经常在译文中看到有的译友将consist of译为“包括”，这其实是经不起推敲的。包括英文最常见的是include，合同中也常用到，其后面列举的是一个或者一系列并非详尽的事项，表示除了列举的事项外，还有其他的事项，而consist of后面列举的是详尽无遗的事项，比如：

Most of these groups consist of graduate students and faculty.

绝大多数的小组由研究生和教职人员组成。

说明这些小组由研究生和教职人员组成，除此之外，没有其他。

而Most of these groups include graduate students. 

这样表达并不能说明没有其他成员。

例1

The Board of the Company shall have been constituted in accordance with the Restated Articles, so that as of the Closing, the Board of the Company shall consist of five (5) directors, of which one (1) director shall be appointed by B Company, initially Ms.XX, one (1) director shall be appointed by A L.P.,initially YY (collectively with the B Company Director, the “Investor Directors” and each an “Investor Director”), three (3) directors shall be appointed by the Founder Holdcos, initially ZZ, WWandCC.

董事会按照重申章程的规定组建,所以,在交割日,公司的董事会由五(5)名董事组成, 其中一 (1)名董事必须由B公司任命,首任董事为XX女士,一(1)名董事应当由A有限合伙任命,首任董事为YY (与B公司董事合称“投资方董事”,单独称为“各投资方董事”),三(3)名董事应由创始人控股公司任命,首任董事为ZZ,WW和CC。

例2

The name of an Investor and the fact that such Investor is a shareholder of the Company can be included in a reusable press release boiler statement, so long as such Investor has given the Company its initial approval of such boilerplate statement and the boilerplate statement is reproduced in exactly the form in which it was approved.

投资者的名称及投资者成为公司股东的事实可以包含在一个可重复使用的新闻稿声明中,只要投资者最初批准了该声明模板，且已经批准的声明模板重现。
