合同中的可分割条款（Severability clause），指的是合同或者法律文件中部分或某一条款非法、无效或不可执行时，其他条款或条件不受影响。所谓可分割即指部分条款的无效、无法履行、不能被强制执行，不影响其他条款。

Severability是Severable的变形，Severable：separable or capable of being treated as separate from a whole legal right or obligation 可分离的，可分离或能够从整个法律权利或义务中分离出来的。如：a severable contract obligation可分离的合同义务。

可分割条款一般包括：

一、说明部分条款的无效、无法履行、不能被强制执行，不影响其他条款

二、合同双方是否同意采取替代条款，及对替代条款的要求

常见的可分割条款模板：

The invalidity of any provision of this Agreement shall not affect the validity of any other provision of this Agreement. Any invalid provision shall be replaced by a provision that is valid and that comes closest to expressing the intention of such invalid provision.

本协议任何条款的失效不应影响本协议任何其他条款的效力。任何无效条款应为最接近表明该无效条款意向的有效条款所代替。

Should provisions of this Agreement be or become invalid or unenforceable in part or in whole, this shall not affect the validity of the other provisions of this Agreement. Ineffective or unenforceable provisions shall be automatically replaced by valid or enforceable provisions that come as close as possible to the intended purpose and the intentions of the parties to the Agreement.

若本协议的规定部分或全部变得无效或不可执行，这不得影响本协议其他规定的有效性。无效或不可执行的规定应自动由最接近协议各方的预期目的和意图的有效的和可执行的规定予以取代。

If any provision of this Agreement is held invalid, illegal or unenforceable in any respect, the validity, legality and enforceability of the remaining provisions shall not in any way be impaired. The Parties shall then use all reasonable endeavors to replace the invalid or unenforceable provision by a valid and enforceable substitute provision the effect of which is as close as possible to the intended effect of the invalidated or unenforceable provision.

如本协议的任何规定无效、违法或无法执行，本协议其余条款的有效性、合法性和实施性均不应受到任何程度的影响。双方应尽力用有效和可执行的替代条款来取代原无效或无法执行的条款，该替代条款应最大程度上接近接近原无效或无法执行的条款的意图。

In the event that one or more of the provisions of this agreement shall, for any reason be held by a court of competent jurisdiction to be invalid, void or unenforceable in any respect, such holding shall not affect any other provisions of this agreement.

如果本协议的一项或多项条款因任何原因被有管辖权的法院裁定在任何方面无效、无效或不可执行，该裁定不影响本协议的任何其他条款。

If any term or provision of this Lease be invalid or unenforceable, the remainder of this Lease shall not be affected thereby, and each term and provision of this Lease shall be valid and be enforced to the full extent permitted by law.

如果本租约的任何条款或规定无效或不可执行，其余部分不受影响，每项条款和规定均在法律允许的最大范围内有效并强制执行。
