Chapter 1: General Provisions
第一章 总则
Article 1 With a view to implementing Some Opinions of the General Office of State Council on Further Regulating Tendering and Bidding (Guo Ban Fa [2004] No. 56), promoting the construction of a credit system of tendering and bidding, enhancing the punishment mechanism of tendering and bidding acts that are in breach of faith, and regulating the acts of the parties concerned in tendering and bidding, these Measures are formulated in accordance with Bid Law and other relevant laws.
第一条 为贯彻《国务院办公厅关于进一步规范招投标活动的若干意见》(国办发[2004]56号),促进招标投标信用体系建设,健全招标投标失信惩戒机制,规范招标投标当事人行为,根据《招标投标法》等相关法律规定,制定本办法。
Article 2 Announcement of records of the illegal tendering and bidding acts of the parties concerned shall be governed by these Measures.
Parties concerned in tendering and bidding, as mentioned in these Measures, refer to the bidder, tenderer, bidding agency and the bid evaluation committee members.
Records of illegal tendering and bidding acts as mentioned in these Measures refer to the records of relevant administrative authorities' decisions, in their legal performance of duties, on punishment meted out to the illegal acts of the parties concerned in tendering and bidding.
第二条 对招标投标活动当事人的招标投标违法行为记录进行公告,适用本办法。
本办法所称招标投标活动当事人是指招标人、投标人、招标代理机构以及评标委员会成员。
本办法所称招标投标违法行为记录,是指有关行政主管部门在依法履行职责过程中,对招标投标当事人违法行为所作行政处理决定的记录。
Article 3 Relevant administrative authorities of State Council shall establish and maintain their respective platforms for announcement of records of illegal tendering and bidding acts according to their division of duties.
National Development and Reform Commission and the related administrative authorities of State Council shall formulate general policies and relevant regulations on announcement platform management.
Relevant administrative authorities of provincial people's governments shall establish and maintain their respective announcement platforms of records of illegal tendering and bidding acts according to their division of duties.
第三条 国务院有关行政主管部门按照规定的职责分工,建立各自的招标投标违法行为记录公告平台,并负责公告平台的日常维护。
国家发展改革委会同国务院其他有关行政主管部门制定公告平台管理方面的综合性政策和相关规定。
省级人民政府有关行政主管部门按照规定的职责分工,建立招标投标违法行为记录公告平台,并负责公告平台的日常维护。
Article 4 Announcement of records of illegal tendering and bidding acts shall be conducted according to the principle of being accurate, prompt and objective.
第四条 招标投标违法行为记录的公告应坚持准确、及时、客观的原则。
Article 5 Announcement of records of illegal tendering and bidding acts shall not intrude upon state secret, trade secret and individual privacy. However, the relevant records may be announced in case an involved party agrees to such announcement, or a huge impact on public interests may result, if records of illegal tendering and bidding acts concerning trade secret and individual privacy are not announced.
第五条 招标投标违法行为记录公告不得公开涉及国家秘密、商业秘密、个人隐私的记录。但是,经权利人同意公开或者行政机关认为不公开可能对公共利益造成重大影响的涉及商业秘密、个人隐私的违法行为记录,可以公开。
Chapter 2: Announcement of Records of Illegal Acts
第二章 违法行为记录的公告
Article 6 Administrative authorities of State Council and those at the provincial level (hereinafter referred to as "announcement departments") shall announce the relevant records within 20 working days after making the decisions on punishing the illegal tendering and bidding acts.
Administrative decisions of the provincial administrative authorities on punishing the illegal tendering and bidding acts shall be simultaneously notified and reported to the relevant administrative authorities of State Council.
第六条 国务院有关行政主管部门和省级人民政府有关行政主管部门(以下简称“公告部门”)应自招标投标违法行为行政处理决定作出之日起20个工作日内对外进行记录公告。
省级人民政府有关行政主管部门公告的招标投标违法行为行政处理决定应同时抄报相应国务院行政主管部门。
Article 7 Announcement of the following administrative decisions on punishing the illegal tendering and bidding acts shall be made:
1) Warning;
2) Fine;
3) Confiscation of illegal income;
4) Suspension or cancellation of bidding agency qualification;
5) Cancellation of the qualification for projects for which bidding is required by law within a certain period;
6) Cancellation of bid evaluation committee membership;
7) Suspension of the implementation of the relevant project, or retraction of the allocated funds;
8) Suspension of allocation of state construction funds;
9) Suspension of the examination and approval of construction projects;
10) Other administrative decisions made by the administrative authorities in accordance with the law.
第七条 对招标投标违法行为所作出的以下行政处理决定应给予公告:
(一)警告;
(二)罚款;
(三)没收违法所得;
(四)暂停或者取消招标代理资格;
(五)取消在一定时期内参加依法必须进行招标的项目的投标资格;
(六)取消担任评标委员会成员的资格;
(七)暂停项目执行或追回已拨付资金;
(八)暂停安排国家建设资金;
(九)暂停建设项目的审查批准;
(十)行政主管部门依法作出的其他行政处理决定。
Article 8 The announcement of records of illegal acts consists of basic content, such as, the title or name of the punished party concerned in the tendering and bidding, illegal acts, grounds for punishment, punishment decisions, time available for decision-making and the decision-making authorities.
Announcement departments may directly announce the administrative decisions on the punishment of illegal tendering and bidding acts.
第八条 违法行为记录公告的基本内容为:被处理招标投标当事人名称(或姓名)、违法行为、处理依据、处理决定、处理时间和处理机关等。
公告部门可将招标投标违法行为行政处理决定书直接进行公告。
Article 9 The time limit for announcing records of illegal acts is six months. When this time limit expires, the records shall be transferred to the back office for preservation and maintenance of records.
As regards the administrative decision on legally limiting the qualification of the party concerned in the tendering and bidding in accordance with the law, in case that the determined limitation period is longer than six months, the announcement period shall follow the decision.
第九条 违法行为记录公告期限为六个月。公告期满后,转入后台保存。
依法限制招标投标当事人资质(资格)等方面的行政处理决定,所认定的限制期限长于六个月的,公告期限从其决定。
Article 10 Announcement departments shall be responsible for establishing the information system of announcement platform, supplementing, modifying, updating the records, and ensuring that the records of illegal acts in the announcement correspond with the relevant administrative decisions.
Announcement platform information system should have in place a system that facilitates inquiry and production of old records.
第十条 公告部门负责建立公告平台信息系统,对记录信息数据进行追加、修改、更新,并保证公告的违法行为记录与行政处理决定的相关内容一致。
公告平台信息系统应具备历史公告记录查询功能。
Article 11 Announcement departments shall appropriately preserve the documents of administrative decisions on punishing illegal tendering and bidding acts in file for future reference.
第十一条 公告部门应对公告记录所依据的招标投标违法行为行政处理决定书等材料妥善保管、留档备查。
Article 12 In case a party concerned in the announcement deems that the records in the announcements disagree with the relevant administrative decisions, the said party may file a written application to the announcement department for modification and provide relevant evidence.
The announcement department shall make verification within five working days after receipt of the written application. In case the records in the announcement are indeed discordant with the administrative decisions, the announcement shall be modified and the applicant shall be duly notified; when the records on the announcement are found to be in accordance with the administrative decisions, the applicant shall be notified accordingly.
The announcement department shall not cease the announcement of the records of illegal acts prior to making a reply.
第十二条 被公告的招标投标当事人认为公告记录与行政处理决定的相关内容不符的,可向公告部门提出书面更正申请,并提供相关证据。
公告部门接到书面申请后,应在5个工作日内进行核对。公告的记录与行政处理决定的相关内容不一致的,应当给予更正并告知申请人;公告的记录与行政处理决定的相关内容一致的,应当告知申请人。
公告部门在作出答复前不停止对违法行为记录的公告。
Article 13 When administrative decisions are under administrative reconsideration or administrative litigation, the announcement department shall not cease announcing the records of illegal acts pursuant to law excluding the condition that the implementation of the administrative decisions is suspended according to law.
第十三条 行政处理决定在被行政复议或行政诉讼期间,公告部门依法不停止对违法行为记录的公告,但行政处理决定被依法停止执行的除外。
Article 14 In case the original administrative decision is altered or annulled in conformity with the law, the announcement department shall promptly alter or annul the relevant announcement and publish an appropriate statement on the announcement platform.
第十四条 原行政处理决定被依法变更或撤销的,公告部门应当及时对公告记录予以变更或撤销,并在公告平台上予以声明。
Chapter 3: Supervision and Administration
第三章 监督管理
Article 15 Relevant administrative authorities shall intensify supervision and administration over the punished party concerned in the announcement of records of illegal tendering and bidding acts in accordance with the law.
第十五条 有关行政主管部门应依法加强对招标投标违法行为记录被公告当事人的监督管理。
Article 16 Announcements of records of illegal tendering and bidding acts shall gradually realize the interconnection, mutual recognition and shall be shared. When conditions are mature, a uniform announcement platform of records of illegal tendering and bidding acts shall be established.
第十六条 招标投标违法行为记录公告应逐步实现互联互通、互认共用,条件成熟时建立统一的招标投标违法行为记录公告平台。
Article 17 Records of illegal tendering and bidding acts in the announcement shall be important references for activities such as the accreditation of qualification as a bidding agency, examination of bidding qualification for projects subject to bidding in accordance with the law, selection of bidding agencies, recommendation and determination of the winning bidder, determination of bid evaluation committee membership and appraisal of bidding evaluation experts, etc.
第十七条 公告的招标投标违法行为记录应当作为招标代理机构资格认定,依法必须招标项目资质审查、招标代理机构选择、中标人推荐和确定、评标委员会成员确定和评标专家考核等活动的重要参考。
Article 18 In case the relevant administrative authority or any functionary therein neglects their duty, practices falsification of records, or favoritism in providing, collecting and announcing related information, a notice of criticism concerning such authority or functionary, as the case may be, shall be made by the involved entity or the higher authority. The person directly liable or the relevant person directly responsible shall be subject to liabilities in accordance with the law; if a crime is made out, the parties concerned shall be transferred to the judicial organ which shall execute criminal punishment against them according to the law.
第十八条 有关行政主管部门及其工作人员在违法行为记录的提供、收集和公告等工作中有玩忽职守、弄虚作假或者徇私舞弊等行为的,由其所在单位或者上级主管机关予以通报批评,并依纪依法追究直接责任人和有关领导的责任;构成犯罪的,移送司法机关依法追究刑事责任。
Chapter 4: Supplementary Rules
第四章 附则
Article 19 Development and reform departments and other relevant departments in all provinces, autonomous regions and municipalities under the Central Government may, in light of these measures, formulate specific measures for implementation together with the relevant departments.
第十九条 各省、自治区、直辖市发展改革部门可会同有关部门根据本办法制定具体实施办法。
Article 20 The National Development and Reform Commission shall, in conjunction with the relevant departments of the State Council, be responsible for the interpretation of these Measures.
第二十条 本办法由国家发展改革委会同国务院有关部门负责解释。
Article 21 These Measures shall become effective from January 1, 2009.
第二十一条 本办法自2009年1月1日起施行。
