Manslaughter翻译为“非预谋杀人罪”。指无预谋恶意地非法终止他人生命的行为。普通法把非预谋杀人罪分为非预谋故意杀人和过失杀人两类，对前者的处罚重于后者。

美国多数司法区仍采用此种分类法，但有些司法区采用了新的分类标准，如纽约州按刑罚轻重将非谋杀罪分为一级非谋杀罪和二级非谋杀罪；新泽西州分为加重非谋杀罪和一般非谋杀罪。

非自愿的非预谋性杀人罪，是指杀人的行为或结果并非出于行为人的故意，更非具有杀人预谋的杀人行为。

过失杀人罪（involuntary manslaughter ）：

非预谋杀人罪的一种类型，与非预谋故意杀人罪相对。指没有杀人或重伤的故意但出于犯罪性疏忽或在实行不包括在重罪-谋杀规则之内的重罪的过程中造成他人死亡的行为。

在我国刑法中，有“过失致人死亡罪”（Guilt of manslaughter），是指由于行为人的过失，致他人死亡的行为。按中国刑法属于侵犯公民人身权利、民主权利罪。本罪主要特征：

（1）犯罪主体必须是达到刑事责任年龄和有刑事责任能力的自然人。中国刑法规定，犯过失杀人罪的，年满16周岁以上的人才负刑事责任。

（2）犯罪的直接客体必须是他人的生命。

（3）主观上只能由过失构成。即疏忽大意或过于自信的过失。（4）客观上必须造成致人死亡的后果。如果没有造成他人死亡，则不构成本罪。

在认定本罪时，要划清故意杀人和过失杀人的界限。
