Chapter I General Provisions
第一章 总则
Article 1 For the purposes of strengthening the supervision and administration of the invitation and submission of tenders for the construction projects of governmental investment, improving the proficiency of inviting tenders, reducing social costs, choosing contracting entities on the basis of comparative selection, guaranteeing quality safety of the projects, and promoting a fundamental turn for the better in the construction market order, These Measures are formulated in accordance with Act of the People’s Republic of China on Invitation and Submission of Tenders and other laws and regulations and in consideration of the local situation of Suzhou City.
第一条 为加强对政府投资建筑工程招标投标的监督管理,提高招标效率,降低社会成本,优选承包单位,保证工程质量安全,促进建筑市场秩序的根本好转,根据《中华人民共和国招标投标法》等法律、法规,结合本市实际,制定本办法。
Article 2 For the purpose of These Measures, the governmental investment shall refer to the investment of the following kinds of capital: (1) the capital arranged by the financial budgets of the governments at all levels; (2) the special capital (fund) incorporated into the financial administration; (3) the capital of government financing or national bonds; (4) the loans and grants from the international financial organizations and foreign governments; and (5) other kinds of governmental capital.
第二条 本办法所称政府投资是指下列资金的投资:(一)各级财政预算安排的资金;(二)纳入财政管理的专项资金(基金);(三)政府融资以及利用国债的资金;(四)国际金融组织和外国政府的贷款、赠款;(五)其他政府资金。
Article 3 For the purpose of These Measures, the construction projects shall refer to the projects of house building and the projects of municipal infrastructures. The projects of house building shall refer to the projects of building all kinds of houses and their ancillary facilities, the projects of installing the lines, pipes, and equipments assorted therewith, and the projects of fitting and decorating the inside and outside of the rooms. The projects of municipal infrastructures shall refer to the projects of earthwork and installation of pipes and equipments in the construction of urban roads, public transport, water supply, water drainage, gas supply, heat supply, gardening and forestation, environmental sanitation, sewage disposal, garbage disposal, flood prevention, underground public facilities and the ancillary facilities.
第三条 本办法所称建筑工程是指房屋建筑和市政基础设施工程。房屋建筑工程是指各类房屋建筑及其附属设施和与其配套的线路、管道、设备安装工程及室内外装饰装修工程。市政基础设施工程是指城市道路、公共交通、供水、排水、燃气、热力、园林绿化、环卫、污水处理、垃圾处理、防洪、地下公共设施及附属设施的土建、管道、设备安装工程。
Article 4 These Measures shall apply to the pre-selection of the contractors for the construction projects of governmental investment in the administrative jurisdiction of Suzhou City and the administration thereof.
第四条 本市行政区域内政府投资建筑工程承包商的预选及其管理适用本办法。
Article 5 The Committee for Membership Qualification of the pre-selected contractors for the construction projects of governmental investment in Suzhou City (hereinafter referred to as the Committee) shall be established, with the leaders of the city government as the chairmen, and the leaders of the city development and reform, supervision, finance, housing and urban-rural development, urban sanitation and administration, transport, water conservation (waterworks), gardening and forestation, auditing, legality, state taxation, local taxation, industry and commerce, and the governments of all cities and districts, the administration committees of Suzhou Industrial Park and Suzhou High-tech Development Zone as the members to take charge of examining and publishing the directories of the contractors applying for undertaking the construction projects of governmental investment (hereinafter referred to as the directories). The corresponding committees for membership qualification of the pre-selected contractors may be established in the cities at the county level to take charge of examining and publishing the supplementary directories of the pre-selected contractors for the construction projects of governmental investment in the local administrative jurisdictions and reporting to the Committee for the record. The Committee shall set up an office thereunder in the competent authority of construction administration to take charge of the pre-examination and administration of the directories.
第五条 成立苏州市政府投资建筑工程预选承包商资格审查委员会(以下简称市委员会),由市政府领导任主任,市发展和改革、监察、财政、住房和城乡建设、市容市政、交通运输、水利(水务)、园林和绿化、审计、法制、国税、地税、工商和各市、区政府,苏州工业园区、苏州高新区管委会领导为成员,负责对申请承接政府投资建筑工程的承包商名录(以下简称名录)的审定和发布。县级市可以设立相应的预选承包商资格审查委员会,负责本辖区政府投资建筑工程预选承包商补充名录的审定和发布,并报市委员会备案。委员会下设办公室,办公室设在建设行政主管部门,负责名录的初审和管理。
Article 6 The Committee shall determine the directories according to the principles of openness, fairness, impartiality, and comparative selection, standardize the compilation and administration of the directories, and ensure the impartiality, scientificity and practicability of the directories.
第六条 委员会应当按照公开、公平、公正、择优的原则确定名录,规范名录的编制和管理,保证其公正性、科学性和实用性。
Article7 The construction entities of the construction projects of governmental investment shall choose tenderers or contractors from the directories. If it is under one of the following circumstances, the construction entities may do otherwise but they shall make explanations to the local office of the Committee at the place of the projects: (1) there is no contractor of the corresponding type in the directories temporarily; (2) there are fewer than 9 contractors in the directories responding to the invitation of tenders or meeting the conditions; and (3) there are two failures in the invitation of tenders from the contractors in the directories.
第七条 政府投资建筑工程的建设单位应当从名录中选择投标人或承包人。有下列情形之一的可除外,但应当向项目所在地的委员会办公室说明:(一)名录中暂无相应类别承包商的;(二)名录中响应招标或符合条件的承包商达不到9家的;(三)向名录内的承包商招标两次失败的。
Article 8 The tenderees of the construction projects of governmental investment shall identify in the tender announcement the types and groups of the tenderers recorded in the directories. The tenderees may, according to the characteristics, scales, complexity, and profession requirements of the projects, set the achievements of the tenderers (or constructors) in the projects of the same type as the qualification condition for the contractors, and implement the post-qualification examination. The tenderees shall not set any other restrictions.
第八条 政府投资建筑工程的招标人应当在招标公告中明确投标人在名录中所属的类别和组别。招标人根据项目特点、规模、复杂程度、专业要求的不同,招标人可以设置投标人(或建造师)具有同类工程业绩作为承包商资格条件,实行资格后审。招标人不得设置其他限制条件。
Article 9 For the oversized projects of municipal infrastructures and house building, the tenderees may choose tenderers other than the pre-selected contractors upon the application of the tenderees and the approval of the Committee. The tenderees may set appropriate conditions and adopt the way of pre-qualification examination to determine the potential tenderers so as to introduce the high-level and competitive construction enterprises into the local construction market of Suzhou City.
第九条 特大型的市政基础设施和房屋建设工程,经招标人申请、委员会同意,可以不在预选承包商中选取投标人。招标人可以设置适当条件,采用资格预审方式确定潜在投标人,以引进有实力、高水平的建筑企业进入本市建设市场。
Chapter II Classification of Directories
第二章 名录分类
Article 10 The directories shall be classified into the directory of construction contractors (including the general contractors and specialty contractors), the directory of project consultant contractors (including the contractors responsible for the survey, design, supervision, cost consultation, tendering agency, project construction agency, etc of the construction projects) and the directory of the suppliers of equipments and materials. At present there are temporally 5 types of directories of general contractors of house building projects, general contractors of municipal public projects (excluding rail transport), specialty contractors of architectural decoration, specialty contractors of gardening and forestation, and specialty contractors of tendering agency for construction projects. The Committee shall formulate the standards for the specific conditions, grading rules, admission quota, and project achievements of the pre-selected contractors for the construction projects of governmental investment, and organize the implementation thereof.
第十条 名录分施工承包商(包括工程总承包、工程专业承包商)名录、工程顾问承包商(包括建筑工程的勘察设计、监理、造价咨询、招标代理、项目代建等承包商)名录、设备及材料供应商名录。目前暂设房屋建筑工程总承包、市政公用工程总承包(不含轨道交通)、建筑装饰专业、园林绿化专业和建筑工程招标代理等五个类别的名录。对政府投资建筑工程预选承包商的具体条件、评分细则、录取名额以及工程业绩标准等,由委员会制定并组织实施。
Article 11 The directory of general contractors shall be divided into Groups I, II, and III according to the qualification level and the business scope: (1) the contractors of Group I shall have the qualification of general construction contracting enterprises of Special Level or Level 1, and may undertake the projects within the business scope as allowed by the enterprise qualification; (2) the contractors of Group II shall have the corresponding qualification of general construction contracting enterprises of Level 2 or higher, and may undertake the projects within the business scope as allowed by the enterprise qualification of Level 2; and (3) the contractors of Group III shall have the corresponding qualification of general construction contracting enterprises of Level 3 or higher, and may undertake the projects within the business scope as allowed by the enterprise qualification of Level 3.
第十一条 工程总承包商名录根据资质等级和承接业务范围的不同,分为Ⅰ、Ⅱ、Ⅲ组:(一)Ⅰ组承包商应具有相应的特级或壹级施工总承包企业资质,可承接企业资质营业范围内的工程;(二)Ⅱ组承包商应具有相应的贰级或贰级以上施工总承包企业资质,可承接贰级企业资质营业范围内的工程;(三)Ⅲ组承包商应具有相应的叁级或叁级以上施工总承包企业资质,可承接叁级企业资质营业范围内的工程。
Article 12 The directory of specialty contractors shall be divided into Groups I, II, and III according to the qualification level and the business scope: (1) the contractors of Group I shall have the corresponding qualification of specialty construction contracting enterprises of Level 1, and may undertake the projects within the business scope as allowed by the enterprise qualification; (2) the contractors of Group II shall have the corresponding qualification of specialty construction contracting enterprises of Level 2 or higher, and may undertake the projects within the business scope as allowed by the enterprise qualification of Level 2; and (3) the contractors of Group III shall have the corresponding qualification of specialty construction contracting enterprises of Level 3 or higher, and may undertake the projects within the business scope as allowed by the enterprise qualification of Level 3.
第十二条 工程专业承包商名录根据资质等级和承接业务范围的不同,分为Ⅰ、Ⅱ、Ⅲ组。(一)Ⅰ组承包商应具有相应的壹级专业承包企业资质,可承接企业营业范围内的工程;(二)Ⅱ组承包商应具有相应的贰级或贰级以上专业承包企业资质,可承接贰级企业资质营业范围内的工程;(三)Ⅲ组承包商应具有相应的叁级或叁级以上专业承包企业资质,可承接叁级企业资质营业范围内的工程。
Article 13 The directory of the contractors responsible for the tendering agency for construction projects shall be divided into Groups I and II according to the qualification level and the business scope: (1) the contractors of Group I shall have the corresponding qualification of tendering agency of Level A, and may undertake the projects within the business scope as allowed by the enterprise qualification; and (2) the contractors of Group II shall have the corresponding qualification of tendering agency of Level B or higher or the temporary level, and may undertake the projects within the business scope as allowed by the enterprise qualification of Level B or the temporary level.
第十三条 建筑工程招标代理机构名录根据资格等级和承接业务范围的不同,分为Ⅰ、Ⅱ组。(一)Ⅰ组承包商应具有相应的甲级招标代理资格,可承接其企业资格营业范围内的工程;(二)Ⅱ组承包商应具有相应的乙级以上或暂定级招标代理资格,可承接乙级或暂定级企业资格范围内的工程;
Chapter III Application and Admission
第三章 申请与录取
Article 14 The Committee shall intensively accept the applications for entering the directories once each year, and examine and approve the name lists of the contractors entering the directories.
第十四条 委员会每年一次集中受理加入名录的申请,审查确定进入名录的承包商名单。
Article 15 The contractors may, according to their conditions, apply for entering the corresponding types and groups in the directories, and each qualification may only apply for one group of the corresponding type.
第十五条 承包商可以根据其条件申请加入名录相应的类别和组别,且每项资质只能申请相应类别中的一个组别。
Article 16 The Committee shall, according to the scale of the construction projects, determine the quota of the contractors of all groups in the directories each year. Among the contractors applying for entering a certain group in the directories, if the number of the applicants meeting the basic conditions for the pre-selected contractors of this group is smaller than the quota set by the Committee, the qualified applicants may directly enter the directories; if the number of the qualified applicants meeting the basic conditions for the pre-selected contractors of this group is larger than the quota set by the Committee, the Committee shall carry out comprehensive grading and comparative admission on the applicants meeting the conditions. The enterprises applying for entering the higher group in the directories but failing to be admitted may apply to enter the lower group according to the principle of grades in descending order with the prerequisite that the quota of the lower group is not fully occupied.
第十六条 委员会每年根据工程建设规模确定名录内各组别承包商的名额。在申请加入名录某一组别的承包商中,符合该组别预选承包商基本条件的申请人少于委员会规定的名额时,合格申请人可以直接进入名录;符合该组别预选承包商基本条件的合格申请人多于委员会规定名额的,委员会应当对符合条件的申请人进行综合评分,择优录取。申请高组别名录的企业,未被录入的,可在其低一级组别名额不满前提下,按照评分由高到低原则,申请加入该组别。
Article 17 The “Comprehensive grading and comparative admission” shall refer to the process that the Committee calculates the grades of the contractors’ project achievements, capability of contract performance, project quality, safety management, discipline and law compliance, honesty and integrity, emergency rescue and disaster relief, amount of tax payment, special contributions, and other indicators according to the detailed rules as stated, and admit the contractors according to their grades in descending order.
第十七条 “综合评分、择优录取”是指委员会对承包商的工程业绩、履约能力、工程质量、安全管理、遵纪守法、诚实守信、抢险救灾、纳税额度、特殊贡献等指标,按规定细则进行分值计算,根据评分排名高低,按名次录取。
Article 18 The work of application and admission shall be carried out according to the following procedures: (1) the office of the Committee shall publish the notice of acceptance of the applications and announce the ways of admission, the detailed rules of comprehensive grading, and other relevant matters on the government website of the competent authority of construction administration, the website of http://www.bidchance.com and the website of http://www.ccgp.gov.cn; (2) the applicants shall submit the application materials to the office of the Committee within the stated time period, which shall include: (a) the application form; (b) the duplicate business license; (c) the qualification certificate, the safety production license (the enterprises of gardening and forestation and the enterprises of tendering agency not needed to provide), or the relevant certification documents; (d) the certification of at least 2 project achievements corresponding to the applied type and group within Suzhou City during the 2 years before the application; (e) the non-local enterprises’ contracts of leasing or purchasing office places in Suzhou City, the certificates of the registered constructors and other professionals and technicians, the management system of the company, and other materials; (f) the certification of tax payment in Suzhou City during the previous 2 years; and (g) other materials which the applicants think may be submitted (such as the award certificates); (3) the office of the Committee shall organize the member entities and relevant experts to examine the application materials and calculate the comprehensive grades; (4) the Committee shall hold a plenary meeting to determine the name lists of the pre-selected contractors to be listed in the directories, and keep the name lists of the pre-selected contractors on the government website of the Bureau of Housing and Urban-Rural Development of Suzhou City, the website of http://www.bidchance.com and the website of http://www.ccgp.gov.cn for 10 working days of publicity; and (5) if there is no objection at the expiration of the period of publicity, the Committee shall determine the name lists of the contractors to be listed in the directories, and publish them on the government website of Bureau of Housing and Urban-Rural Development of Suzhou City, the website of http://www.bidchance.com and the website of http://www.ccgp.gov.cn.
第十八条 申请与录取工作按下列程序进行:(一)委员会办公室在建设行政主管部门政务网站、中国招标网、中国政府采购网向全国发布受理申请通知,并公布录取的方式、方法、综合评分细则及其他有关事项;(二)申请人在规定的时间内向委员会办公室报送申请材料,材料包括:(1)申请表;(2)工商营业执照副本;(3)资质证书、安全生产许可证书(园林绿化、招标代理企业不提供)或有关证明文件;(4)在申请前两个年度内,不少于2项在苏州市范围内相对应申请类别和组别的工程业绩证明;(5)外地企业驻苏州市的办公场所租赁或购买合同、注册建造师及其他专业技术人员证书、公司管理制度等材料;(6)前两年度在苏州市纳税的证明;(7)申请人认为可以提交的其他材料(如获奖证书等)。(三)委员会办公室组织成员单位及有关专家审查申请材料,计算综合评分;(四)委员会召开全体会议确定列入名录的承包商初选名单,并将初选名单在苏州市住房和城乡建设局政务网站、中国招标网、中国政府采购网上公示10个工作日;(五)公示期满无异议的,委员会确定列入名录的承包商名单,并在苏州市住房和城乡建设局政务网站、中国招标网、中国政府采购网上公布。
Article 19 The Committee shall finish the examination and determine the name lists within 45 working days since the acceptance of the application materials. If the Committee fails to finish the work on time because of accidents, the time limit may be extended by 15 working days upon the approval of the chairman or vice-chairman of the Committee.
第十九条 委员会应当在截至受理申请材料后45个工作日内完成审查,确定名录名单。因故未能按时完成的,经委员会主任或副主任批准可延长15个工作日。
Article 20 If a contractor has one of the following circumstances during the year before the intensive acceptance of the applications for being a pre-selected contractor, it shall not be listed in the directories: (1) the contractor is announced by Ministry of Housing and Urban-Rural Development of the State, Department of Housing and Urban-Rural Development of Jiangsu Province, and Bureau of Housing and Urban-Rural Development of Suzhou City because of the bad influences caused by the default on the rural migrant workers’ wages and the default on the sub-contractors’ construction cost; (2) the contractor is subject to administrative sanctions or criminal punishments because of bribe-offering, collusive tendering, sub-contracting, tax dodge, tax evasion, or tax fraud, etc; (3) the contractor is evaluated as Type C or Type D according to Measures for Comprehensive Evaluation of Construction Enterprises in Suzhou City; and (4) the contractor is subject to the punishment of suspension of tendering by Ministry of Housing and Urban-Rural Development of the State, Department of Housing and Urban-Rural Development of Jiangsu Province, or the competent authority of construction administration of Suzhou City because of violation of laws and regulations.
第二十条 集中受理预选承包商申请前一个年度周期内承包商有下列情形之一的,不予列入名录:(一)因拖欠民工工资、拖欠分包商工程款造成恶劣影响被国家住房和城乡建设部、江苏省住房和城乡建设厅、苏州市住房和城乡建设局通报的;(二)因行贿、串通投标、转包或偷、逃、骗税等而受到行政处罚或刑事制裁的;(三)按《苏州市建筑施工企业综合考评办法》被评为C类、D类的;(四)因违反法律法规受到国家住房和城乡建设部、江苏省住房和城乡建设厅或者本市建设行政主管部门处罚被停止投标的。
Article 21 The applicants which conceive the facts and/or resort to deception during the application shall not be listed in the directories, and their applications for entering the directories shall not be accepted within two years.
第二十一条 对于申请时隐瞒真相、弄虚作假的申请人,不予列入名录,并在两年内不接受其加入名录的申请。
Chapter IV Supervision and Administration
第四章 监督管理
Article 22 The contractors entering the directories shall fulfill the following obligations: (1) obeying the laws, regulations and policies of the State, complying with the social morals, and consciously maintaining the construction market order; (2) earnestly participating in the tender competition for the construction projects of governmental investment; (3) following the principle of honesty and integrity, ensuring the project team at the time of tendering to be in position, and conscientiously performing the contracts for construction projects; (4) participating in no collusive tendering, sub-contracting, affiliation, or other law-breaking and rule-breaking acts, and seeking no interests by bribe-offering, bribe-taking, or other illegal means; (5) cooperating well with the construction entities, and providing high-quality and highly-effective services; and (6) actively participating in the emergency rescue and disaster relief and other social activities for public welfare organized by the governmental departments.
第二十二条 加入名录的承包商应当履行下列义务:(一)遵守国家法律、法规和政策,遵守社会公德,自觉维护建筑市场秩序;(二)认真参加政府投资建筑工程的投标竞争;(三)遵守诚实信用原则,保证投标时的项目班子到位,认真履行建设工程合同;(四)不参与串通投标、转包、挂靠等违法违规行为,不以行贿、受贿等非法手段谋取利益;(五)与建设单位良好合作,并提供优质、高效服务;(六)积极参加政府部门组织的抢险救灾等社会公益活动。
Article 23 The construction entities shall fulfill the following obligations: (1) earnestly performing the contracts for construction projects, and paying the construction cost in full and on time according to the clauses agreed in the contracts; (2) participating in no collusive tendering, and receiving or accepting no illegal interests; and (3) evaluating the contractors’ daily performance of contract according to the regulations.
第二十三条 建设单位应当履行下列义务:(一)认真履行建设工程合同,按照合同约定及时足额支付工程款;(二)不得参与串通投标,不得收受非法利益;(三)按规定对承包商的日常履约情况进行评价。
Article 24 The evaluation of the construction entities on the contractors’ performance of contract shall be the basis of the admission and evaluation of the pre-selected contractors. The construction entities shall, at the same time when applying for the record of inspection and acceptance of the completed construction projects, submit the evaluation reports about the contractors’ daily performance of contract to the competent authority of construction administration. The construction entities of the projects under construction shall regularly submit the reports about the contractors’ performance of contract to the competent authority of construction administration.
第二十四条 建设单位对承包商履约评价将作为预选承包商录用、评判的依据。建设单位应在申办工程竣工验收备案的同时,向建设行政主管部门提交对承包商日常履约情况的评价报告。在建项目的建设单位应按期向建设行政主管部门提交承包商履约情况的报告。
Article 25 If the qualification level of a contractor entering the directories changes, the contractor shall timely report to the office of the Committee. If the contractor fails to meet the conditions of the original group because of the lowering of its qualification level, the office of the Committee shall adjust it to the group corresponded thereto.
第二十五条 加入名录的承包商资质等级发生变化的,应当及时报告委员会办公室。因其资质等级降低达不到承包商所在组别条件的,委员会办公室应相应调整其组别。
Article 26 If a contractor has one of the following circumstances, the office of the Committee shall notify the tenderee of refusing the contractor’s tender within 6 months since the emergence of the prescribed circumstance: (1) the contractor fails 3 times to submit the tender after passing the pre-examination without proper reasons within 1 year; and (2) the contractor fails or refuses to carry out the projects it wins in the tendering because of its own reasons.
第二十六条 承包商有下列情形之一的,委员会办公室应通报招标人在规定情形出现后的6个月内拒绝其投标:(一)在一年内入围后无故不递交标书次数达到3次的;(二)因自身原因未能实施或拒绝实施中标工程的。
Article 27 If a contractor has one of the following circumstances within 1 year since the day of entering the directories, the office of the Committee may request the Committee to move it to the lower group; if the contractor belongs to the lowest group, the office of the Committee may request the Committee to remove it from the directories: (1) the contractor is evaluated as unqualified twice or more in the evaluation of performance of contract; and (2) the contractor is announced 3 times or more because of bad acts by the competent authority of construction administration at the county level or higher.
第二十七条 承包商自加入名录之日起一年内有下列情形之一的,委员会办公室可提请委员会降低其组别;属于最低组别的承包商,从名录中清除:(一)2次以上履约评价评为不合格的;(二)因3次以上不良行为被我市县以上建设行政主管部门通报的。
Article 28 If a contractor entering the directories has one of the following circumstances, the office of the Committee shall request the Committee to directly remove it from the directories: (1) the contractor has one of the circumstances prescribed in Article 20 and Article 21 herein; (2) the contractor no longer meets the basic conditions for entering the directories; and (3) the contractor refuses to participate in the emergency rescue or disaster relief organized by the competent governmental departments. The business for which the contractor has signed and performed a contract before it being removed from the directories shall be continued to be finished. If laws and regulations have other provisions, such provisions shall prevail.
第二十八条 进入名录的承包商有下列情形之一的,委员会办公室应当提请委员会将其直接清出名录:(一)有本办法第二十条、第二十一条规定的情形之一的;(二)已不再具备进入名录的基本条件的;(三)拒绝参加政府主管部门组织的抢险救灾的。承包商被清出名录前已签订并履行承包合同的业务,应继续完成。法律、法规另有规定的从其规定。
Article 29 For a contractor removed from the directories, the Committee shall not accept its application for entering the directories within 2 years; for a contractor reduced to a lower group, the Committee shall not accept its application for restoring the original group or entering the higher group within 1 year.
第二十九条 对被清出名录的承包商,委员会两年内不接受其加入名录的申请;被降低组别的承包商,委员会一年内不接受其恢复原组别或更高组别的申请。
Article 30 After a contractor is removed from the directories, the vacancy may be filled according to the results of the comprehensive grading in descending order.
第三十条 承包商被清除出名录后,其缺额可按综合评分结果按顺序依次递补。
Article 31 The office of the Committee shall timely publish the name lists of the contractors reduced to the lower group, the contractors removed from the directories, and the contractors filling the vacancies on the government website of Bureau of Housing and Urban-Rural Development of Suzhou City, the website of http://www.bidchance.com and the website of http://www.ccgp.gov.cn.
第三十一条 委员会办公室应当及时将降低组别、清出名录和递补的承包商名单在苏州市住房和城乡建设局政务网站、中国招标网、中国政府采购网上公布。
Article 32 The complaints or grievances of the publicity and publishing of the directories and the treatment of the contractors may be submitted to the office of the Committee, which shall make a proposal of settlement opinions to the Committee upon investigation and verification. The Committee shall determine whether to adjust the decision of settlement according to the opinions of the office of the Committee, and the office of the Committee shall make replies to the complaints or complainants.
第三十二条 对于名录的公示、发布及承包商处理有投诉或申诉的,可向委员会办公室提出,委员会办公室经调查核实后向委员会提出处理意见。委员会根据委员会办公室意见确定是否调整处理决定,并由委员会办公室回复投诉或申诉人。
Article 33 The Committee shall formulate rules for all types of work, strictly carry out the operation according to the rules, and accept the supervision of all walks of life. The work personnel responsible for the supervision and administration of the activities of the pre-selection of the contractors, who conduct malpractice for personal gains, ask for bribes and take bribes, abuse the power or neglect the duties, shall be given administrative sanctions according to law by the disciplinary inspection and supervision organ or their competent authority; if it constitutes a crime, their criminal liabilities shall be investigated according to law.
第三十三条 委员会应制定各项工作规程,严格按规程操作,接受社会各界的监督。对预选承包商活动负有监督管理职责的工作人员徇私舞弊、索贿收贿、滥用职权或玩忽职守的,由纪检监察机关或其主管部门依法予以行政处分,构成犯罪的,依法追究刑事责任。
Chapter V Supplementary Provisions
第五章 附则
Article 34 The Committee shall gradually add the directories of contractors in other industries according to the need in the project construction. The classification, basic conditions, detailed rules of grading, etc of the added directories of contractors shall be formulated separately.
第三十四条 委员会根据工程建设需要逐步增加其他行业承包商名录。增加的承包商名录的分类、基本条件、评分细则等另行制订。
Article 35 These Measures shall come into effect as of January 1, 2010.
第三十五条 本办法2010年1月1日起实施。
