claim clause是指索赔条款。索赔条款在货物买卖合同中较为常见。在国际贸易上,买方收到的货物,如发生损害或与合同约定不符,可向有关负责人要求赔偿。买方索赔的对象通常有三个，即合同承运人( contract carrier) 、 保险公司( insurance company)及 卖方( the seller)。 对卖方的索赔,常见的是有关质量、数量、包装、交货等方面的索赔,这一类索赔范围甚广，责任也不易确定。因此,为早日确定责任起见,通常即在买卖合同中订立索赔条款。

例1 The seller shall not be liable for any claims unless theyare made promptly after receipt of the goods and due opportunity hasbeen given for investigation by the seller's own representatives. Goods must not be returned except by permission of the seller.

[参考译文] 除非买方收到货物后即刻提出索赔,并给与卖方的代表有调查的相当机会,否则卖方对于索赔不予负责。除非获卖方同意,货物不得退回。

例2 Within how many days should the claim for insurancebenefit be submitted ?

例3 A citizen, a legal person or any other organization who suffers damage because of the infringement upon his or its lawful rights and interests by a specific administrative act of an administra-tive organ or the personnel of an administrative organ, shall have the right to claim compensation.

[参考译文] 公民、法人或者其他组织的合法权益受到行政机关或者行政机关工作人员做出的具体行政行为侵犯造成损害的，有权请求赔偿。

例4 He claimed on the insurance after he had a car accident.

[参考译文]他在车祸后就向保险公司索赔了。

claim一词在法律文件中的使用频率很高，除了上述例句中claimed on the insurance( 向保险公司索赔)的用法外，还有一些短语,例如:claims-consciousness(权利意识;法律意识)、small claims court ( 小额索赔法院)、 claim of lien( 留置权的请求权)、claim to the throne (要求继承王位)、claim settle-ment(理赔),等等。

此外，claim有时还具有“夺走生命”之意,

例如:The accident claimed three lives. (那场事故，夺走了3条人命。)
