To the finance bureaus of all the districts and counties: 

In order to implement the provisions of the Notice of the Shanghai Municipal People's Government on Announcing the Fourth Batch of Administrative Examination and Approval Items to Be Cancelled and Adjusted in Shanghai Municipality (Hu Fu Fa [2009] No. 68) (hereinafter referred to as the "Notice"), the following notice on delegating the power on examining and approving the early recovery of investment by foreign investors of Sino-foreign cooperative joint ventures and follow-up administration is hereby issued:

    各区县财政局:

    为贯彻执行《上海市人民政府关于公布本市第四批取消和调整行政审批事项的通知》(沪府发〔2009〕68号)(以下简称《通知》)的规定,现就下放中外合作经营企业外国投资者提前收回投资审批及后续管理工作通知如下:

1. The Notice provides that for the purpose of promoting the reform of the administrative examination and approval system of this municipality, the power on examining and approving the early recovery of investment by foreign investors of Sino-foreign cooperative joint ventures which is previously held by the Shanghai Municipal Finance Bureaus is delegated to the finance bureaus of the districts and counties.

       一、《通知》规定,为推进本市行政审批制度改革,原由市财政局审批的中外合作经营企业外国合作者提前收回投资审批下放到各区县财政局审批。

2. When examining and approving the early recovery of investment by foreign investors of Sino-foreign cooperative joint ventures, the finance bureaus of all the districts and counties shall strictly implement the provisions of the Measures for Examination and Approval of the Early Recovery of Investment by the Foreign Party to a Sino-Foreign Cooperative Joint Venture Enterprise promulgated by the Ministry of Finance (Decree No. 28 of the Ministry of Finance) and the Notice on Forwarding the "Notice of the Ministry of Finance on the Issues Concerning the Early Recovery of Investment by the Foreign Party to a Sino-Foreign Cooperative Joint Venture Enterprise" (Hu Cai Qi [2008] No. 34) issued by the Shanghai Municipal Finance Bureau.

       二、各区县财政局对中外合作经营企业外国投资者提前收回投资的审批,应严格执行财政部《中外合作经营企业外国合作者先行回收投资审批办法》(财政部令第28号)和上海市财政局《关于转发<财政部关于中外合作经营企业外方合作者先行回收投资有关问题的通知>的通知》(沪财企〔2008〕34号)文件规定。

3. After approving the application for the early recovery of investment made by a foreign investor of the Sino-foreign cooperative joint venture, the finance bureau of a district or county shall submit to the enterprise division of the Shanghai Municipal Finance Bureau its approval reply and the letter of undertaking submitted by the cooperative joint venture and the foreign investor thereof, which shall be forwarded by the Shanghai Municipal Finance Bureau to the competent departments of commerce and foreign exchange of Shanghai Municipality. The Shanghai Municipal Finance Bureau shall, based on the actual need, supervise and examine the examination and approval work conducted by the finance bureaus of all the districts and counties.

       三、各区县财政局对中外合作经营企业外国投资者提前收回投资的申请批准后，应将其批复及合作企业和外国投资者报送的承诺函送市财政局企业处，由市财政局转送市商务及外汇主管部门。市财政局将根据工作需要，就各区县财政局开展该审批工作的有关情况进行监督检查。
