  Article 1   For the purposes of supporting and promoting the disposal and recycle of construction wastes in the Wenchuan Earthquake and implementing the Circular of the State Council on Printing and Distributing the Comprehensive Program for Energy Conservation and Emission Reduction (Guo Fa [2007] No. 15), the government finance shall arrange special funds to support the production and promotion of renewable and energy efficient construction materials. These Measures are herby formulated for the purpose of enhancing the administration of such funds.

       第一条  为支持推动汶川大地震建筑垃圾处理与再生利用,贯彻落实《国务院关于印发节能减排综合性工作方案的通知》(国发[2007]15号)精神,国家财政将安排资金专项用于支持再生节能建筑材料生产与推广利用。为加强该项资金管理,特制定本办法。

  Article 2   For the purpose of these Measures, "renewable and energy efficient construction materials" means renewable and new energy efficient construction materials produced from wastes (e.g., construction wastes). "Financial subsidy for promotion of renewable and energy efficient construction materials" (hereinafter referred to as the "subsidy funds") shall refer to funds specifically arranged by the Central finance to support production and promotion of renewable and energy efficient construction materials.

       第二条  本办法所称“再生节能建筑材料”是指利用建筑垃圾等废弃物生产的再生建材以及新型节能建材。本办法所称“再生节能建筑材料推广利用财政补助资金”(以下简称补助资金)是指中央财政安排的专项用于支持再生节能建筑材料生产与推广利用方面的资金。

  Article 3    The subsidy funds shall be mainly used for the following: interest subsidy for loans granted for enterprises of renewable and energy efficient construction materials to expand production capacity, rewards for promotion of renewable and energy efficient construction materials, research and formulation of relevant technical standards and speculations and expenses approved by the Ministry of Finance concerning production and promotion of renewable and energy efficient construction materials.

       第三条  补助资金使用范围主要包括:再生节能建筑材料企业扩大产能贷款贴息;再生节能建筑材料推广利用奖励;相关技术标准、规范研究与制定;财政部批准的与再生节能建筑材料生产利用相关的支出。

  Article 4   Interest subsidy funds granted by the Central Finance shall be determined according to the actual amount needed for the expansion of production capacity of renewable and energy efficient construction materials and the benchmark lending interest rate of the People's Bank of China for the same period. Where the loan term does not exceed three years, interest subsidy funds shall be provided according to the actual length of such term; where the term exceeds three years, interest subsidy funds shall be provided for three years. Enterprises of renewable and energy efficient construction materials applying for interest subsidy funds granted by the Central Finance shall satify relevant techinical and economic requirements. Specific conditions shall be promulgated by the Ministry of Housing and Urban-Rural Development and the Ministry of Finance. Enterprises satisfying relevant requirements may apply to local finance departments for capitals. Finance departments and construction departments at provincial level shall be responsible for examining the conditions of the applying enterprises and verify the interest subsidy funds applied by the enterprises based on the loan contract and interest payment vouchers. The interest subsidy term shall be from June 29 of the previous year to June 30 of this year. The Ministry of Finance shall organize local financial supervisory commissioner's office to supervise and investigate the implementation of subsidy funds from time to time.

       第四条  中央财政贴息资金将按再生节能建材生产企业扩大产能实际贷款额及中国人民银行同期贷款基准利率计算。贷款期限不长于3年的,按实际贷款期限贴息;贷款期限长于3年的,按3年贴息。申请中央财政贴息资金的再生节能建筑材料生产企业需满足技术、经济等相关条件,具体条件由住房城乡建设部会同财政部发布。符合相关条件的企业均可向当地财政部门申请资金,省级财政部门会同建设部门负责对申报企业的相关条件进行审核,并根据贷款合同及结息凭证等,对企业申报的贴息资金予以审核确认。贴息期为上年的6月29日至本年的6月30日。财政部将不定期地组织财政部驻各地财政监察专员办事处对补助资金申报落实情况进行监督检查。

  Article 5   Meaures for rewarding the promotion of renewable and energy efficient construction materials shall be otherwise formulated.

       第五条  再生节能建筑材料推广利用奖励办法另行制订。

  Article 6   Administration of the payment of subsify funds shall be subject to relevant provisions on the treasury management system.

       第六条  补助资金支付管理按照财政国库管理制度有关规定执行。

  Article 7   Departments of finance and construction at all levels shall enhance the administration of subsidy funds to ensure such funds to be used for special purposes. Any falsification, false claim, interception and embezzlement of subsidy funds shall be prosecuted in accordance with relevant State provisions once ascertained.

       第七条  各级财政、建设部门要切实加强补助资金的管理,确保补助资金专款专用。对弄虚作假、冒领、截留、挪用补助资金的,一经查实,按照国家有关规定进行处理。

  Article 8   The Ministry of Finance shall be responsible for the interpretation of these Measures.

       第八条  本办法由财政部负责解释。

  Article 9   These Meausres shall come into force as of the date of its printing and distributing.

       第九条  本办法自印发之日起施行。
