三者均有“不作为”的含义。

 Negative act

negative act也称为act of omission，指不履行法定义务，“不作为”。严格说来，negative act包括两种情况，即 forbearance和 omission。forbearance指有意不作为，为一种 intentional negative act。

英文释义：

The failure to do something that is legally required; a nonoccurrence that involves the breach of a legal duty to take positive action.

Forbearance

n.

1、容忍;忍耐;克制。关于高利贷的立法中，指债权人在约定的期限内不得要求债务人偿还到期的债务。

2、推迟行使某项权利;不行使某项权利;不起诉。

3、推迟债务人清偿债务的期限；

4、延迟偿还债务的协议。

英文释义：

1. The act of tolerating or abstaining.

2. The act of refraining from enforcing a right,obligation, or debt.

Omission

n.

1、省略的东西;遗漏的东西。

2、疏忽;懈怠。指忽视或未为一定行为，尤指未为法律、职责或特定环境要求从事的行为，一定条件下行为人须对此承担刑事责任。

omission（古时称为omittance）则多指一种非故意的不作为行为（an unintentional negative act）。

英文释义：

1. A failure to do something; esp, a neglect of duty.

2. The act of leaving something out.

3. The state of laving been left out or of not having been done.

4. Something that is left out, left undone, or otherwise neglected.
