Chapter 1: General Provisions

第一章  总则

  Article 1    These Measures are formulated in accordance with the Law of the People’s Republic of China on Renewable Energy and the Notice of the Ministry of Finance, the National Development and Reform Commission and the National Energy Administration on Issuing and Distributing the "Interim Administrative Measures for the Collection and Use of the Renewable Energy Development Fund" (Cai Zong [2011] No. 115).

       第一条  根据《中华人民共和国可再生能源法》和《财政部国家发展改革委国家能源局关于印发<可再生能源发展基金征收使用管理暂行办法>的通知》(财综〔2011〕115号),制定本办法。

  Article 2    For the purposes of these Measures, renewable energy power generation refers to wind power generation, biomass power generation including power generation by direct combustion and gasification of agro-forestry wastes, by waste incineration and landfill gas, or by biogas, solar power generation, geothermal power generation, ocean power generation, etc.

       第二条  本办法所称可再生能源发电是指风力发电、生物质能发电（包括农林废弃物直接燃烧和气化发电、垃圾焚烧和垃圾填埋气发电、沼气发电）、太阳能发电、地热能发电和海洋能发电等。

Chapter 2: Determination of Projects to be Subsidized

第二章  补助项目确认

  Article 3    Projects for which an application for subsidy is made shall satisfy the following conditions:

(1) Projects are covered in the scope of subsidy provided for in the Notice of the Ministry of Finance, the National Development and Reform Commission and the National Energy Administration on Issuing and Distributing the "Interim Administrative Measures for the Collection and Use of the Renewable Energy Development Fund";

(2) Projects have been approved, verified or filed for the record in accordance with relevant provisions of the State, and confirmed by the National Energy Administration through examination and verification. Specific measures for such examination and verification shall be formulated separately by the National Energy Administration; and

(3) Projects comply with the State policies for prices of renewable energy, and the competent price departments have given an official, written reply regarding the on-grid prices thereof upon examination and verification.

       第三条  申请补助的项目必须符合以下条件:

    (一)属于《财政部国家发展改革委国家能源局关于印发<可再生能源发展基金征收使用管理暂行办法>的通知》规定的补助范围。

    (二)按照国家有关规定已完成审批、核准或备案,且已经过国家能源局审核确认。具体审核确认办法由国家能源局另行制定。

    (三)符合国家可再生能源价格政策,上网电价已经价格主管部门审核批复。

  Article 4    With regard to projects that comply with the provisions of Article 3 of these Measures, enterprises of renewable energy power generation, project sponsors of grid connection works for renewable energy power generation, and project sponsors of public independent renewable energy electrical power systems shall apply, under the territorial principle (see forms in Appendix 1) to the departments at the province level in charge of finance, price, and energy for subsidy at the places where the said entities are located. Such departments shall, after preliminary examination, jointly report the same to the Ministry of Finance, the National Development and Reform Commission, and the National Energy Administration.

       第四条  符合本办法第三条规定的项目,可再生能源发电企业、可再生能源发电接网工程项目单位、公共可再生能源独立电力系统项目单位,按属地原则向所在地省级财政、价格、能源主管部门提出补助申请(格式见附1)。省级财政、价格、能源主管部门初审后联合上报财政部、国家发展改革委、国家能源局。

  Article 5    The Ministry of Finance, the National Development and Reform Commission and the National Energy Administration shall examine and verify the materials submitted by the local departments, and incorporate qualified projects into the catalog of additional subsidy funds for prices of electricity generated by renewable energy.

       第五条  财政部、国家发展改革委、国家能源局对地方上报材料进行审核，并将符合条件的项目列入可再生能源电价附加资金补助目录。

Chapter 3: Subsidy Standard

第三章  补助标准

  Article 6    On-grid prices of electricity generated by renewable energy, benchmark prices of electricity generated by coal-fired sets with flue gas desulphurization and other relevant factors shall be taken into consideration in determining the subsidy standard of on-grid electricity quantity of renewable energy power generation projects.

       第六条  可再生能源发电项目上网电量的补助标准,根据可再生能源上网电价、脱硫燃煤机组标杆电价等因素确定。

  Article 7    With regard to project investments and operation & maintenance expenditures dedicated to the grid connection system of renewable energy power generation projects, the subsidy thereof shall be granted based on on-grid electricity quantity and according to the subsidy standard which shall be: RMB0.01 per kilowatt-hour for a distance of less than 50 kilometers, RMB0.02 per kilowatt-hour for a distance between 50-100 kilometers, and RMB0.03 per kilowatt-hour for a distance of more than 100 kilometers.

       第七条  专为可再生能源发电项目接入电网系统而发生的工程投资和运行维护费用,按上网电量给予适当补助,补助标准为:50公里以内每千瓦时1分钱,50-100公里每千瓦时2分钱,100公里及以上每千瓦时3分钱。

  Article 8    Selling prices of electricity generated by state-funded or sate-subsidized public independent renewable energy electrical power systems shall be subject to the classified selling prices in the same region; the part of reasonable operation and managerial costs exceeding the selling price shall be appropriately subsidized through the additional subsidy funds for prices of electricity generated by renewable energy. The subsidy standard shall be RMB4,000 per kilowatt-year for the time being.

       第八条  国家投资或者补贴建设的公共可再生能源独立电力系统的销售电价,执行同一地区分类销售电价,其合理的运行和管理费用超出销售电价的部分,通过可再生能源电价附加给予适当补助,补助标准暂定为每千瓦每年0.4万元。

  Article 9    The National Development and Reform Commission shall, based on the characteristics of different types of renewable energy power generation and the conditions of various regions, determine price policies for renewable energy power generation projects, grid connection works and public independent renewable energy electrical power systems under the principle of conductive to the promotion of the development and utilization of renewable energies and the principle of economy and rationality, and duly make adjustments based on the technologic advance of renewable energy development and utilization.

The on-grid electricity prices that are determined by bidding or other competitive means in accordance with relevant provisions of the Law of the People's Republic of China on Renewable Energy shall be subject to bid prices, provided that such prices shall not exceed the pricing level fixed by the government for renewable energy power generation projects of the same type.

       第九条  可再生能源发电项目、接网工程及公共可再生能源独立电力系统的价格政策，由国家发展改革委根据不同类型可再生能源发电的特点和不同地区的情况，按照有利于促进可再生能源开发利用和经济合理的原则确定，并根据可再生能源开发利用技术的发展适时调整。

    根据《中华人民共和国可再生能源法》有关规定通过招标等竞争性方式确定的上网电价，按照中标确定的价格执行，但不得高于同类可再生能源发电项目的政府定价水平。

Chapter 4: Budget Management and Fund Appropriation

第四章  预算管理和资金拨付

  Article 10    The Ministry of Finance shall, in conjunction with the National Development and Reform Commission and the National Energy Administration, formulate the annual budget of revenue and expenditure for additional subsidy funds for prices of electricity generated by renewable energy in accordance with the administrative requirements and procedures for central governmental funds.

       第十条  按照中央政府性基金预算管理要求和程序,财政部会同国家发展改革委、国家能源局编制可再生能源电价附加补助资金年度收支预算。

  Article 11    Additional subsidy funds for prices of electricity generated by renewable energy shall be appropriated at quarterly intervals and settled at the end of each year in principle. Based on the circumstances of grid-connected power generation projects and grid connection works incorporated in the catalog of additional subsidy funds for prices of electricity generated by renewable energy in their respective grid coverage, provincial grid enterprises and local independent grid enterprises shall submit, prior to 10th of the third month of each quarter, an application form for addition subsidy funds for prices of electricity generated by renewable energy (see the form in Appendix 2) of the next quarter. The departments at the province level in charge of finance, price, and energy at the places where the enterprises are located shall examine and verify the application form, and then submit it the Ministry of Finance, the National Development and Reform Commission and the National Energy Administration.

Applications for addition subsidy funds shall be submitted together with settlement reports after the annual end of public independent renewable energy electrical power system projects.

       第十一条  可再生能源电价附加补助资金原则上实行按季预拨、年终清算。省级电网企业、地方独立电网企业根据本级电网覆盖范围内的列入可再生能源电价附加资金补助目录的并网发电项目和接网工程有关情况,于每季度第三个月10日前提出下季度可再生能源电价附加补助资金申请表(格式见附2),经所在地省级财政、价格、能源主管部门审核后,报财政部、国家发展改革委、国家能源局。

    公共可再生能源独立电力系统项目于年度终了后随清算报告一并提出资金申请。

  Article 12    The Ministry of Finance shall, based on the additional revenues of prices of electricity generated by renewable energy and the fund applications of provincial grid enterprises and local independent grid enterprises, appropriate additional subsidy funds for prices of electricity generated by renewable energy to provincial departments of finance. The said departments shall appropriate funds in a timely manner in accordance with the regulations on treasure administration.

       第十二条  财政部根据可再生能源电价附加收入、省级电网企业和地方独立电网企业资金申请等情况,将可再生能源电价附加补助资金拨付到省级财政部门。省级财政部门按照国库管理制度有关规定及时拨付资金。

  Article 13    Provincials grid enterprises and local independent grid enterprises shall, on the basis of on-grid prices of electricity generated by renewable energy and purchased on-grid quantity of electricity generated by renewable energy, settle electricity bills at monthly intervals with renewable energy power generation enterprises.

       第十三条  省级电网企业、地方独立电网企业应根据可再生能源上网电价和实际收购的可再生能源发电上网电量,按月与可再生能源发电企业结算电费。

  Article 14    Provincial grid enterprises, local independent grid enterprises and project sponsors of public independent renewable energy electrical power systems shall prepare and submit, within one month after the end of each year, the application form for settlement of additional subsidy funds for prices of electricity generated by renewable energy (see the form in Appendix 3) to the departments at the province level in charge of finance, price, and energy together with related supporting documents, such as full-year electricity bills or power bills.

       第十四条  年度终了后1个月内,省级电网企业、地方独立电网企业、公共可再生能源独立电力系统项目单位,应编制上年度可再生能源电价附加补助资金清算申请表(格式见附3),报省级财政、价格、能源主管部门,并提交全年电费结算单或电量结算单等相关证明材料。

  Article 15    The departments at the province level in charge of finance, price, and energy shall carry out preliminary examination of the documents submitted by enterprises, and put forward and submit preliminary examination opinions to the Ministry of Finance, the National Development and Reform Commission and the National Energy Administration.

       第十五条  省级财政、价格、能源主管部门对企业上报材料进行初步审核,提出初审意见,上报财政部、国家发展改革委、国家能源局。

  Article 16    The Ministry of Finance shall, in conjunction with the National Development and Reform Commission and the National Energy Administration, organize the examination and verification of the documents submitted by local departments, and carry out the settlement of subsidy funds.

       第十六条  财政部会同国家发展改革委、国家能源局组织审核地方上报材料，并对补助资金进行清算。

Chapter 5: Supplementary Provisions

第五章  附则

  Article 17    These Measures shall be interpreted by the Ministry of Finance in conjunction with the National Development and Reform Commission and the National Energy Administration.

       第十七条  本办法由财政部会同国家发展改革委、国家能源局负责解释。

  Article 18    These Measures shall come into effect on the date of promulgation. These Measures shall apply with regard to the declaration, examination and verification, and appropriation of additional subsidy funds for prices of electricity generated by renewable energy in 2012.

       第十八条  本办法自发布之日起施行。2012年可再生能源电价附加补助资金的申报、审核、拨付等按本办法执行。
