fault n. 过错（失）

指作为侵权行为或不法行为责任的构成条件的一种心理状况

fault是法律英语中极为常见的一个词，和普通英语中一样，译为“过错（失）”，但是，在法律中，“过错”有着特殊的含义，指作为侵权行为或不法行为责任的构成条件的一种心理状况。

区分fault和negligence

fault和negligence是侵权法中最常见的责任原因。

fault 常指一种故意违法行为或故意不作为，而negligence (过失)则指没有尽到应有的小心或注意。fault 有时也可被视为包括negligence或等同negligence ，故此时其应为“过失”;有时fault 又不同于negligence,此时其应为“过错”。
