LEASE AGREEMENT

This Lease Agreement (hereinafter referred to as the "Lease"), is executed this 27th day of August, 1990, by and between MARIANNA PARTNERS LIMITED, a New Mexico limited partnership (hereinafter referred to as the "Landlord") and WILD OATS MARKET OF SANTA FE, INC., a New Mexico corporation, (hereinafter referred to as the "Tenant").

WITNESSETH:

In consideration of the mutual covenants and agreements hereinafter set forth, Landlord and Tenant covenant and agree as follows:

 

ARTICLE I
DEMISE OF PREMISES; QUIET ENJOYMENT

SECTION 1.01. DEMISE OF PREMISES. Subject to the terms, conditions, covenants, and undertakings hereinafter set forth, Landlord does hereby lease to Tenant those certain Premises described as follows (including the existing Building thereon):

An approximately 14,850 square foot free-standing building located on that certain parcel of land containing approximately 68,000 square feet located on the northwest corner of St. Francis Drive and Cordova Road in the City of Santa Fe, New Mexico, more particularly described on Exhibit "A" attached hereto and incorporated herein by reference. The parties acknowledge that 14,850 square feet is an approximation of the area of the existing building and that Landlord does not guarantee the area thereof.
