The people's governments of all districts and counties (autonomous counties) and the relevant departments of the Municipal Government,

For the purposes of making the allocation of special financial fund more scientific and transparent and improving the using efficiency of financial fund, the following opinions are hereby put forward on the bidding allocation reform for trial implementation of agriculture-related special financial fund upon the approval of the Municipal Government:

    各区县(自治县)人民政府,市政府有关部门:

    为进一步增强财政专项资金分配的科学性和透明度,提高财政资金使用绩效,经市政府同意,现对财政涉农专项资金试行招投标分配改革提出如下意见:

I. Guidelines

Following the scientific view of development, and conscientiously implementing the spirit of the third plenary session of the 17th Central Committee of the Communist Party of China and the fourth plenary session of the third Municipal Party Committee, you shall emancipate mind, seek reform and innovation, adhere to scientific financing, handle financial affairs in the interest of the people, strengthen the consciousness of performance first, innovate fund allocation mechanism and endeavor to raise the management level and using efficiency of special financial fund for promoting the construction of a new countryside and the urban-rural overall development.

       一、指导思想

    以科学发展观为统领,认真贯彻党的十七届三中全会和市委三届四次全会精神,解放思想、改革创新,坚持科学理财、为民理财,强化绩效优先观念,创新资金分配机制,努力提高财政专项资金管理水平和使用效益,推动新农村建设,促进城乡统筹发展。

II. Basic principles

1. Highlighting key points. Special financial fund which is brought into the bidding allocation refers to the special subsidies of the central finance or the public welfare special fund which has been listed in the annual financial budget for the rural areas, namely the special financial fund mainly used for rural people's livelihood construction projects, infrastructure construction and the development of social and cultural undertakings. The using time and using objects thereof are selectable.

2. Performance first. The management of performance shall cover the whole process of the allocation and use of the special financial fund. The performance objective is the major judgment criterion for selecting the special financial fund projects. The performance evaluation index shall not only involve fund performance indexes such as project quality, capital investment proportioning, output benefits, et cetera, but also involve social benefit indexes such as the participation and recognition degree of villagers. 

3. Be open and transparent. The performance evaluation index and bidding procedures shall be made public for mass discussion and villages and towns (village community) application. Besides, a variety of forms such as expert appraisal, consultation between departments, et cetera shall be brought in so as to make the whole process, namely, the allocation, use, and final accounts of the special financial fund, open, transparent and under supervision. 

4. Regulating management. Bidding allocation reform shall be carried out without changing the current allocation pattern of the special financial fund, changing the right of examination and approval and the right of management of administrative departments for relevant projects or affecting the administrative departments' performance of administrative functions.

5. Promoting steadily. In combination with the management practice of special financial fund, the reform shall be firstly carried out in rural highway, rural drinking water, small farmland water conservancy, rural production and use of marsh gas, rural primary and secondary school buildings, rural activity center and other projects on a trial basis so as to be adjusted and perfected continuously and to be developed gradually.

       二、基本原则

    (一)突出重点。纳入招投标分配的财政专项资金是指中央财政专项补助或已列入年度财政预算用于农村的公益性专项资金,即主要用于农村民生工程、基础设施建设和社会文化事业发展的财政专项资金。这些资金在使用时间和对象上具有可选择性。

    (二)绩效优先。绩效管理应贯穿财政专项资金分配和使用的全过程,绩效目标是财政专项资金项目遴选的主要判断标准。绩效评价指标不仅要有工程质量、资金投入配比和产出效益等资金效益指标,还要引入村民参与度、认同度等社会效益指标。

    (三)公开透明。公开绩效评价指标,公开招投标程序,群众讨论,乡镇(村社)申报,引入专家评审、部门会商等多种形式,使财政专项资金从分配、使用、决算全程公开透明并接受监督。

    (四)规范管理。实行招投标分配改革,不改变现行财政专项资金的分配格局,不改变主管部门对相关项目的审定权、管理权,不影响主管部门行使行政管理职能。

    (五)稳步推进。结合财政专项资金管理实际,首先在农村公路、农村饮水、小型农田水利、农村沼气、农村中小学校舍、村活动中心等项目试行,不断调整完善,并逐步拓展。

III. Implementation methods

1. For a project which has been under overall planning but needs to be implemented by steps, after announcing the bidding conditions to districts and counties (autonomous counties) and the districts and counties (autonomous counties) have put forward the implementation programs, relevant departments of the Municipal Government shall, in light of the requirement of "best condition, least time", determine the excellent specific implementation order of the project in districts and counties (autonomous counties), which is to be adopted.

2. For a project which may be implemented in some districts and counties (autonomous counties) selected, after announcing the bidding conditions to districts and counties (autonomous counties) and on the basis of the specific implementation suggestions put forward by all these districts and counties, relevant departments of the Municipal Government shall, in light of the requirement of "selecting the good from the all, selecting the excellent from the good", organize appraisal to determine the districts and counties (autonomous counties) and entities where the project shall be implemented, which are to be selected.

       三、实施方式

    (一)对于已有总体规划但需分步实施的项目,采取向区县(自治县)公布招投标条件,区县(自治县)提出实施方案后,由市政府有关部门按照“条件最优,时间最快”的要求,择优确定项目在区县(自治县)的具体实施顺序。

    (二)对于可在区县(自治县)之间选择实施的项目,采取向区县(自治县)公布招投标条件,并在各地提出具体实施建议的基础上,由市政府有关部门按照“多中选好,好中选优”的要求,组织评审确定项目实施区县(自治县)和单位。

IV. Clarifying responsibilities

1. Public finance departments at the level of a districted city are in charge of guiding a review of the supporting direction, using objects, nature of fund and other basic information of the existing special financial funds and making classification and selection in accordance with the nature of the special funds so as to determine the special funds to be brought into the bidding allocation scope.

2. Relevant departments of the Municipal Government are responsible for researching the special funds brought into the bidding allocation one by one, working out the work implementation program, putting forward the specific methods for implementing bidding allocation, perfecting the expert database and establishing performance evaluation system and information announcing mechanism.

3. The public finance departments and other relevant departments of all the districts and counties (autonomous counties) are the implementation body of the special financial funds and projects and are responsible for organizing the specific application and implementation of projects, and the allocation, management and performance evaluation of funds.

       四、明确责任

    (一)市级财政部门负责牵头对现有财政专项资金的扶持方向、使用对象、资金性质等基本情况进行清理,并按专项资金性质进行分类、筛选,确定纳入招投标分配范围的专项资金。

    (二)市政府有关部门负责对纳入招投标分配的专项资金逐项研究,制订工作实施方案,提出实行招投标分配的具体办法,完善专家库,建立绩效评价体系和信息发布机制。

    (三)各区县(自治县)财政及相关部门是财政专项资金和项目的实施主体,具体组织项目的申报、实施,资金的拨付、管理及绩效考评。

V. Appraisal procedures

1. Determining application conditions. The administrative departments at the level of a districted city shall, in light with the requirements for the nature and performance evaluation of the special financial fund for bidding allocation, determine the application conditions. The application projects which are qualified shall be brought into the bidding allocation scope. 

2. Submitting application materials. Districts and counties (autonomous counties) and entities which meet the projects' application conditions and participate in the bidding allocation of special financial fund shall, in accordance with relevant requirements, submit project application materials to administrative departments and public finance departments at the level of a districted city within the prescribed time limit.

3. Organizing project appraisal. Administrative departments and public finance departments at the level of a districted city shall, in light of the project application materials submitted by districts and counties (autonomous counties) and entities, organize experts to make appraisal according to determined project appraisal elements so as to determine the projects, districts and counties (autonomous counties) and entities selected and make public announcement.

       五、评审程序

    (一)确定申报条件。市级主管部门根据实行招投标分配的财政专项资金性质和绩效考评的要求,确定申报条件。对符合条件的申报项目,纳入招投标分配范围。

    (二)报送申报材料。符合项目申报条件,参与财政专项资金招投标分配的区县(自治县)及单位,按照有关要求,在规定时限内向市级主管部门和财政部门报送项目申报材料。

    (三)组织项目评审。市级主管部门和财政部门根据区县(自治县)和单位报送的项目申报材料,组织专家按照确定的项目评审要素予以评审,确定中选项目和区县(自治县)单位,并予以公示。

VI. Management and supervision

1. Villages and towns (village community), which have obtained the special financial fund for bidding allocation, shall establish project announcement system in order to announce the time, scale, standards, collection and use of funds and other information about the implementation of projects. Public announcements shall be made for projects require the investment of farmers such as rural production and use of marsh gas and projects need the labor inputting and capital changed by goods by farmers such as rural highway. All links of the implementation of the above mentioned projects shall be subject to the supervision of the society and the masses consciously.

2. Project implementation entities, which have obtained the special financial fund for bidding allocation, shall, in light of state financial and economic systems, conduct accounting, strengthen management, utilize the fund for the exclusive purpose and actively cooperate with the supervision and inspection of relevant departments.

3. Relevant districts and counties (autonomous counties), which have obtained the special financial fund for bidding allocation, shall provide the performance evaluation report of project fund of the year before for administrative departments and public finance departments at the level of a districted city at the beginning of every year.

4. Departments, entities and individuals, which violate laws, regulations or relevant provisions on the management of special financial fund, shall be punished seriously in accordance with Budget Law of the People's Republic of China, Regulation on Penalties and Sanctions against Illegal Fiscal Acts and other relevant provisions.

       六、管理与监督

    (一)获得财政招投标分配专项资金的乡镇(村社),应建立项目公示制度。将项目实施的时间、规模、标准、资金筹集和使用等信息予以公示。需要农民出资的项目如农村沼气等,或需要农民投劳折资的项目如农村公路等,必须上墙公示,自觉接受社会和群众对项目实施各个环节的监督。

    (二)获得财政招投标分配专项资金的项目实施单位,要按照国家财经制度进行会计核算,加强管理,专款专用,积极配合有关部门的监督检查。

    (三)获得财政招投标分配专项资金的相关区县(自治县),应在每年年初向市级主管部门和财政部门提供上年度项目资金的绩效评价报告。

    (四)对部门、单位和个人违反法律法规和财政专项资金管理有关规定的,按照《中华人民共和国预算法》、《财政违法行为处罚处分条例》及其他有关规定严肃处理。
