To all departments in charge of commerce, departments (bureaus) of finance of all provinces, autonomous regions, municipalities directly under the Central Government and cities specially designated in the State plan, the Bureau of Commerce, Bureau of Finance of Xinjiang Production and Construction Corps, and related Central enterprises.
In order to carry out the Opinion of State Cuo Ban Fa [2008] No. 134), to promote resources saving and encourage recycled consumption, the Ministry of Commerce and Ministry of Finance decide to enhance the construction of recovery system of renewable resources, and hereby notify the relevant issues as follows:
1. Principles and Objective
With the rapid development of China's economy, energy and resources deficiency problems become increasingly serious. Recovery of renewable resources plays a more and more important role in terms of improving resources utilization, reducing pollution and protecting environment. At present, the industry of renewable resources recovery faces a lot of problems such as small scale, low recovery rate, backward technology, serious secondary pollution, unregulated operations and so on, which go against with the target of building a resource-saving and eco-friendly society. Therefore, all local governments shall attach great importance to the construction of recovery system of renewable resources from the view of implementing the scientific concept of development, and take the construction of recovery system of renewable resources as significant measures for energy saving and emission reduction and strive to achieve their purposes.
(1) Guiding Principles
Government should be responsible for guiding and support and enterprises should obey the market rules. From the starting point of helping to improve the recovery utilization rate of renewable resources, protect environment, facilitate residents life and foster leading enterprises, take recovery enterprises and distributing markets as basis, integrate existing recovery network and promote the reconstruction and upgrade through policy support; Establish pilot recovery systems at first and spread the experience to more places to realize the rapid development of the construction of recovery system of renewable resources nationwide.
(2) General Ideas and Objective
Focus on major cities. First of all, a pilot shall be conducted in selected municipalities directly under the Central Government, and cities specially designated in the State plan and provincial capitals (hereinafter refer to as "pilot cities"), and then expand to small cities using the pilot experience. Perfect the laws, standards and policies on the recovery of renewable resources to establish a promoting mechanism; reconstruct the recovery venues in communities, the selection centers and distribution markets by training the recovery enterprises and the staff in order to bring more than 90 percent of the recovery personnel into standard administration, set up recovery centers in more than 90 percent of communities, put more than 90 percent of the renewable resources in designated markets for trading or processing, and increase the recovery rate of main renewable resources to 80 percent. As a result, establish a recovery system of renewable resources with reasonable layout, sufficient networks, good facilities, complete functions and scientific management regularly which conform to the developing plan of the cities, and realize the industrialization of renewable resources finally.
2. Major Work
(1) Establish and perfect the administrative mechanism for recovery of renewable resources
All local governments shall formulate the construction plan for the recovery system of renewable resources based on city construction planning and publish that plan via government or legislative authority to make it enforceable; establish a promoting system for recovery of renewable resources including laws and regulations, standards, finance, tax or land policies; set up organizing bodies and administrative mechanism to guide, supervise and manage the recovery system of renewable resources.
(2) Set up and regulate the recovery system of renewable resources
All local governments shall choose leading enterprise for the construction of recovery system of renewable resources and make uniform plan, reasonable layout and standard construction based on existing recovery channels, in order to establish a network system for the recovery of renewable resources based on recovery venues and selection centers in communities, with the core of distribution markets and the purpose of processing and utilization, and to promote the healthy and orderly development of renewable resources industry.
(a) Guide recovery enterprises to adopt operating chains and integrate separate and decentralized recovery mode to set up fixed or removable recovery centers in communities with uniform planning, uniform sign, uniform dressing, uniform price, uniform measurement, uniform vehicles and uniform management according to the principle of "convenient for sales".
(b) According to the construction planning for recovery system of renewable resources, improve the selecting function of major renewable resources such as waste paper, waste plastic (waste water bottle) and waste metals etc. in order to establish standard, professional and environment-protecting selection and processing centers.
(c) Improve large distributing markets across different regions with centralized renewable resources, large trading scales and great influence, through perfecting the functions of storage, distribution, primary processing, trading and information collection, and enhancing the construction of infrastructures, environment and labor protecting facilities.
(3) Propaganda, Education and Training
All local governments shall organize the writing and compilation of training materials based on their respective local situations for training the administrative personnel, enterprise management and recovery workers in order to improve the administration level and the degree of specialization, systematization and standardization of renewable resources recovery industry.
(4) Regulate Supervision and Administration
Set up a statistic system for the recovery of renewable resources, develop the information system for the administration of the recovery of renewable resources, and make records for enterprises and the personnel in order to strengthen the supervision of renewable resources industry. The ministry of Commerce will cooperate with the Ministry of Finance to examine the construction of recovery system of renewable resources, and grant a nationwide uniform sign to the qualified projects in order to establish standard and perfect recovery system of renewable resources regularly.
The special fund of the Central finance for promoting service industry will provide some support for the construction of recovery system of renewable resources, and specific measures shall be issued separately.
3. Working Requirements
All local departments in charge of commerce shall strengthen the organization, leadership and administration on the construction of recovery system of renewable resources through guiding enterprises with the construction of operating facilities and environment and labor protecting facilities, improving technologies, and organizing trainings of the relevant personnel to promote the development of the industrialization of recovery industry; departments of finance shall communicate and cooperate with the departments of commerce to make overall arrangement of the use and management of funds to increase their utilization efficiency; to strengthen the supervision on implementation of the project and the use of the funds in order to prohibit any defraud, appropriation, retention of the funds or changing the usage of special funds at discretion. The relevant working progress is required to be promptly reported to the Ministry of Commerce (Business Service Department the Financial department) and Ministry of Finance (Economy and Construction Department).

Construction Standards of Recovery System of Renewable Resources in Pilot Cities
1. Construction standards for recovery centers of renewable resources
各省、自治区、直辖市、计划单列市商务主管部门、财政厅(局),新疆生产建设兵团商务局、财务局,有关中央企业:
为贯彻落实《国务院办公厅关于搞活流通扩大消费的意见》(国办发〔2008〕134号)要求,推行资源节约,鼓励循环消费,商务部、财政部决定加快推进再生资源回收体系建设有关工作。现通知如下:
一、原则及目标
随着我国经济的快速发展,能源和资源瓶颈问题日益凸现,再生资源回收在提高资源利用率,减少污染,保护环境方面的作用愈加重要。目前我国再生资源回收行业规模小、回收率低、技术落后、二次污染严重,部分企业和从业人员经营行为不规范等问题十分突出,与建设资源节约型、环境友好型社会的要求不相适应。因此,各地务必要从落实科学发展观的高度认识再生资源回收体系建设的重要性,把推动再生资源回收体系建设作为节能减排的重要措施,抓紧、抓实、抓出成效。
(一)指导原则
政府引导支持,企业市场化运作,以有利于提高再生资源回收利用率,有利于环境保护,有利于方便居民生活,有利于行业管理和培育规模化、规范化的龙头企业为出发点,以回收企业和集散市场为载体,立足于整合规范现有回收网络资源,通过政策支持推动改造、提升;试点先行,以点带面,实现全国再生资源回收体系建设的平稳较快发展。
(二)总体思路和目标
以城市为重点,率先选择在直辖市、计划单列市和省会城市开展试点(以下简称“试点城市”),取得经验后再逐步向地级及以下城市推开。通过完善再生资源回收的法律、标准和政策,形成再生资源回收促进体系;通过建立回收企业和从业人员培训体系,规范改造社区居民回收站点、分拣中心和集散市场,使城市90%以上回收人员纳入规范化管理,90%以上的社区设立规范的回收站点,90%以上的再生资源进入指定市场进行规范化的交易和集中处理,再生资源主要品种回收率达到80%,逐步形成符合城市建设发展规划,布局合理、网络健全、设施适用、服务功能齐全、管理科学的再生资源回收体系,实现再生资源回收的产业化。
二、主要工作
(一)建立和完善再生资源回收管理机制
各地要结合城市建设规划制定再生资源回收体系建设规划,并通过政府或立法机关发布,使之具有法律效力;制定并形成包括法律法规、标准及财税、土地等政策在内的再生资源回收促进体系;建立对再生资源回收体系建设指导、监督和管理的组织机构和管理制度。
(二)建立和规范再生资源回收体系
各地要选择确定承担再生资源回收体系建设的龙头企业,充分发挥龙头企业作用,在充分利用、规范和整合现有再生资源回收渠道的基础上,统一规划,合理布局,规范建设,形成以社区回收站点和分拣中心为基础,集散市场为核心,加工利用为目的的再生资源回收网络体系,逐步提高回收集散加工能力,促进再生资源行业健康、有序发展。
1.引导回收企业运用连锁经营的方式,对目前“散兵游勇”式的走街串巷回收方式进行整合和规范,按照“便于交售”的原则,合理规划布局,建设统一规划、统一标识、统一着装、统一价格、统一衡器、统一车辆、统一管理、经营规范的固定或流动社区回收点。
2.按照再生资源回收体系建设规划,提升废纸、废塑料(废饮料瓶)、废金属等主要再生资源回收品种的综合分拣加工能力,形成运营规范、专业化、符合环保要求的分拣加工中心。
3.对于再生资源集中度较高、交易规模较大、有较好基础、具有一定的区域辐射能力的大型跨地区的集散市场要进行规范和提升,完善其储存、集散、初级加工、交易、信息收集发布等功能,加强拆解、仓储等基础设施、环境保护设施和劳动保护设施等方面的建设。
(三)宣传教育培训
各地要根据本地的实际情况,组织编写相应的培训教材,对行政管理人员、企业管理人员和回收拆解工人进行培训,提高再生资源回收行业的管理水平和专业化、组织化、规范化程度。
(四)规范行业监督管理
建立再生资源回收统计制度,开发、完善再生资源管理信息系统,扎实推进企业及从业人员备案工作,加强对行业的监管。商务部将会同财政部对再生资源回收体系建设进行阶段性审核验收,对符合验收规范的项目,授权使用全国统一的再生资源回收体系标识,逐步形成规范完善的再生资源回收体系。
中央财政促进服务业发展专项资金将对再生资源回收体系建设给予支持,具体办法另发。
三、工作要求
各地商务主管部门要加强对再生资源回收体系建设的组织领导与管理,指导企业完善经营设施、环境保护和劳动保护设施建设,提升技术水平,组织相关从业人员培训,推动回收行业的产业化发展;财政部门要与商务主管部门加强沟通与协调,统筹安排资金使用与管理,提高资金使用效率;要加强对项目执行和资金落实情况的监督、检查工作,严禁任何单位骗取、挪用、截留资金,或擅自改变专项资金用途。有关工作进展情况请及时报商务部(商贸服务司、财务司)、财政部(经济建设司)。

试点城市再生资源回收体系建设规范
一、再生资源回收站(点)建设规范
Article 1 The recovery centers shall be constructed strictly according to the requirements of "seven uniforms and one standard" (uniform planning, uniform sign, uniform dressing, uniform price, uniform measurement, uniform vehicles and uniform management and regulated operation).
第一条 严格按照“七统一、一规范”(统一规划、标识、着装、价格、计量、车辆、管理及经营规范)的要求进行建设。
Article 2 The recovery centers shall have a business license or other qualifications, and the principal shall have individual identification certificate without any records of crime.
第二条 回收站(点)经营证照及资质齐全,负责人有个人身份证明资料,无违法犯罪记录。
Article 3 According to the principle of "convenience for delivery and sale", one recovery center shall be maintained for each 2000 residents in cities, and one center shall be maintained for each 2500 residents in countries and villages.
第三条 按照“便于交售”的原则,城区每2000户居民设置1个回收站(点);乡、镇每2500户居民设置1个回收站(点)。
Article 4 The area of the recovery center shall not exceed 10 m² in principle, and its signboard shall use the uniform name and design.
第四条 回收站(点)面积原则上不少于10平方米,门面招牌采用统一规范的站名和设计。
Article 5 The construction of recovery centers shall conform to the local general urban planning; and the design and decoration shall be compatible with the environment of the community. The recovery center shall use green and light constructing materials and conduct completely closed processing.
第五条 回收站(点)建设要符合当地城市总体规划,设计及装修与社区环境相符,社区回收站(点)采用绿色环保轻型建筑材料进行全封闭处理。
Article 6 The personnel of the recovery center in communities shall undergo training and study and obtain certificate for the work.
第六条 社区回收站(点)的从业人员须经过培训学习,持证上岗。
Article 7 The recovery center shall not affect the local city appearance, environment and sanitation, have proper sewage facilities and shall comply with the local requirements for environment protection.
第七条 不影响当地市容市貌和环境卫生,排污设施完善,符合当地的环境保护要求。
Article 8 Closed transport equipment shall be used for the transfer from recovery centers in communities to transfer centers and to distributing markets.
第八条 社区回收站(点)至中转站至再生资源集散市场间配备相应的封闭式运输设备。
Article 9 It shall be ensured that renewable resources be transported out of the community in time to avoid secondary pollution and fire hazards and ensure the recovery center are equipped with fire control facilities.
2. Construction standards for distributing markets of renewable resources
According to the requirement of integrated functions of the network system, the market shall be composed of "five zones and one center": goods trading zone, selecting and processing zone, storage and distributing zone, goods display zone, services zone and training center.
Article 1 The location of distributing markets of renewable resources shall be selected in nearby suburban areas with convenient transportation and complete infrastructure, on the premises conforming to the general plan of the city, the utilization plan of the land and the plan for preventing pollution.
Article 2 The planning, design and construction of the distributing markets of renewable resources shall comply with the standards of environment protection, city appearance and fire control. The market shall have separation walls and green parks to maintain nice environment.
Article 3 The market shall possess functions of distribution, trading, storage, and primary processing and pollution reduction and match the comprehensive utilization of renewable resources. The processing zones, trading zones and storage and distributing zones shall be separated from the service zones and office zones. The processing zones and service zones shall be equipped with facilities for environment protection and security in order to deal with the waste emission collectively and avoid secondary pollution.
Article 4 The scale of the land for the construction of distributing markets shall be determined according to state industry policies, the requirement of city plan and the total quantity of renewable resources in that region.
Article 5 The construction of distributing markets shall conform to the appraisal for environment protection and the standards of production technology ratified by environment protection authorities, and shall possess the qualification for dealing with wastes. The markets for separation and processing of easily contaminated waste shall be paved with hardening ground which can prevent the mixture or infiltration of water, rain or oils, and the processing facilities shall be surrounded with environment protection facilities for cutting or collecting the oil or other liquid and for separating water from oil.
Article 6 All zones in the market shall conform to the following requirements:
(1) Goods trading zone shall be divided according to the category of goods to realize intensive operation. Its design, decoration and construction shall comply with the local requirements of environment protection and fire control.
(2) The area of selecting and processing zone shall be determined based on the total amount of local renewable resources. Its design and decoration shall comply with the requirements of environment protection and fire control, which shall focus on preventing the diffusion of waste, the emanation of stench, polluting the ground or surroundings.
(3) The area of storage and distributing zone shall be determined based on the trading scale of the market. It shall use standard facilities and technologies for transport, storage, loading, package, and bar code etc. in order to increase the utilization rate and reduce the cost of enterprises.
(4) Goods display zone provides exhibition services for dealers in the market, and its design and decoration should be modern and technical.
(5) Information center is in charge of the statistics of the information about trading and processing in the market and shall publish the domestic or foreign supply and demand information for renewable resources regularly, as well as provide information services for recovery networks, all residents and enterprises. Online recovery website, hotline services and network facilities are encouraged to provide convenient services for residents, enterprises or institutions.
(6) Services zone and training center are mainly responsible for providing training and other services, and shall be constructed according to the requirements of fire control and environment protection.
All above zones shall start operation after passing the examination and obtaining the approval by relevant authorities according to related laws, regulations and provisions.
第九条 保证社区回收站(点)再生资源能及时运出,避免造成新的环境污染和火灾隐患,同时配备消防安全设施,符合消防安全管理规定要求。
二、再生资源集散市场建设规范
根据网络体系整体功能配置要求,市场应由“五区一中心”构成,即:商品交易区、分拣加工区、仓储配送区、商品展示区、配套服务区和培训中心。
第一条 再生资源集散市场的设置应在符合城市总体规划、土地利用总体规划和当地固体废物污染防治规划的前提下,在交通便利、基础设施齐全的近郊地区选址。
第二条 再生资源集散市场规划、设计及建设要符合环保、市容和消防安全等标准,设有隔离围墙,园区绿化,保持较好的外观环境。
第三条 市场要完善集散、交易、储存、初加工、治污减排等功能,并与再生资源综合利用相配套。市场内加工区、交易区、仓储配送区与服务区、办公区分离,加工区与交易区配备相应的环保、安全等作业设施,集中治理废弃物排放,消除二次污染。
第四条 市场的建设用地规模根据国家产业政策、城市规划要求和当地再生资源总量确定,集约用地。
第五条 市场建设要符合环保部门环保评估及生产技术标准的资质认定,具备相关废弃物的处理资质。开展易污染废物拆解加工的市场内应铺设具有防止地面水、雨水及油类混入或渗透功能的硬化地面,处理设施周围应有油类或液体的截流、收集及油水分离的环保设施或措施。
第六条 市场内各区域须符合以下要求:
1.商品交易区应依交易产品种类进行细分,形成集约化经营,整体设计、装修及建设要符合当地环保及消防的管理要求。
2.分拣加工区建筑面积根据当地再生资源总量而定,采用轻型建筑材料进行全封闭处理,在设计、装修方面必须符合环保及消防的要求,着重防止废弃物溢散、散发恶臭、污染地面及影响四周环境。
3.仓储配送区建筑面积根据市场交易量而定,采用标准化、系列化、规范化的运输、仓储、装卸、搬运、包装机具设施及条形码等技术。提高整体资源利用率,降低企业运作成本。
4.商品展示区在设计与装修上以现代化、科技化为标准,为场内交易提供商品展示服务。
5.信息中心负责场内交易、加工等信息的统计,定期发布国内外再生资源供求信息,为当地再生资源回收各网点以及全市居民与企业提供信息服务。鼓励设立在线收废网站、统一公开的服务电话及互联网络设施,以方便居民及企事业单位预约投售。
6.配套服务区与培训中心以培训及其他服务功能为主,按照消防、环保管理要求进行施工建设。
以上各区域应按有关法律、法规和规定,经有关部门验收、批准后运营。
