To the people's governments of all provinces, autonomous regions and municipalities directly under the Central Government, all the relevant departments of the State Council, and the Xinjiang Production and Construction Corps:

With a view to standardizing the policies for individual housing provident fund loans, pursuant to the Regulations of the Administration of Housing Provident Fund and the Notice of the State Council on Firmly Curbing the Surging Housing Prices in Certain Cities (Guo Fa [2010] No. 10), relevant issues are hereby notified as follows upon approval of the State Council:

    各省、自治区、直辖市人民政府,国务院各有关部门,新疆生产建设兵团:

    为规范住房公积金个人住房贷款政策,根据《住房公积金管理条例》和《国务院关于坚决遏制部分城市房价过快上涨的通知》(国发〔2010〕10号)的有关规定,经国务院同意,现就有关问题通知如下:

1. Individual housing provident fund loans may only be used for paying the purchase, construction, renovation and heavy maintenance of ordinary housing for owner-occupation by contributing employees, so as to support basic housing needs. It is strictly prohibited to use individual housing provident fund loans for speculative property purchase.

       一、住房公积金个人住房贷款只能用于缴存职工购买、建造、翻建、大修普通自住房,以支持基本住房需求。严禁使用住房公积金个人住房贷款进行投机性购房。

2. The continuity and stability of the policies for use of individual housing provident fund loans to purchase the first ordinary owner-occupation home by a contributing employee family (including the borrower, his/her spouse and their minor child, hereinafter the same) shall be maintained. Where the family uses individual housing provident fund loans to purchase its first ordinary owner-occupation home of no more than 90 square meters large in built-in space, the down payment required shall be no less than 20% of the total purchase price; if such a home is more than 90 square meters large in built-in space, the down payment required shall be no less than 30% of the total purchase price.

       二、保持缴存职工家庭(包括借款人、配偶及未成年子女,下同)使用住房公积金个人住房贷款购买首套普通自住房政策的连续性和稳定性。使用住房公积金个人住房贷款购买首套普通自住房,套型建筑面积在90平方米(含)以下的,贷款首付款比例不得低于20%;套型建筑面积在90平方米以上的,贷款首付款比例不得低于30%。

3. Individual housing provident fund loans for a second home shall only be disbursed to a contributing employee family whose per capita housing floor space is below the local average level. Such loans shall be used exclusively for purchase of an ordinary owner-occupation home for improvement of living conditions. In the foregoing case, the down payment shall be no less than 50% of the total purchase price, and the interest rate shall be at least 1.1 times the interest rate for purchase of a first home at the corresponding period.

       三、第二套住房公积金个人住房贷款的发放对象,仅限于现有人均住房建筑面积低于当地平均水平的缴存职工家庭,且贷款用途仅限于购买改善居住条件的普通自住房。第二套住房公积金个人住房贷款首付款比例不得低于50%,贷款利率不得低于同期首套住房公积金个人住房贷款利率的1.1倍。

4. Individual housing provident fund loans shall no longer be disbursed to a contributing employee family that is buying a third home, etc.

       四、停止向购买第三套及以上住房的缴存职工家庭发放住房公积金个人住房贷款。

5. Urban housing provident fund management committees shall, based on local housing prices, housing floor space per capita and the business development of housing provident funds, uphold the principle of supporting the borrowing needs of contributing employee families to purchase ordinary owner-occupation home, reasonably determine the maximum amount of individual housing provident fund loans, and report the same to departments of housing and urban-rural development, finance departments, branches of the People's Bank of China (PBOC) and bureaus of the China Banking Regulatory Commission (CBRC) at the provincial level for record-filing. Municipalities directly under the Central Government and the Xinjiang Production and Construction Corps shall report the maximum amount of their individual housing provident fund loans to the Ministry of Housing and Urban-Rural Development, the Ministry of Finance (MOF), the PBOC and the CBRC for record-filing.

       五、城市住房公积金管理委员会要根据当地住房价格、人均住房建筑面积和住房公积金业务发展状况,以支持缴存职工购买普通自住房的贷款需求为原则,合理确定住房公积金个人住房贷款最高额度,并报省级住房城乡建设、财政、人民银行、银监部门备案。直辖市、新疆生产建设兵团住房公积金个人住房贷款最高额度报住房城乡建设部、财政部、人民银行和银监会备案。

6. Urban housing provident fund management centers and entrusted banks shall take effective measures to strengthen the investigation, examination, security, disbursement, recovery, etc., of individual housing provident fund loans, and effectively enhance credit risk management to ensure fund safety. Housing provident fund management centers shall, in conjunction with relevant authorities, lose no time in establishing an information sharing mechanism to guard against such acts as defrauding individual housing provident fund loans. In addition, they shall simplify the formalities and improve service levels. 

People's governments of the cities concerned shall, in light of local realities, promptly formulate specific measures for the implementation of this Notice, and actively manage well policy explanation. People's governments of all provinces, autonomous regions and municipalities directly under the Central Government as well as relevant departments of the Xinjiang Production and Construction Corps shall enhance work guidance, and intensify supervision and inspection. Issues encountered in policy implementation shall be promptly reported to the Ministry of Housing and Urban-Rural Development, the MOF, the PBOC and the CBRC.

       六、城市住房公积金管理中心和受委托银行要采取有效措施,加强住房公积金个人住房贷款的调查、审核、抵押、发放、回收等工作,切实加强贷款风险管理,保障资金安全。住房公积金管理中心要会同有关主管部门,抓紧建立信息共享机制,防范骗取住房公积金个人住房贷款等行为。同时,要简化办理手续,提高服务水平。

    城市人民政府要结合当地实际,抓紧制定落实本通知精神的具体措施,积极做好政策解释工作。各省、自治区、直辖市人民政府和新疆生产建设兵团有关部门要加强工作指导,加大监督检查力度。政策执行中有关问题,及时报住房城乡建设部、财政部、人民银行和银监会。
