Chapter I General Provisions

第一章  总则

  Article 1    In order to push forward the construction of new socialist countryside, improve the network of rural circulation, promote increase in rural income and stimulate rural consumption, the central budget sets up funds for the development of rural logistic service system (hereinafter referred to as special funds for abbreviation) in accordance with the spirits of Opinions of the Central Committee of CPC and the State Council on Pushing Forward the Construction of New Socialist Countryside (Zhong Fa [2006] No. 1) and Opinions of General Office of the State Council on Activating Circulation and Increasing Consumption (Guo Ban Fa [2008] No. 134). With the goal of enhancing funds administration and improving the utilization efficiency of funds, these Measures are hereby formulated in accordance with Budget Law of the People’s Republic of China and relevant provisions of the implementing measures thereof.

       第一条  为推进社会主义新农村建设,健全农村流通网络体系,促进农民增收,拉动农村消费,根据《中央中央国务院关于推进社会主义新农村建设的若干意见》(中发[2006]1号)和《国务院办公厅关于搞活流通扩大消费的意见》(国办发[2008]134号)精神,中央财政设立农村物流服务体系发展专项资金(以下简称专项资金)。为规范专项资金的管理,提高资金使用效益,根据《中华人民共和国预算法》及其实施细则有关规定,制定本办法。

  Article 2    The arrangement of special funds shall comply with the principle of being open and transparent, normative and rational, as well as key-prominent, so as to ensure the utilization efficiency of funds.

       第二条  专项资金的安排坚持公开透明、规范合理、突出重点的原则,确保资金的使用效益。

Chapter II Supporting Scope

第二章  支持范围

  Article 3    Supporting scope of special funds includes:

(i) Supporting the construction of new countryside stores and rural comprehensive service centers and the renovation of the existing stores and centers, accelerating the construction of the distributing centers for rural products, and improving product-distributing capacity;

(ii) Supporting the linkage between large chain supermarkets, agricultural products circulating enterprises and professional cooperatives for agricultural products, as well as such projects as constructing cold chain systems for fresh agricultural products, rapid test system, distributing centers and logistic service system at manufacturing bases for agricultural products;

(iii) Supporting large wholesale markets of fresh agricultural products to upgrade and improve such facilities as cold-chain system, traceability system of quality and safety, safety supervision, waste disposal, sorting and packing, processing and distributing;

(iv) Supporting rural commercial markets at counties and villages to conduct standardized improvement to operating facilities;

(v) Supporting chain operation of agricultural means of production, giving priority to cultivation of large circulating enterprises for agricultural means of production, and enhancing modern warehouse and logistics construction for agricultural means of production;

(vi) Supporting the upgrade and improvement of rural circulating network for home electronic appliance, automobiles and motor bicycles to go to the countryside;

(vii) Supporting the construction of public service platform and electronic trade platform for rural logistic information;

(viii) Other aspects as specified by the Ministry of Finance People’s Republic of China.

       第三条  专项资金的支持范围包括:

    (一)支持新建和改造农家店、农村综合服务社,加快农村商品配送中心建设,提升商品配送能力;

    (二)支持大型连锁超市、农产品流通企业与农产品专业合作社对接,在农产品生产基地建设鲜活农产品冷链系统、快速检测系统、配送中心、物流配送体系等项目;

    (三)支持大型鲜活农产品批发市场对冷链系统、质量安全可追溯系统、安全监控、废弃物处理以及仓储、分拣包装、加工配送等设施进行升级改造;

    (四)支持县乡农贸市场对经营设施进行标准化改造;

    (五)支持农业生产资料连锁经营,重点培育大型农业生产资料流通企业,加强农业生产资料现代仓储物流设施建设;

    (六)支持家电下乡、汽车摩托车下乡农村流通网络升级改造;

    (七)支持农村物流信息公共服务平台、电子交易平台建设;

    (八)财政部确定的其他支持方向。

  Article 4    In accordance with the State's overall requirements on countryside's economic and social development and the utilization orientation of special funds, the Ministry of Finance People's Republic of China specifies annual focus of special funds support in joint efforts with such departments as Ministry of Commerce ot the People's Republic of China and General Federation of Supply and Marketing Cooperatives.

       第四条  根据国家农村经济社会发展总体要求和专项资金的使用方向,财政部会同商务部、供销总社等部门明确年度专项资金支持的重点。

Chapter III Supporting Means

第三章  支持方式

  Article 5    Special funds adopt such supporting means as replacement of subsidies with rewards, subsidized interest to loans and financial subsidies.

(i) Replacement of subsidies with rewards. In order to increase the utilization efficiency of funds, supports by means of replacement of subsidies with rewards are offered to projects that are capable to formulate specific quantized assessing standard. After the implementation of projects, rewarding funds shall be granted to qualified projects upon examination in accordance with the prescribed standard.

(ii) Subsidizing interest to loans. As for projects that are of large size in investment, and are capable to obtain loans from banks, supports shall be granted by means of subsidizing interest to loans. Funds for the said subsidies shall be calculated in accordance with bank loans that are issued practically, interest rates as prescribed, limitation thereof and the practical interests that are already paid. Limitation of subsidies to interest shall not exceed 3 years in principle. And the annual subsidy rate to interest shall not exceed the basic interest rate of banks as is prescribed by the State of the corresponding year.

(iii) Financial subsidy. As for projects that are poor in making profits, focus on public welfare, difficult to go through quantized assessment and unsuitable to be supported by means of replacement of subsidies with rewards, supports shall be granted by means of financial subsidies. Where of units that undertaking the said projects have a high proportion of self-raised funds or that are supported by local financial departments, priority shall be given in arrangement.

       第五条  专项资金采取以奖代补、贷款贴息和财政补助等支持方式。

    (一)以奖代补。为了提高资金使用效益,对于能够制定具体量化评价标准的项目,采取以奖代补方式予以支持。在项目实施后,根据规定的标准,经审核符合条件的项目,安排奖励资金。

    (二)贷款贴息。对于投资规模大、能够获取银行贷款的项目采取贷款贴息方式予以支持。贴息资金根据实际到位银行贷款、规定的利息率、贷款期限和实际支付的利息数计算。贴息年限一般不超过3年,年贴息率最高不超过当年国家规定的银行贷款基准利率。

    (三)财政补助。对于盈利性弱、公益性强,难以量化评价,不适于以奖代补方式支持的项目采取补助方式予以支持。项目承担单位自筹资金比例较高及地方财政给予支持的优先安排。

Chapter IV Examination, Approval and Appropriation

第四章  资金审核及拨付

  Article 6    Special funds shall be allocated mainly through component approach.

       第六条  专项资金主要采取因素法进行分配。

  Article 7    Ministry of Finance People’s Republic of China shall, in accordance with the annual focus of special funds support and in consideration of relevant development quotas of all localities and their respective financial capacities and so on, allocate special funds to all provincial financial departments and give funds budget quotas to them, and appropriate funds timely in accordance with relevant provisions concerning management of payment through national treasury.

       第七条  财政部根据专项资金年度支持重点,按照各地相关发展指标并考虑地方财力等因素,将专项资金分配到各省级财政部门并下达资金预算指标,同时按国库支付管理的有关规定及时拨付资金。

  Article 8    All provincial financial departments shall, in joint efforts with such relevant competent departments as commercial departments and federations of supply and marketing cooperatives, formulate specific implementing measures over the utilization of special funds, put forward specific opinions on project arrangement in accordance with the annual focus of special funds support prescribed by the State and quotas allocated in the budget for special funds, report to Ministry of Finance People’s Republic of China, Ministry of Commerce of the People’s Republic of China and General Federation of Supply and Marketing Cooperatives for record and then organize implementation of the said measures.

       第八条  各省级财政部门会同同级商务、供销等相关主管部门制定资金使用管理具体操作办法,根据国家规定的年度专项资金支持重点和分配的专项资金预算指标,提出具体项目安排意见,在规定时间内报财政部、商务部、供销总社等部门备案后组织实施。

  Article 9    Financial departments at provincial level may entrust relevant institutions or organize experts to conduct appraisal over projects that apply for special funds. Appraisal expenditure shall be disbursed from special funds and shall be controlled below 1% of special funds so as to control the expenditure strictly.

       第九条  省级财政部门可委托相关机构或组织专家对申报专项资金的项目进行评审。评审费用在专项资金中列支,按照不超过专项资金额度的1%掌握,从严控制支出范围。

  Article 10    Localities shall, in accordance with their respective financial capacities, arrange funds to support the construction of rural logistics service system and the funds arranged shall be utilized under the integral plan of Ministry of Finance People’s Republic of China.

       第十条  各地可根据当地财力情况,安排资金支持农村物流服务体系建设,并与中央财政专项资金统筹使用。

  Article 11    Financial departments at provincial level shall transfer special funds in accordance with prescribed procedure and appropriate special funds timely to units that undertake corresponding projects in full amount.

       第十一条  省级财政部门按照规定程序办理专项资金划拨手续,及时、足额将专项资金拨付给项目单位。

  Article 12    Units directly under the Central Committee shall apply to Ministry of Finance People’s Republic of China in accordance with provisions of these Measures and guide for the application of special funds of the corresponding year. Upon verification in accordance with regulations, Ministry of Finance People’s Republic of China shall give funds budget and appropriate funds.

       第十二条  中央直属单位根据本办法的规定和当年专项资金项目申报指南向财政部申报。财政部按规定进行审核后,下达资金预算并拨付资金。

  Article 13    Application materials for special funds shall generally include:

(I) Application Form for special funds;

(ii) Project Feasibility Report;

(iii) Copies of business license, state and local tax registration certificates of the legal representatives to units that undertake projects concerned;

(iv) Relevant certificates such as bank loan contract and commitment in case of applying for bank loans with subsidized interest;

(v) Copies of relevant qualification certificates of units that undertake projects concerned;

(vi) Other materials required.

       第十三条  专项资金的申报材料一般应包括:

    (一)专项资金申请文件;

    (二)项目可行性研究报告;

    (三)项目承担单位法人营业执照复印件,地税、国税登记证复印件;

    (四)申请银行贷款财政贴息的项目,需提供相关银行贷款合同和贷款承诺书等凭证;

    (五)项目承担单位相关资质证书复印件;

    (六)其他要求提供的材料。

Chapter V Supervision and Administration

第五章  监督管理

  Article 14    Ministry of Finance People’s Republic of China, Ministry of Commerce of the People’s Republic of China and General Federation of Supply and Marketing Cooperatives shall conduct irregular sampling examination on the administration and utilization of special funds. And local financial departments, commercial departments, federations of supply and marketing cooperatives and units directly under the central committee shall enhance supervision and examination over the utilization of special funds of respective localities and systems and the implementation of projects.

       第十四条  财政部、商务部、供销总社等部门对专项资金管理使用情况进行不定期抽查。地方财政部门、商务部门、供销部门和中央直属单位应当加强对本地和本系统专项资金使用情况和项目执行情况的监督和检查。

  Article 15    Special funds shall be used for their special purposes only, and units or individuals shall be forbidden form detention, retention, peculation and misappropriation of special funds. As for special funds tricked, detained, retained, peculated or misappropriated by means of fraudulent application and claim, Ministry of Finance People's Republic of China shall recall special funds that have been appropriated already upon verification, and handle with the said situations in accordance with relevant provisions of Regulation on Penalties and Sanctions against Illegal Fiscal Acts (Decree No. 427 of the State Council).

       第十五条  专项资金专款专用,任何单位或者个人不得滞留、截留、挤占、挪用专项资金。对以虚报、冒领等手段骗取和滞留、截留、挤占、挪用专项资金的,一经查实,财政部将收回已安排的专项资金,并按《财政违法行为处罚处分条例》(国务院令第427号)的相关规定进行处理。

Chapter VI Supplementary Provisions

第六章  附则

  Article 16    These Measures shall be implemented as of the printing and distributing date. Interim Administrative Measures for Special Funds for Rural Logistic Service System Development (Cai Jian [2006] No. 364) printed and distributed by Ministry of Finance People’s Republic of China shall be abolished simultaneously.

       第十六条  本办法自印发之日起施行。财政部印发的《农村物流服务体系专项资金管理暂行办法》(财建[2006]364号)同时废止。

  Article 17    These Measures shall be subject to the interpretation of Ministry of Finance.

       第十七条  本办法由财政部负责解释。
