法律文件中的custodian，custodial和custody是比较容易混淆的三个词。

custodian作为法律术语,是对财产、证券、文件或其他资产进行监督管理的个人或金融机构的统称。在破产程序中,custo-dian也指根据强制性授权委托,为了整体债权人的利益而管理债务人资产的第三人，如破产事务官、受托管理人等。

例：Custodian shall send advices with respect to all security andprincipal cash transactions to the insurance company.

[参考译文] 托管人应当向保险公司寄送关于担保与主要现金交易的建议。

Mutual fund custodian holds and safeguards securities owned by a mutual fund.

[参考译文]共同基金托管人持有并监管共同基金所拥有的有价证券。

custody最重要的两个意思就是“羁押、关押”或“监护(权)”。重要的短语有be held in custody( 被羁押)、in custody(被羁押状态)、take into custody(羁押)、be placedin custody of sb. (交由某人监护),等等。

例Since her arrest, the police never notified her family of the reason for her detention, nor told them where she was held or her condition in custody.

[参考译文] 自从她被逮捕以来,警方一直没有通知她的家人她被拘留的原因,也没有告诉他们她被拘留在何地,或者她被羁押以来的情况。

A person charged with a crime will be held in custodyin accordance with law.

[参考译文]被指控犯罪的人应被依法羁押。

custodian指实施监管的主体,custody则指实施监管的行为;custodial是形容词,意为“被监管的”或“监管人的”。

例Custodial account is created for the benefit of a minor , usually at a bank, mutual fund, or brokerage, with an adult as the custodian.

[参考译文]保管账户是成年人作为监护人,通常在银行、共同基金或者通过经纪行业,为方便未成年人开立的账户。
