Divorce/Annulment/Dissolution of marriage

1.Divorce

divorce 用于指完全意义的离婚（absolute divorce），也可指中止婚姻关系的效力（即部分离婚或有条件限制的离婚），至少是中止双方当事人的同居。

英文释义

The legal ending of a marriage; specifically, the legal dissolution of a marriage by a court.

legislative divorce   由立法机关通过颁布法令所确认的离婚

judicial divorce   判决离婚；司法离婚

2.Annulment

annulment 宣布婚姻无效，则是确认此种合法地位从未存在过。

英文释义

A judicial or ecclesiastical declaration that a marriage is void. An annulment establishes that marital status never existed in law.

3.Dissolution of marriage

dissolution of marriage 解除婚姻关系，多被认为是“divorce”的一种委婉说法，也是指终止一种合法的婚姻地位，包括因配偶死亡而使婚姻关系解除。在涉及离婚时，人们一般用“divorce”，而不用“dissolution of marriage”。

但在美国，无过错离婚或除感情破裂而无法重修旧好外的不列举具体离婚原因之“离婚”，通常不称“divorce”，而称“dissolution of marriage”。

英文释义

A divorce-like remedy available when both spouse have signed a separation agreement that deals with the issue of alimony and children; dissolution of marriage terminates the marriage as of the date of the judgment of dissolution.

离婚依据

英国

离婚的依据只有一个，即婚姻无法挽回的破裂（irretrievable breakdown），可以由五种情况证明:

1. 通奸（adultery）

2. 无理行为（unreasonable conduct）

3. 遗弃长达2年（desertion for two years）

4. 分居2年且双方同意离婚（separation for two years and the parties agree to a divorce）

5. 分居5年（separation for five years）

离婚诉讼多由郡法院或伦敦的离婚法院（divorce registry）受理，除少数因争议抗辩的案件（defended cases）须移送高等法院外，大部分案件均按一种特别程序（a special procedure）不经完全审理即可离婚。

美国

美国的离婚属于制定法调整。一般分为过错离婚（fault divorce）和无过错离婚（non-fault divorce）两种。

过错离婚

过错离婚的依据有：通奸（adultery）、虐待（cruelty）、违反自然的性行为或反常性行为（crimes against nature or sexual perversions）、酗酒或吸毒（drunkenness）、犯重罪或被监禁（felony or imprisonment）、性无能（incapacity or impotency）、 精神病（insanity）、企图谋杀对方（attempted murder of a spouse）等。

无过错离婚

无过错离婚的依据有:双方同意离婚（mutual consent）、分居长达一定期限（separation for a certain time）、感情不和（incompatibility）、婚姻关系无法挽回的破裂（irretrievable breakdown of a marriage）。

过错离婚一般由州最高法院（State Supreme Court）受理,无过错离婚的程序比过错离婚简单一些，有些州规定有简易离婚程序（summary dissolution procedure），但仍须由州最高法院处理。
