  Article 1   These Measures are formulated in accordance with the Law of the People's Republic of China on Boosting Small and Medium Enterprises for the purposes of further boosting the development of small and medium enterprises, strengthening the construction of small and medium enterprise service system, regulating the administration of use of special-purpose funds for the construction of local small and medium enterprise service platform systems allocated by the Central Government.

       第一条  根据《中华人民共和国中小企业促进法》,为了进一步促进中小企业的发展,加强中小企业服务体系建设,规范中央补助地方中小企业平台式服务体系建设专项资金的使用管理,制定本办法。

  Article 2   For the purposes of these Measures, special funds for the construction of local small and medium enterprise service platform systems (hereinafter referred to as "subsidiary funds for the construction of small and medium enterprise service systems") shall mean the funds arranged in the Central financial budget specially for subsidizing the construction of local small and medium enterprise service platform systems.

For the purposes of these Measures, a small and medium enterprise service system shall mean a service system that functions as a public service platform constructed by various social service institutions for boosting small and medium enterprises.

For the purposes of these Measures, small and medium enterprises shall mean the small and medium enterprises defined in the Interim Provisions on Standards of Small and Medium Enterprises (Guo Jing Mao Zhong Xiao Qi [2003] No. 143) jointly formulated in 2003 by the former State Economic and Trade Commission, former State Planning Commission, the Ministry of Finance, and State Statistics Bureau.

       第二条  本办法所称中央补助地方中小企业平台式服务体系建设专项资金(以下简称“中小企业服务体系建设补助资金”),是指中央财政预算安排的,专项用于补助地方中小企业平台式服务体系建设的资金。

    本办法所称中小企业平台式服务体系是指各类社会服务机构为中小企业发展构建的具有平台式公共服务功能的服务体系。

    本办法所称中小企业是指符合原国家经贸委、原国家计委、财政部、国家统计局2003年制定的《中小企业标准暂行规定》(国经贸中小企〔2003〕143号)中界定的中小企业。

  Article 3   The administration of subsidiary funds for the construction of small and medium enterprise service systems shall abide by the principles of standardization, security, and effectiveness and shall be conducive to improving the business environment of small and medium enterprises, boosting the healthy development of small and medium enterprises and expand employment in both urban and rural areas.

       第三条  中小企业服务体系建设补助资金的管理应遵循规范、安全、有效的原则,有利于改善中小企业经营环境,促进中小企业健康发展,扩大城乡就业。

  Article 4   The subsidiary funds for the construction of small and medium enterprise service systems shall be used for constructing the public service platform for small and medium enterprises, and shall mainly be used for:

(1) Expenditures on purchasing necessary equipment;

(2) Expenditures on developing or purchasing software;

(3) Expenditures on making necessary renovations to the existing venues for expanding service scope;

(4) Expenditures on purchasing advanced, general and suitable technical products in the industry;

(5) Expenditures on information collection; and

(6) Other expenditures approved by the Ministry of Finance.

       第四条  中小企业服务体系建设补助资金用于中小企业公共服务平台建设,具体开支范围包括:

    1.必要的设备购置支出。

    2.软件开发或购置支出。

    3.为拓展服务范围对现有场地进行必要改造的支出。

    4.购买行业先进、共性、适用技术成果的支出。

    5.信息采集支出。

    6.经财政部批准的其他支出。

  Article 5   The subsidiary funds for the construction of small and medium enterprise service systems shall be allocated as subsidiary funds to small and medium enterprises service institutions. Small and medium enterprise service institutions applying for subsidiary funds for the construction of small and medium enterprise service systems shall satisfy the following conditions:

(1) Having legal person qualification and the corresponding business qualification for serving small and medium enterprises;

(2) Having professionals engaged in small and medium enterprise services, and having the business ability for providing social services for small and medium enterprises and necessary service facilities;

(3) Having the business premises for providing social services for small and medium enterprises;

(4) Having complete service rules and a well-established financial management system; and

(5) Satisfying other conditions as required.

       第五条  中小企业服务体系建设补助资金采取拨款补助的方式,补助对象为中小企业服务机构。申请中小企业服务体系建设补助资金的中小企业服务机构应具备以下条件:

    1.具有法人资格,拥有为中小企业服务相应业务的资格。

    2.具有从事中小企业服务业务的专业人员,具备为中小企业提供社会服务的业务能力及必要的服务设施。

    3.有为中小企业提供社会服务的工作场所。

    4.有完整的服务规程和健全的财务管理制度。

    5.其他应符合的条件。

  Article 6   The procedures for the applications for subsidiary funds for the construction of small and medium enterprise service systems and the circulation of the examination and approval results of such applications are:

(1) The Ministry of Finance prints and issues the notice on annual funds application;

(2) The provincial financial departments organize application materials according to the projects and submit the same to the Ministry of Finance within a specified time limit. The application materials shall include formal application documents and the implementation schemes of the projects; and

(3) The Ministry of Finance shall, on the basis of reviewing the projects under the applications for subsidiary funds submitted by the local authorities, in accordance with the relevant laws and regulations of the State and the provisions on budgetary management, formulate and circulate plans on subsidiary funds for the construction of small and medium enterprise service systems, and timely allocate the funds in accordance with the relevant provisions.

       第六条  中小企业服务体系建设补助资金的申报与审批下达程序是:

    1.财政部印发年度资金申报通知。

    2.省级财政部门按项目组织申报材料,并在规定的时间内报送财政部。申报材料包括正式申请文件和项目的实施方案。

    3.财政部在对地方申报补助资金项目进行评审的基础上,根据国家有关法律法规及预算管理的规定,编制下达中小企业服务体系建设补助资金计划,并按有关规定及时拨付资金。

  Article 7   Small and medium enterprise service institutions that accept the subsidiary funds for the construction of small and medium enterprise service systems shall bear the obligation of providing service platforms such as techniques, human resource, information, management, etc., and shall, on a regular basis, submit the relevant information relating to such service platforms to the local financial department for filing.

       第七条  接受中小企业服务体系建设补助资金的中小企业服务机构应承担向中小企业提供技术、人才、信息、管理等平台服务的义务,并定期将提供平台服务的有关情况报地方财政部门备案。

  Article 8   The local financial department shall be responsible for the management of the subsidiary funds for the construction of the small and medium enterprise service system and the specific projects, and also the follow-up on the efficiency of the use of such funds; The Ministry of Finance shall, at non-fixed intervals, organize the relevant organizations to conduct special examination.

       第八条  地方财政部门具体负责中小企业服务体系建设补助资金及项目的管理并跟踪问效;财政部不定期组织有关机构进行专项检查。

  Article 9   The subsidiary funds for the construction of small and medium enterprise service systems must be used for designated purposes, and retention, embezzlement or misappropriation shall be strictly prohibited. With regard to acts of retention, embezzlement and misappropriation of funds, or practicing falsity and fraud, etc., in violation of the financial and economic disciplines, in addition to imposing administrative and economic penalties on the funded organizations and relevant responsible persons in accordance with the relevant provisions of the State, the following punishment shall be imposed: recover the subsidiary funds for the construction of small and medium enterprise service systems allocated thereto in full amount and turn over such funds to the Ministry of Finance, and they shall not be allowed to file any application for such funds within three years.

       第九条  中小企业服务体系建设补助资金必须专款专用,严禁截留、挤占、挪用。对截留、挤占、挪用及弄虚作假等违反财经纪律的行为,除按国家有关规定对资助单位和有关责任人给予行政和经济处罚外,还将进行以下处理:将已经拨付的中小企业服务体系建设补助资金全额收回上缴财政部;三年内不得申报中小企业服务体系建设补助资金。

  Article 10   These Measures shall be effective on the promulgation date.

       第十条  本办法自发布之日起施行。
