  Article 1    In order to strengthen and standardize the administration of Central Funds for Development of Foreign Trade, to exercise macro-guidance of funds for subsidizing interest of loans, to promote enterprises' technological renovation and transformation as well as products research and development, to upgrade industries, and to optimize the structure of products, these Measures are hereby enacted in accordance with the Foreign Trade Law of the People's Republic of China.

       第一条  为加强和规范中央外贸发展基金的管理，发挥贴息资金的宏观导向作用，促进企业的技术更新改造和产品研究开发，推动产业升级，优化产品结构，根据《中华人民共和国对外贸易法》等有关规定，制定本办法。

  Article 2    "Funds for subsidizing interest of loans for projects of technological renovation and transformation" as referred to herein means the appropriate subsidies allocated by the State for interest of medium to short-term loans (excluding fluid capital loans) used for enterprises' projects of technological renovation and transformation.

       第二条  本办法所称技术更新改造项目贷款贴息是指国家对企业用于技术更新改造项目的中短期贷款(不含流动资金贷款)利息给予的适当资助。

  Article 3    The principles to allocate funds for subsidizing interest of loans are:

       第三条  安排贴息资金的原则是：

(1) To be in favor of technological renovation and restructuring of products, and to strengthen the products' competitive power;

    (一)有利于技术创新和产品结构的调整，增强产品竞争力；

(2) To be in favor of economizing energy, reducing consumption, and improving enterprises' technical arrangement level;

    (二)有利于节能降耗，提高企业技术装备水平；

(3) To be in favor of research and development of products of hi-tech enterprises, and technological renovation and transformation for industries with the internationally comparative superiority; and

    (三)有利于高新技术企业产品的研究开发和在国际上具有比较优势产业的技术更新改造；

(4) To be in favor of stimulating and boosting up enterprises' enthusiasm for technological renovation and transformation as well as products research and development.

    (四)有利于激发、调动企业进行技术更新改造和产品研究开发的积极性。

  Article 4    Projects for which funds for subsidizing interest of loans are allocated are:

       第四条  安排贴息资金的项目范围是：

(1) Projects of hi-tech products research and development;

    (一)高新技术产品研究开发项目；

(2) Projects economizing energy, reducing consumption, reducing pollution, and promoting environmental protection;

    (二)节能降耗，减少污染、促进环境保护的项目；

(3) Projects improving products' quality and grade, increasing varieties and specifications of products, and enhancing the market competitive power; and

    (三)提高产品质量和档次、增加品种规格、增强市场竞争力的项目；

(4) Projects promoting the structural adjustment of products.

    (四)推动产品结构调整的项目。

  Article 5    Projects for which enterprises apply for interest discount shall meet the following conditions:

       第五条  企业申请贴息的项目应符合以下条件：

(1) Where they shall belong to projects as specified in Article 4 herein;

    (一)属于本办法第四条规定范围内的项目；

(2) Where loans for projects have been approved by commercial banks or policy banks of this country, and enterprises have singed the loan contracts with the loaning banks;

    (二)项目贷款经国家商业银行或政策性银行批准同意，企业与承贷银行已签订贷款合同；

(3) Where projects, after being completed, shall pass checkup for acceptance of them organized by the authorities in charge of examination and approval of project establishment or in charge of project establishment in accordance with the relevant provisions;

    (三)项目竣工后，按规定经项目立项审批部门或项目立项主管部门验收合格；

(4) Where projects shall be completed within the appropriate time limits;

    (四)项目在合理工期内竣工；

(5) Where the actual budgets of investment in projects do not exceed 20% of the budgets; and

    (五)项目投资决算不超过概算的20%；

(6) Where projects have not been under other planning for subsidizing interest of loans.

    (六)项目未列入其他贴息计划。

  Article 6    An enterprise shall submit the following materials when applying for funds for subsidizing interest of loans to a project:

       第六条  企业申请贴息的项目应提供以下材料：

(1) Application Form for Funds for Subsidizing Interest of Loans for Projects of Technological Renovation and Transformation (See Appendix I)

    (一)《技术更新改造项目贷款贴息资金申请表》；

(2) The feasibility research report, and the official reply to such report made by the authority in charge of examination and approval of project establishment, or the reference permission for the project by the authority in charge of project establishment;

    (二)项目可行性研究报告及项目立项申批部门对项目可行性研究报告的批复文件或项目立项主管部门对项目的备案许可；

(3) The report on the checkup for acceptance of the completed project, and the official reply to such report made by the authority in charge of examination and approval of project establishment, or by the authority in charge of project establishment; and

    (三)项目竣工验收报告及项目立项审批部门或项目立项主管部门对项目竣工验收报告的批复文件；

(4) The loan contract for the project issued by the loaning bank, and the debit note as well as interest settlement list hereto.

    (四)承贷银行出具的项目贷款合同及合同项下的借据和利息结算清单。

  Article 7    The interest discount rate for a project shall not exceed the bank loan rate for this project during the current period, and the time limit for enjoying interest discount shall not exceed three years. No discount shall be given to overdue interest of loans, overdue interest of loans, added interest, and default interest incurred by borrowers' default of loans to banks.

       第七条  贷款项目的贴息率最高不超过该项目当期的银行贷款利率，贴息期限最多不超过3年。对借款单位逾期不归还银行贷款产生的逾期贷款利息、加息、罚息，不予贴息。

  Article 8    Departments (committees or bureaus) of foreign trade and economic cooperation of all provinces, autonomous regions, municipalities directly under the Central People's Government, and municipalities separately listed on the State Planning shall jointly examine and collect projects for which the locally administered enterprises apply for interest discount, and declare them subsequently. Enterprises administered by the Central People's Government shall directly declare such projects.

       第八条  各省、自治区、直辖市及计划单列市外经贸厅(委、局)和财政厅(局)对地方管理企业申请贴息的项目进行联合审核汇总后审报；中央管理企业直接申报。

Documents of projects under application for interest discount shall be submitted to the Ministry of Foreign Trade and Economic Cooperation and the Ministry of Finance before 1st September each year. These documents include:

    申报贴息的项目文件应于每年9月1日前提交外经贸部和财政部。包括：

(1) Application report for funds for subsidizing interest of loans;

    (一)贴息资金申请报告；

(2) Summary Table of Application Forms for Funds for Subsidizing Interest of Loans for Projects of Technological Renovation and Transformation (See Appendix II); and

    (二)《技术更新改造项目贷款贴息资金申请汇总表》；

(3) The relevant materials as specified in Article 6 herein.

    (三)本办法第六条规定的有关材料。

  Article 9    The Ministry of Foreign Trade and Economic Cooperation and the Ministry of Finance shall organize experts to allocate funds for subsidizing interest of loans after examining projects under application for interest discount. The Ministry of Finance shall directly allocate funds for subsidizing interest of loans to enterprises administered by the Central People's Government. The Ministry of Finance shall allocate such funds for the locally administered enterprises via the local financial departments. Such funds shall be allocated to the project undertaking units before 31st December each year. Enterprises shall conduct accounting according to the relevant provisions of the State upon the receipt of funds for subsidizing interest of loans.

       第九条  外经贸部和财政部应组织专家对申请贴息的项目进行审核后下达贴息资金。中央管理企业的贴息资金由财政部直接拨付；地方管理企业的贴息资金由财政部拨付地方财政部门并通过其转拨。每年12月31日前应将贴息资金下达到项目承担单位。企业收到贴息资金后，应按照国家有关规定进行财务处理。

  Article 10    The Ministry of Foreign Trade and Economic Cooperation shall be responsible for planning, organizing, implementing, and administering technological renovation and transformation projects for which the loans are intended. The Ministry of Finance shall be responsible for examining, allocating, supervising, and inspecting funds for subsidizing interest of loans.

       第十条  外经贸部负责技术更新改造贷款项目的规划、组织、实施和管理工作。财政部负责贴息资金的审核、拨付、监督检查工作。

The Ministry of Foreign Trade and Economic Cooperation and the Ministry of Finance shall be responsible for the follow-up of technological renovation and transformation projects for which the loans are intended.

    财政部和外经贸部共同负责技术更新改造贷款项目的追踪问效工作。

  Article 11    Departments (committees or bureaus) of foreign trade and economic cooperation and departments (bureaus) of finance of all provinces, autonomous regions, municipalities directly under the Central People's Government, and municipalities separately listed on the State Planning shall supervise and inspect the implementation of technological renovation and transformation projects for which the loans are intended as well as realization of funds for subsidizing interest of loans at regular intervals, shall ensure that funds for subsidizing interest of loans be allocated in time, and shall be responsible for jointly submitting the annual report on the use of such funds of the next fiscal year to the Ministry of Foreign Trade and Economic Cooperation and the Ministry of Finance before 1st March each year. The report shall contain the scientific analysis and assessment of the allocation and use of funds for subsidizing interest of loans, comparison of projects' prospective benefits with actual benefits, etc.

       第十一条  各省、自治区、直辖市及计划单列市外经贸厅(委、局)和财政厅(局)应定期对技术更新改造贷款项目的执行和贴息资金的落实情况进行监督、检查，确保贴息资金及时到位，并负责于每年3月1日以前向外经贸部和财政部联合报送上一年度贴息资金的年度使用报告。报告应包括贴息资金的拨付、使用、贷款项目预期效益与实际效益比较等情况的科学分析和评价。

  Article 12    The following acts committed by enterprises that apply for or obtain funds for subsidizing interest of loans are unlawful acts:

       第十二条  申请或取得贴息资金企业有以下情形之一的，属于违法行为：

(1) Changing the purposes of loans without authorization, or embezzling them for other purposes;

    (一)擅自改变贷款用途、挪作他用；

(2) Swindling funds for subsidizing interest of loans by any illegal means;

    (二)采取各种不正当手段骗取贷款贴息资金；

(3) Embezzling or withholding funds for subsidizing interest of loans; and

    (三)挪用或截留侵占贴息资金；

(4) Refusing the relevant authorities' supervision or inspection according to law, or failing to cooperate with the relevant authorities in supervision or inspection according to law.

    (四)拒绝有关部门依法监督、检查，或对有关部门依法监督、检查不予配合。

  Article 13    Acts in violation of these Measures shall be handled according to the following provisions according to the seriousness of circumstances:

       第十三条  对违反本办法的违法行为，视情节轻重，依法进行以下处理：

(1) Whoever commits an act in violation of these Measures shall be warned and ordered to make corrections within a specified time limit;

    (一)警告并责令限期改正；

(2) Whoever commits an unlawful act in the non-business operation shall be imposed a fine of not more than RMB 1,000. Whoever commits an unlawful act in the business operation shall be imposed a fine of not more than RMB 10,000 if there is no illegal gain, and shall be imposed a fine of not more than RMB 30,000 if there is any illegal gain;

    (二)对非经营活动中的违法行为，处以1000元以下的罚款；对经营活动中的违法行为，没有违法所得的，处以10000元以下的罚款，有违法所得的，处以30000元以下罚款；

(3) Any offender shall have the obtained funds for subsidizing interest of loans recovered; and

    (三)收回已取得的贴息资金；

(4) The next higher administrative department in charge or the relevant authority shall impose administrative sanctions on the directly responsible personnel; whoever violates the Criminal Lawshall be transferred to the judicial organization for punishment.

    (四)上级行政机关或者有关部门对直接责任人员给予行政处分；触犯刑律的，移交司法机关处理。

  Article 14    Any enterprise concerned, if refusing to comply with an administrative punishment decision, may apply for an administrative review or file an administrative lawsuit according to law.

       第十四条  有关企业对行政处罚决定不服的，可以依法申请行政复议或提起行政诉讼。

  Article 15    The Ministry of Foreign Trade and Economic Cooperation may formulate the detailed implementing rules and flow scheme on the subsidizing interest of loans for projects of technological renovation and transformation according to these Measures in the light of characteristics of different trades.

       第十五条  外经贸部可依据本办法按照行业特点分别制定技术更新改造贷款项目贴息具体实施规则和流程。

  Article 16    The power of interpretation of these Measures shall be vested in the Ministry of Foreign Trade and Economic Cooperation and the Ministry of Finance.

       第十六条  本办法由外经贸部和财政部负责解释。

  Article 17    These Measures shall take effect 30 days after the promulgation date.

       第十七条  本办法自发布之日起30日后施行。
