through the formalities for canceling relevant accounts, accompanied with relevant certificates issued by the competent administrative department for real estate of this Municipality or by the proprietors' committee,.
The capital balance of itemized account shall be withdrawn in proportion to the housing floor space originally owned by its co-owners.
第十九条 因拆迁、自然灾害或者其他原因致使房屋灭失的,由业主持市房产行政主管部门的有关证明、业主委员会的证明到专户银行提取其维修资金分户账和单独帐目中的资金余额,并办理相关账户注销手续。
单独账目的资金余额由共同所有人按照原拥有住房建筑面积的比例分别提取。
Article 20 The proprietors' committee or its entrusted realty management organization or intermediary institution shall check up the maintenance fund account once a quarter with its special account bank an make public the following information to all proprietors once for half a year:
(1) deposit and use of maintenance fund as well as the settled balance;
(2) project and cost related to housing maintenance, renewal and transformation and household sharing costs; and
(3) other information related to the use and management of maintenance fund.
If any proprietor objects to the maintenance fund account released, such proprietor may ask the proprietors' committee to make reconsideration.
第二十条 业主委员会或者其委托的物业管理单位、中介机构应当每季度与专户银行核对一次维修资金账目,并将下列情况每半年向全体业主公布一次:
(一)维修资金缴存、使用和结余的金额;
(二)发生住房维修、更新、改造的项目和费用以及按户分摊情况;
(三)维修资金使用和管理的其他有关情况。
业主对公布的维修资金账目有异议的,可要求业主委员会复核。
Article 21 The special account bank shall send a bank statement of maintenance fund account to the proprietors' committee every quarter. If the proprietors' committee objects to the changes of the maintenance fund account, it may apply to the special account bank for reconsideration.
The special account bank shall establish an inquiry system for maintenance fund so as to receive proprietor's inquiry on his or her individual household account.
第二十一条 专户银行应当每季度向业主委员会发送维修资金账户对账单。业主委员会对维修资金账户变化情况有异议的,可向专户银行申请复核。
专户银行应当建立维修资金查询制度,接受业主对个人分户账的查询。
Article 22 The financial management and accounting of maintenance fund shall abide by the relevant financial regulations and be subject to the supervision by the financial department according to law.
第二十二条 维修资金的财务管理和会计核算应当执行财政方面的有关规定,并依法接受财政部门的财政监督。
Article 23 The organizations managing maintenance fund on behalf of proprietors' committee shall be subject to audit supervision by the audit department.
第二十三条 维修资金的代管单位,应当依法接受审计部门的审计监督。
Chapter 4: Use of Maintenance Fund
第四章 维修资金的使用
Article 24 Maintenance Fund shall be specially used for the maintenance, renewal and transformation of the shared parts, facilities and equipments of housing after the expiration of their guarantee period, and no organization or individual may misappropriate the fund for other purposes.
The maintenance fund is forbidden to be used for the daily operation and maintenance of the shared parts, facilities and equipments of housing, which are within the scope of realty service expenditure according to law.
If the shared parts, facilities or equipments of housing are intentionally damaged, the expenses of maintenance and renovation shall be borne by the person who is responsible for the damage.
第二十四条 维修资金应当专项用于住房共用部位、共用设施设备保修期满后的维修、更新和改造,任何单位和个人不得挪作他用。
依法属于物业服务费用支出范围的住房共用部位、共用设施设备的日常运行、维护,不得使用维修资金。
住房共用部位、共用设施设备属于人为损坏的,其维修、更新费用应当由责任人承担。
Article 25 The use share of maintenance fund shall follow the principle that anyone who benefits from the maintenance fund shall bear the expenses and be listed into expenditure in accordance with the following provisions:
(1) If it is used for the shared parts, facilities and equipments within a realty management area, all proprietors shall share the expenses in proportion to their respective floor space;
(2) If it is used for the shared parts, facilities and equipments of the housing, the housing proprietors shall share the expenses in proportion to their respective floor space; and
(3) If it is used for the shared parts, facilities and equipments of two or more flats, the relevant proprietors shall share the expenses in proportion to their respective floor space.
Where an independent account is opened and the maintenance fund is used, certain proportion of the maintenance fund may be listed into expenditure in certain proportion from the independent account, and the rest shall be shared by all proprietors or relevant proprietors in accordance with the preceding paragraph of this Article.
第二十五条 维修资金使用的分摊,应当遵循谁受益谁负担的原则,按照下列规定列支:
(一)用于物业管理区域共用部位、共用设施设备的,由全体业主按所拥有建筑面积的比例分摊;
(二)用于房屋本体共用部位、共用设施设备的,由该房屋业主按所拥有建筑面积的比例分摊;
(三)用于二户或者二户以上住房共用部位、共用设施设备的,由相关业主按所拥有建筑面积的比例分摊。
设立单独账目的,使用维修资金时可先从单独账目中列支一定比例,其余部分由全体业主或者相关业主按照本条前款规定共同分摊。
Article 26 If the maintenance funds are to be used before the proprietors' conference is established, the realty management organizations or relevant proprietors shall come up with a scheme for using maintenance fund according to maintenance item, and after being adopted by more than two thirds of the voting rights held by all proprietors or relevant proprietors and submitted for the record to the competent administrative department for real estate of this Municipality, the special account bank shall transfer the fund needed to the realty management organizations or maintenance organizations.
When the maintenance fund is needed to be used after the establishment of the proprietors' conference, the realty management organizations shall come up with a scheme for using maintenance fund, and after being adopted by the proprietors' conference and submitted for the record to the competent municipal administrative department for real estate, the special account bank shall transfer the fund needed to the realty management organizations.
The competent municipal administrative department for real estate shall separately formulate the conditions and procedures for using the maintenance fund.
第二十六条 业主大会成立前需要使用维修资金的,由物业管理单位或者相关业主根据维修项目提出维修资金使用方案,经全体业主或者相关业主所持投票权三分之二以上通过,并报市房产行政主管部门备案后,由专户银行将所需资金划转到物业管理单位或者维修单位。
业主大会成立后需要使用维修资金的,由物业管理单位提出维修资金使用方案,经业主大会依法通过,并报市房产行政主管部门备案后,由专户银行将所需资金划转到物业管理单位。
维修资金的使用条件、程序由市房产行政主管部门另行制定。
Article 27 After being identified by relevant institutions, if any hidden safety problem exists in the shared parts, facilities or equipments, or if the shared parts, facilities or equipments have to be maintained in accordance with the relevant technical specifications, the relevant proprietors or the proprietors' committee shall make maintenance without delay; in case of failure to do so, the realty management organizations shall report it to the competent municipal administrative department for real estate which shall order the realty management organizations to make maintenance, and the expenses incurred shall be listed in the household maintenance fund account of relevant proprietors.
The realty management organizations shall make public the identification results and technical specifications to the relevant proprietors or all proprietors.
第二十七条 经有关机构鉴定,住房共用部位、共用设施设备存在安全隐患,或者按照有关技术规范要求必须维修住房共用部位、共用设施设备的,有关业主或者业主委员会应当及时维修;不及时维修的,物业管理单位应当向市房产行政主管部门报告,由市房产行政主管部门责成物业管理单位进行维修,费用从相关业主维修资金分户账中列支。
物业管理单位应当将鉴定结果和技术规范向有关业主或者全体业主公布。
Chapter 5: Legal Liability
第五章 法律责任
Article 28 If any project owner or selling organization of public housing fails to deposit the initial maintenance fund in accordance with the provisions of Article 8 and Article 9 of these Measures, the competent municipal administrative department for real estate shall order it to make corrections within a specified time limit and may impose a fine of not less than 10,000 Yuan but not more than 50,000 Yuan.
第二十八条 建设单位、公有住房售房单位未按照本办法第八条、第九条规定缴存首次维修资金的,由市房产行政主管部门责令其限期改正,并可处1万元以上5万元以下的罚款。
Article 29 Where anyone misappropriates the maintenance fund in violation of the provisions of Article 24 of these Measures, the competent municipal administrative department for real estate shall recover the misappropriated maintenance fund, issue a warning, confiscate the illegal gains and may impose a fine of not less than two times of the misappropriated fund; if a realty management organization misappropriates the maintenance fund with serious circumstances, its qualification certificate shall be revoked by the department issuing the qualification certificate; if a crime is made out, the persons directly in charge and other directly responsible persons shall be investigated for criminal liabilities according to law.
第二十九条 违反本办法第二十四条规定挪用维修资金的,由市房产行政主管部门追回挪用的维修资金,给予警告,没收违法所得,可以并处挪用数额2倍以下的罚款;物业管理单位挪用维修资金,情节严重的,由颁发资质证书的部门吊销资质证书;构成犯罪的,依法追究直接负责的主管人员和其他直接责任人员的刑事责任。
Article 30 The functionaries of the competent municipal administrative department for real estate shall perform their functions and duties according to law, and they shall not neglect their duties, abuse their powers or engage in illegalities for personal gains or by fraudulent means.
Any functionary whoever violates the provisions of the preceding paragraph of this Article shall be imposed with administrative sanction by the organization where he or she works or the competent department at a higher level; if a crime is made out, criminal liabilities shall be investigated for according to the law.
第三十条 市房产行政主管部门工作人员应当依法履行职责,不得玩忽职守、滥用职权、徇私舞弊。
违反本条前款规定的,由其所在单位或者上级主管部门给予行政处分;构成犯罪的,依法追究刑事责任。
Chapter 6: Supplementary Provisions
第六章 附则
Article 31 The competent municipal administrative department for real estate shall set up a complaint acceptance system to accept complaints about conducts against these Measures from the proprietors, the proprietors' committee and realty management organizations.
第三十一条 市房产行政主管部门应当建立投诉受理制度,接受业主、业主委员会和物业管理单位对违反本办法行为的投诉。
Article 32 When any dispute arising due to the depositing and use of maintenance fund, the interested parties may solve the dispute through consultations or bring a lawsuit to the people's court according to the law.
第三十二条 因维修资金的缴存、使用等发生纠纷时,当事人可以自行协商解决,也可依法向人民法院提起诉讼。
Article 33 Before the implementation of these Measures, if the maintenance fund has been turned over in accordance with the relevant policies, the fund shall be uniformly deposited in a special account bank, and its management and use shall be conducted in accordance with relevant provisions of these Measures.
第三十三条 本办法实施前,已按有关政策规定交纳维修资金的,应当统一缴存至专户银行,其管理与使用依照本办法的有关规定执行。
Article 34 The deposit, use and management of maintenance fund of a county (or city) shall refer to these Measures.
第三十四条 县(市)维修资金的缴存、使用和管理,可参照本办法执行。
Article 35 These Measures shall become effective from February 15, 2006.
第三十五条 本办法自2006年2月15日起施行。
