  Article 1   These Measures are formulated pursuant to the requirements of the Opinions of the CPC Central Committee and the State Council on Deepening the Reform of the Medical and Health Care System (Zhong Fa【2009】No. 6) with a view to ensuring that persons who have insured the basic medical insurance for urban workers, basic medical insurance for urban residents or participated in the new rural cooperative health care be continuously insured during migrant employment and that the continuation of basic medical insurance relations are smooth, and to protecting the legitimate rights and interests of insurance (cooperation) participants.

       第一条  为保证城镇职工基本医疗保险、城镇居民基本医疗保险和新型农村合作医疗参保(合)人员流动就业时能够连续参保,基本医疗保障关系能够顺畅接续,保障参保(合)人员的合法权益,根据《中共中央国务院关于深化医药卫生体制改革的意见》(中发【2009】6号)的要求,制定本办法。

  Article 2   All types of migrant workers in urban and rural areas shall participate in the basic medical insurance for urban workers, the basic medical insurance for urban residents or the new rural cooperative health care correspondingly in accordance with the existing provisions, and shall not participate in the insurance and cooperation at the same time or enjoy benefits repeatedly. No region shall set up participation obstacles with reasons such as household registration.

       第二条  城乡各类流动就业人员按照现行规定相应参加城镇职工基本医疗保险、城镇居民基本医疗保险或新型农村合作医疗,不得同时参加和重复享受待遇。各地不得以户籍等原因设置参加障碍。

  Article 3   Where persons with rural household registration are employed by entities in cities and towns and have a stable labor relation, the employing entities shall handle registration formalities in accordance with the Interim Administrative Measures for Social Insurance Registration for the said persons to enable them to participate in the basic medical insurance for urban workers at the place of employment. Other migrant workers may voluntarily choose to participate in the new rural cooperative health care at the household residence or the basic urban medical insurance at the place of employment, and shall handle registration formalities with handling agencies of the new rural cooperative health care at the household residence or handling agencies of social (medical) insurance at the place of employment in accordance with relevant provisions.

       第三条  农村户籍人员在城镇单位就业并有稳定劳动关系的,由用人单位按照《社会保险登记管理暂行办法》的规定办理登记手续,参加就业地城镇职工基本医疗保险。其他流动就业的,可自愿选择参加户籍所在地新型农村合作医疗或就业地城镇基本医疗保险,并按照有关规定到户籍所在地新型农村合作医疗经办机构或就业地社会(医疗)保险经办机构办理登记手续。

  Article 4   After participants of the new rural cooperative health care have participated in the basic urban medical insurance, handling agencies of social (medical) insurance at the place of employment shall notify handling agencies of the new rural cooperative health care at the household residence to go through transfer formalities. The said persons shall withdraw from the new rural cooperative health care pursuant to local regulations, and shall no longer enjoy the benefits of the new rural cooperative health care. 

       第四条  新型农村合作医疗参合人员参加城镇基本医疗保险后,由就业地社会(医疗)保险经办机构通知户籍所在地新型农村合作医疗经办机构办理转移手续,按当地规定退出新型农村合作医疗,不再享受新型农村合作医疗待遇。

  Article 5    Persons with rural household registration who suspend the basic urban medical insurance relations as a result of the termination of labor relations or other reasons may, on the strengthen of the certificate of insurance participation issued by handling agencies of social (medical) insurance at the place of employment, apply to handling agencies of the new rural cooperative health care at the household resident to participate in the new rural cooperative health care in accordance with local regulations.

       第五条  由于劳动关系终止或其他原因中止城镇基本医疗保险关系的农村户籍人员,可凭就业地社会(医疗)保险经办机构出具的参保凭证,向户籍所在地新型农村合作医疗经办机构申请,按当地规定参加新型农村合作医疗。

  Article 6    Where persons participating in the basic urban medical insurance get migrant employment cross the coordinating regions, in the event that there are acceptance entities at the new places of employment, the said entities shall handle registration formalities in accordance with the requirements of the Interim Administrative Measures for Social Insurance Registration, and the said persons shall participate in the basic medical insurance for urban workers at the new places of employment; in the event that there are no acceptance entities, the individual shall handle registration formalities with handling agencies of social (medical) insurance at the new places of employment within three(3) months upon the suspension of the original basic medical insurance relation, and participate in the basic medical insurance for urban workers or the basic medical insurance for urban residents pursuant to local regulations.

       第六条  城镇基本医疗保险参保人员跨统筹地区流动就业,新就业地有接收单位的,由单位按照《社会保险登记管理暂行办法》的规定办理登记手续,参加新就业地城镇职工基本医疗保险;无接收单位的,个人应在中止原基本医疗保险关系后的3个月内到新就业地社会(医疗)保险经办机构办理登记手续,按当地规定参加城镇职工基本医疗保险或城镇居民基本医疗保险。

  Article 7    Where persons participating in the basic urban medical insurance get migrant employment cross the coordinating regions and participate in the basic urban medical insurance at the new places of employment, handling agencies of social (medical) insurance at the new places of employment shall notify handling agencies of social (medical) insurance at the original places of employment to go through the transfer formalities, and the said persons shall no longer enjoy the benefits of the basic urban medical insurance at the original places of employment. Where personal accounts have been established, the personal accounts shall, in principle, transfer with the medical insurance relations, and balances in the personal accounts (including fees paid by individuals and the transferred-in part of fees paid by entities) shall be transferred through handling agencies of social (medical) insurance.

       第七条  城镇基本医疗保险参保人员跨统筹地区流动就业并参加新就业地城镇基本医疗保险的,由新就业地社会(医疗)保险经办机构通知原就业地社会(医疗)保险经办机构办理转移手续,不再享受原就业地城镇基本医疗保险待遇。建立个人账户的,个人账户原则上随其医疗保险关系转移划转,个人账户余额(包括个人缴费部分和单位缴费划入部分)通过社会(医疗)保险经办机构转移。

  Article 8    Where persons participating in the insurance or cooperation transfer basic medical insurance relations cross systems or cross coordinating regions, handling agencies of social (medical) insurance or the new rural cooperative health care at the original household residence or the original places of employment shall produce the certificate of insurance (cooperation) participation (see appendix for format) when the said persons handle the formalities for suspension of insurance (cooperation) participation, and shall retain the information on insurance (cooperation) participation thereof for future verification. New places of employment shall manage well the verification and registration, etc. of insurance (cooperation) participation information of flowed-in persons. 

       第八条  参保(合)人员跨制度或跨统筹地区转移基本医疗保障关系的,原户籍所在地或原就业地社会(医疗)保险或新型农村合作医疗经办机构应在其办理中止参保(合)手续时为其出具参保(合)凭证(样式见附件),并保留其参保(合)信息,以备核查。新就业地要做好流入人员的参保(合)信息核查以及登记等工作。

  Article 9    The certificate of insurance (cooperation) participation shall be uniformly formulated by the Ministry of Human Resources and Social Security in conjunction with the Ministry of Health, and be uniformly printed by handling agencies of social (medical) insurance and the new rural cooperative health care in all regions. The information on the certificate of insurance (cooperation) participation shall, in principle, be delivered between and among handling agencies of social (medical) insurance and handling agencies of the new rural cooperative health care. Where due to special reasons the information cannot be delivered, the persons participating in the insurance (cooperation) shall handle relevant formalities on their own.

       第九条  参保(合)凭证由人力资源社会保障部会同卫生部统一设计,由各地社会(医疗)保险及新型农村合作医疗经办机构统一印制。参保(合)凭证信息原则上通过社会(医疗)保险及新型农村合作医疗经办机构之间传递,因特殊原因无法传递的,由参保(合)人员自行办理有关手续。

  Article 10    Handling agencies of social (medical) insurance and the new rural cooperative health care shall designate windows or assign special personnel to handle such business as the registration of basic medical insurance of migrant workers and relation continuation. Gradually use the ID card number as the only identification code of all categories of persons to participate in the basic medical insurance for urban workers, the basic medical insurance for urban residents, and the new rural cooperative health care, strengthen the construction of the information system, and timely record and update the information on the payment of insurance (cooperation) participation by migrant workers to ensure the integrity and continuity of the records on insurance (cooperation) participation. 

       第十条  社会(医疗)保险和新型农村合作医疗经办机构要指定窗口或专人,办理流动就业人员的基本医疗保障登记和关系接续等业务。要逐步将身份证号码作为各类人员参加城镇职工基本医疗保险、城镇居民基本医疗保险和新型农村合作医疗的唯一识别码,加强信息系统建设,及时记录更新流动人员参保(合)缴费的信息,保证参保(合)记录的完整性和连续性。

  Article 11   Handling agencies of social (medical) insurance and the new rural cooperative health care shall strengthen communication and cooperation, and jointly manage well the administration and services of the transfer and continuation of basic medical insurance relations to simplify formalities, standardize procedures and enable data sharing to facilitate persons participating in the insurance (cooperation) to continue the basic medical insurance relations and enjoy the benefits.

       第十一条  社会(医疗)保险和新型农村合作医疗经办机构要加强沟通和协作,共同做好基本医疗保障关系转移接续管理服务工作,简化手续,规范流程,共享数据,方便参保(合)人员接续基本医疗保障关系和享受待遇。

  Article 12    All provinces, autonomous regions and municipalities directly under the Central Government shall, in accordance with these Measures and in light of local realities, formulate specific implementation measures for the administration over the registration of basic medical insurance for migrant workers as well as the transfer and continuation thereof.

       第十二条  各省、自治区、直辖市要按照本办法,并结合当地实际制定流动就业人员基本医疗保障登记管理和转移接续的具体实施办法。

  Article 13    These Measures shall come into effect as of July 1, 2010. 

       第十三条  本办法自2010年7月1日起实施。
