Departments (bureaus or committees) of transport of all provinces, autonomous regions and municipalities directly under the Central Government, the Bureau of Transport of the Xinjiang Production and Construction Corps, the Tianjin Municipal Highway Administration, and the Shanghai Municipal Engineering Administration Bureau, 

With a view to streamlining examination and approval procedures, and improving the efficiency of administrative operations, in accordance with the Decision of the State Council on the Fourth Batch of Cancelled and Adjusted Administrative Examination and Approval Items (Guo Fa [2007] No. 33), the Ministry of Transport has decided to reform the construction bidding administration system for highway construction projects funded by loans of international financial organizations or foreign governments. Relevant issues are hereby notified as follows:

    各省、自治区、直辖市、新疆生产建设兵团交通厅(局、委),天津市市政公路管理局,上海市市政工程管理局:

    为简化审批程序,提高行政效率,根据《国务院关于第四批取消和调整行政审批项目的决定》(国发〔2007〕33号)的要求,部决定改革使用国际金融组织或者外国政府贷款的公路建设项目施工招标管理制度,现将有关事项通知如下:

1. The record-filing system shall be adopted in replacement of the examination and approval system for construction bidding operations for highway construction projects funded by loans of international financial organizations or foreign governments. Specifically, the project construction bidding documents, results of pre-examination of qualifications and bid evaluation reports of highway construction projects included in the National Highway Network and other key highway construction projects designated by the Ministry of Transport shall be submitted to the Ministry of Transport for record-filing; and the said documents, results and reports of other highway construction projects shall be submitted for record-filing to competent transport departments of local people's governments at or above the county level according to project management authorities. Record-filing administration shall be carried out in accordance with the provisions set out in the Administrative Measures for Bidding and Bids of Highway Engineering Construction (Order No. 7 of the Ministry of Transport).

2. Bid inviters shall strengthen communication and coordination with lenders and/or fund-providers. During the preparation of bidding documents, the bid inviter concerned shall take effective measures to prevent bidders from winning bids at unreasonably low prices or trading bids between and among themselves; during contract negotiations and when the bid winner enters the construction site, the bid inviter concerned shall ensure that sufficient personnel and equipment have been assigned for project construction and that the bid winner is capable of fulfilling the contract; during the construction process, the bid inviter shall enhance inspections on contract performance to ensure that the construction project be completed as agreed in the contract. Where a candidate bid winner gives up its bid-winning qualifications without justifications or commits other acts disturbing the market order, such malpractices shall be entered as bad credit records into the bidder's files in accordance with relevant provisions set out in the Notice on Printing and Distributing the Guiding Opinions on Establishing the Credit System for the Highway Construction Market (Jiao Gong Lu Fa [2006] No. 683).

3. Competent transport departments of local people's governments at or above the county level shall step up administrative regulation over activities of bidding and bids as well as construction operations vis-à-vis highway construction projects funded by loans of international financial organizations or foreign governments. They shall also diligently perform regulatory duties, regulate market order, and stop and correct activities of bidding and bids that are not in compliance with relevant State laws, regulations and/or rules, so as to ensure project quality.

       一、对使用国际金融组织或者外国政府贷款的公路建设项目施工招标由审批制改为备案制。其中,属国家高速公路网和交通部确定的其他重点公路建设项目,其工程施工的招标文件、资格预审结果和评标报告报交通部备案;其他公路建设项目工程施工的招标文件、资格预审结果和评标报告按照项目管理权限报县级以上地方人民政府交通主管部门备案。备案管理工作按照《公路工程施工招标投标管理办法》(交通部令2006年第7号)的规定执行。

    二、招标人应当加强与贷款方或者资金提供方的沟通和协调。在编制招标文件时,应当制定有效措施,防范低价抢标和让标行为;在合同谈判和中标人进场时,要具体落实投入项目施工的人员和设备,保证其履行合同的能力;在项目实施过程中,要加强履约检查,确保按合同约定完成施工任务。对中标候选人无故放弃中标资格等扰乱市场秩序的,应按照《关于印发建立公路建设市场信用体系指导意见的通知》(交公路发〔2006〕683号)的规定记入不良信用记录。

    三、县级以上地方人民政府交通主管部门应当加强对使用国际金融组织或者外国政府贷款的公路建设项目施工招投标活动和工程实施的行政监管,认真履行监管职责,规范市场秩序,对不符合国家法律、法规及有关规章规定的招投标活动应及时制止和纠正,确保工程质量。
