在法律英语中，lease可以被翻译为“租赁”、“租约”、“出 租”，该词语既可作动词，又可作名词。所谓的“租赁”是指出租 人将其土地、房屋以一定期限交付承租人占有和使用，承租人 支付租金的协议。由于lease具有不同的含义，读者要注意根据 不同的语境选用合适的释义。

例 Party A further represents and warrants that the Land is free and clear of any and all claims, charges, easement, encumbrances, lease, covenants, security interest, liens, option, pledge, rights of others, or restrictions, whether imposed by agreement, understanding, law, equity or otherwise.

注：lessor是指“出租人”。在租赁关系中，出租财产的 人被称为出租人（lessor； landlord），接受财产并占有和使用的一 方为承租人（lessee； tenant） c租赁的特点是：（1 ）出租人对租赁 物拥有的产权必须大于承租人取得的权益，如两者相等则属不 动产转让而非租赁；（2）承租人取得租赁物的排它占有权，否则 不是租赁而仅是使用许可；（3）出租人在租赁期满后保留租赁 物的复归权。
