知识产权，文为“intellectual property”，也被翻译为智力成果权、智慧财产权或智力财产权。是“基于创造成果和工商标记依法产生的权利的统称”。最主要的三种知识产权是著作权（copyright）、专利权（patent right）和商标权（trademark right），其中专利权与商标权也被统称为工业产权（industrial property right）。

在我国，知识产权的保护范围包括发明专利（patent for invention）、实用新型专利（patent for utility models）、外观设计专利（registation of design）、商标（trademarks）、著作权（copyright）、工业版权（industrial property right）。

《民法典》中第一百二十三条规定：

民事主体依法享有知识产权。知识产权是权利人依法就下列客体享有的专有的权利：

《商标法》第三条规定：

经商标局核准注册的商标为注册商标（registered trademark），包括商品商标（goods marks）、服务商标（service mark）、证明商标（certification mark）；商标注册人享有商标专用权，受法律保护。

《商标法》第五条规定：

对违法法律、社会公德或者妨害公共利益的发明创造。不授予专利权。

对违反法律、行政法规的规定获取或者利用遗传资源，并依赖该遗传资源完成的发明创造，不授予专利权。
