Article 1 With a view to promoting scientific and impartial management of the demonstration projects of buildings constructed with renewable energy (hereinafter referred to as the Project), and regulating the evaluation of the Projects, these Measures are formulated in accordance with the Interim Administrative Measures for Special Application Funds for Building constructed with Renewable-Energy (Cai Jian [2006] No. 460) (hereinafter referred to as the Administrative Measures).
第一条 为提高可再生能源建筑应用示范项目(以下简称项目)管理的科学性、公正性,规范项目评审工作,根据《可再生能源建筑应用专项资金管理暂行办法》(财建〔2006〕460号,以下简称管理办法),制定本办法。
Article 2 Application materials submitted by local governments shall be registered and put on file by the Ministry of Construction. A Project database shall be set up for unified management.
第二条 建设部对各地申报的材料进行登记、造册,建立项目库,统一管理。
Article 3 The Ministry of Finance and the Ministry of Construction shall make initial screening of Project application materials, and include the same into the Project database except for those to which any of the following circumstances applies:
1. Projects whose techniques and/or equipment adopted are unsatisfactory in terms of safety;
2. Projects whose information as provided is inconsistent with the actual situation;
3. Projects that fail to meet local energy-saving standards of buildings;
4. Projects whose declaration procedures are incomplete, or whose application report is not prepared in the required manner;
5. Projects that have received national financial support related to application of renewable-energy buildings;
6. Projects and cities that use renewable energy for centralized heating and cooling, but fail to calculate and charge fees by the amount of heating (cooling) actually consumed; or
7. Projects that are not in compliance with relevant provisions as set out in the Administrative Measures.
第三条 由财政部、建设部对项目申报材料进行初步筛选,列入项目库。对有下列情况之一的,不予列入:
1.项目所采用的技术、设备不具备安全性;
2.提供资料与实际情况不符;
3.不符合所在区域的建筑节能标准;
4.申报手续不完备,申请报告编写不符合规定;
5.已获得国家可再生能源建筑应用相关的资金支持;
6.利用可再生能源实行集中供热、供冷但未实行按用热(冷)量计量收费的项目和城市;
7.不符合管理办法有关规定。
Article 4 The Ministry of Finance and the Ministry of Construction shall jointly organize experts to select a certain percentage of Projects from the Project database, make centralized evaluation, and present examination opinions on investment or additional investment therein.
The scoring of the Projects is mainly based on the application report for demonstration projects of renewable-energy buildings. Please see the Scoring Sheet of Demonstration Projects of Renewable-Energy Buildings (Appendix 1) for details. Items for evaluation are as follows:
1. technical sophistication, i.e. how advanced is the renewable energy application technology adopted;
2. applicability and feasibility, which covers such aspects as the implementing entity, the entity for technical support, operation and maintenance, construction techniques, products and equipment, and the risks involved;
3. cost-effectiveness and rationality, which covers such aspects as the incremental cost, the amount of alternative energy used, and the cost-effectiveness ratio (incremental cost/energy saving efficiency);
4. Project demonstration and popularization, which covers such aspects as the regional representativeness and architectural representativeness of the Project, other resource-saving measures, and post-evaluation safeguards.
第四条 财政部和建设部联合组织专家,从项目库中选取一定比例的项目,组织专家进行集中评审,并对项目示范增投资提出审核意见。
项目主要依据可再生能源建筑应用示范项目申请报告进行评分,详见《可再生能源建筑应用示范项目评分表》(附1),评审内容如下:
1.技术先进,是指可再生能源应用技术的先进性;
2.适用可行,包括实施单位和技术支持单位、运行维护、施工工艺、产品设备、风险;
3.经济合理,包括增量成本、常规能源替代量、费效比(增量成本/节能效益);
4.示范推广,包括项目的区域代表性、建筑类型代表性、其他资源节约措施、后评估保障措施。
Article 5 The composition of evaluation expert groups for demonstration Projects of renewable-energy buildings is as follows:
(1) the Ministry of Construction and the Ministry of Finance shall jointly select experts in areas such as renewable-energy building application, building energy-saving, finance, project management, etc. to form a Project expert tank;
(2) the Ministry of Finance and the Ministry of Construction shall select experts from the expert tank to form expert evaluation group. Each expert evaluation group shall consist of no less than seven (7) members, including experts in building, civil engineering, construction equipment and construction costs, etc. A group leader shall be appointed for each expert evaluation group;
(3) evaluation experts shall be highly responsible for the country and the Projects, have good professional ethics, adhere to the principles, and evaluate the Projects on an independent, objective and impartial basis; evaluation experts shall be qualified senior technical professionals;
(4) an evaluation expert shall apply for abstention if he/she has any stake in the Project under application, or any other relationship that may affect his/her ability to impartially evaluate the Project.
第五条 可再生能源建筑应用示范项目评审专家的组成。
(一)由建设部、财政部共同选择可再生能源建筑应用、建筑节能、财务、项目管理等方面的专家组成项目专家库;
(二)财政部、建设部从专家库中抽取专家组成专家评审组;每个专家评审组一般不少于7人,评审组应包含建筑、土木工程、建筑设备、工程造价等方面的专家,并指定一名专家组长;
(三)评审专家应具有对国家和项目负责的态度,具有良好的职业道德,坚持原则,独立、客观、公正地对项目进行评审,评审专家应具有高级专业技术职务;
(四)评审专家如与申报项目存在利益关系或其他可能影响公正性的关系的,应当申请回避。
Article 6 Projects that have passed the evaluation shall be announced by the Ministry of Finance and the Ministry of Construction for ten (10) days. The qualification of demonstration Projects shall be cancelled upon verification of any major problems.
第六条 财政部、建设部对评审合格的项目进行确定后进行公示,公示期十日,如有重大问题,经查实取消示范资格。
Article 7 These Measures shall be interpreted by the Ministry of Finance and the Ministry of Construction.
第七条 本办法由财政部、建设部负责解释。

Duties and Discipline of Evaluation Experts in Evaluating Demonstration Projects of Renewable-Energy Buildings
1. Evaluation experts shall follow the prescribed evaluation procedures to evaluate and grade Projects on an independent, objective, impartial and scientific basis.
2. Evaluation experts shall fill out the Scoring Sheet of Demonstration Projects of Buildings Constructed with Renewable Energy and the Form of Recommendation Opinions on Demonstration Projects of Application of Buildings Constructed with Renewable Energy.
3. Evaluation experts shall apply to the group leader for abstention, if they have any stake in the Project under application, or any other relationship that may affect their ability to evaluate the Project on an impartial basis.
4. Evaluation experts shall not make use of their special status and influence as experts to collude with the personnel of the Project under application to facilitate Project establishment.
5. Evaluation experts shall not suppress divergent academic opinions or opinions of other experts. Evaluation experts shall not, for pursuit of the subjectively expected conclusion, make evaluation in irregular ways or out of context, or make one-sided and non-objective evaluation.
6. Evaluation experts shall not divulge any Projects confirmed in the evaluation and the list hereof, the list of evaluation experts, evaluation standards, evaluation opinions or evaluation results, or duplicate and retain, or disseminate the evaluation materials to others. Upon completion of the evaluation process, evaluation experts shall submit their evaluation opinions to the project management body, and return all the evaluation materials.
7. Evaluation experts shall not make any cross-group discussion that may hinder the fair evaluation of Projects.
8. Without the approval of the project management body, evaluation experts shall not be transferred into other evaluation groups.
9. Evaluation experts shall not solicit for or accept any benefits offered by the organization and/or individual whose Project is under evaluation, including gifts, cash, marketable securities, payment vouchers and junketing that may affect the impartiality of their judgement.
10. In the course of the evaluation, evaluation experts, in principle, are not allowed to leave the meeting venue. Under exceptional circumstances, the experts shall ask for leave subject to the approval of the leader of the expert group. The period of leave shall not be longer than four (4) hours. Otherwise, the expert concerned shall be disqualified from the evaluation. Leave applications of group leaders shall be approved by the person in charge of the project management body.
第八条 本办法自印发之日起执行。

可再生能源建筑应用示范项目专家在评审工作中的职责和纪律
1.评审专家应按照规定的评审程序,独立、客观、公正、科学地对项目进行评价和打分。
2.评审专家对项目进行评议并应填写《可再生能源建筑应用示范项目评分表》、《可再生能源建筑应用示范项目推荐意见表》。
3.评审专家如与申报项目存在利益关系或其他可能影响公正性的关系的,应当向组长申明并回避。
4.评审专家不得利用专家的特殊身份和影响力与申请项目相关人员串通,为其申请的项目获得立项提供便利。
5.评审专家不得压制不同学术观点和其他专家意见。评审专家不得为得出主观期望的结论,投机取巧、断章取义、片面做出与客观事实不符的评价。
6.评审专家不得泄露评审认定项目和清单、评审专家名单、评审标准、评审意见、结果,不得复制保留或向他人扩散评审资料,评审工作结束后,向项目管理机构提交专家评审意见并交回全部评审材料。
7.评审专家不得跨组进行有碍项目公正评审的有关讨论。
8.未经项目管理机构批准,评审专家不得调换评审组。
9.评审专家不得索取或者接受被评审项目单位以及相关人员的礼品、礼金、有价证券、支付凭证以及可能影响公正性的宴请或其他好处。
10.评审工作期间,评审专家原则上不得离开会议所在地,如遇特殊情况实行请假制度,但请假时间超过4小时,即取消本次评审资格,请假需经专家组长批准。专家组长的请假需经项目管理机构负责人批准。
