be entitled to和have the right to,二者均可以解释为“有权利做某事”。在很多合同翻译中,这两个词也经常出现混用的情况,但是究竟二者能不能互换呢?匠匠这里作一个简要的说明:
1 be entitled to深层含义是be given the right to do sth,即“(尤其是法律赋予)权利做某事”,体现了该等权利的强制性;而
2 have the right to深层含义是权利主体本身就有权利做某事,无需任何其他方的同意或授权。与reserve the right to含义相似,但是reserve the right to体现法律上规定的权利,比have the right to更加正式。
以上是二者之间的差别,所以在使用时,主要是中译英,千万要斟酌。
